PETITION TO REVOKE LETTERS TESTAMENTARY
TO THE HONORABLE,THE JUDGE OF SAID DIVISION:
The Petition of Adolph L.Zeman respectfully represents:
1.Frances Vactor Derham,a/k/a Frances V.Derham,died
on January 3,1972,testate,her Last Will and Testament having been
probated on January 7,1972,and filed in the Office of the Register
of Wills of Washington County,Pennsylvania,in Will Book 113 page
176.
2.Letters ~estamentary in said Estate were granted to
Adolph L.Zeman,the Executor named in the Will of said decedent,
by Russell Marino,Register of Wills of Washington County,Pennsylvania,
on January 7,1972.
3.Your Petitioner's health has become such that he feels
that he cannot continue to serve as Executor of the Estate of said
decedent.
4.The said Last Will and Testament of said decedent names
as alternative Executor,Robert L.Zeman,but the said Robert L.
Zeman has stated that he cannot undertake the duties of an executor
and would decline such appointment,in the event that your Petitioner's
request for revocation of the Letters granted to him be approved.
The joinder of the said Robert L.Zeman and his Renunciation are
attached to this Petition and made par~hereof.
5.The residuary legatee-devisee in said Will is Payne
A.M.E.Church,the Pastor of which is the Reverend Charles Dee
Johnson.
6.The Reverend Charles Dee Johnson is familiar with the
contents of the Will,the assets and liabilities of the Estate of
said decedent,the legatees and devisees named in the Will and the
presently known obligations of the Estate.Your Petitioner believes,
and therefore avers,that the decedent in her lifetime reposed great
confidence and,trust in the Reverend Charles Dee Johnson and would
;have named him as Executor,had she not named the said Adolph L.
Zeman and Robert L.Zeman as stated hereinabove.
7.The only action taken by your Petitioner to date in
the administration of said Estate has been to engage Zeman and Zeman
as counsel,to open an Estate checking account in the Pittsburgh
National Bank,Canonsburg Branch,to have estate notices published
as required by law,to collect and deposit in said account certain
money due the Estate,to reimburse counsel the costs advanced as
hereinafter stated,and to have communication with parties inter-
ested in the Estate.
8.The costs advanced by,and reimbursed to,the firm of
Zeman and Zeman are the following:

AS AMENDED FOR LEAVE TO MAKE PRIVATE SALE OF
REAL ESTATE
TO THE HONORABLE,THE JUDGES OF SAID COURT:
The Petition of Charles D.Johnson,Administrator,C.T.A
of the Estate of Frances Vactor Derham,a/k/a Frances V.Derham,
Deceased,by his Attorneys,Hormell,Tempest,Simmons,Bigi &
Melenyzer,respectfully represent:
1.That the Decedent,Frances Vactor Derham,a/k/a
Frances V.Derham,Deceased,died testate on January 3,1972,a
citizen of the United States and a resident of Canonsburg,Washing
ton County,Pennsylvania.
2.That the said FrancesVactor Derham,a/k/a Frances V.
Derham,at the time of her death was survived by Adolph L.Zeman,
who was the Executor of her Estate but the said Executor's health
was such that the Executor felt that he could not continue to
serve as Executor of the Estate and therefore he petitioned this
Honorable Court to revoke the Letters Testamentary to him and furth~r
requested the appointment of the Reverend Chari~es D.Johnson as
Administrator,C.T.A.of the Estate of Frances Vactor Derham,a/k/
Frances V.Derham,Deceased.
3.That Charles D.Johnson was duly appointed as
Administrator with the Will annexed for the Estate of Frances
Vactor Derham,a/k/a Frances V.Derham on April 13,1972,by the

Orphans'Court Division of the Court of Common Pleas of Washington
County,Pennsylvania.
4.That Charles D.Johnson,as Administrator,C.T.A.
acquired a bond in the amount of $2,000.00 to insure his faithful
fulfilment of his duties and said bond was acquired from the
United States Fidelity and Guaranty Company.
5.That the above decedent,at the time of his death,
as a part of his Estate,owned four contiguous parcels of ground
situate in the Third Ward of Canonsburg,Washington County,Pennsy -
vania,which are now necessary to convey in order to pay all the
just debts,funeral expenses and costs of administration and
inheritance taxes of the Estate and said parcels of ground are
described as follows:
"ALL the following four contiguous parcels of
ground:
FIRST:ALL that certain parcel of ground
situate in the Third Ward of the Borough of Canonsburg,
formerly South Canonsburg,Washington County,Pennsyl-
vania,being a part of lots Nos.8 and 9 in a plan of
lots laid out by Rachel W.VanEman and James N.VanEman,
Executors of the Estate of the late T.B.VanEman,and
designated as the "VanEman Plan of Lots",recorded in
the Recorder's Office of said county in Plan Book No.
2,Page 153,and bounded and described as follows,to wit.-
Beginning at a point at the conjunction of WanEman Street
and Brook Street;thence along land formerly owned by
James Berry one hundred and fifteen feet,the same run-
Ring in a Southwesterly direction;thence in a South-
easterly direction sixty-five feet,more or less,to
Brook Street;thence in a northerly direction along
said Brook Street one hundred and twenty-five feet to
point of beginning.
SECOND:ALL that certain parcel of ground
situate in the Third Ward of the Borough of Canonsburg,
Washington County,Pennsylvania,and known and designa-

7.That Petitioner has executed an Agreement for the
sale of the real estate to Oscelan V~Elmore and David M.Elmore,
her husband,for the sum of $24,000.00 and the specific devisees
of the subject property have also executed said Agreement in ac-
cordance with Section 543 of the Fiduciaries Act of 1949.A copy
of said Agreement is attached hereto and made a part hereof as
Exhibit "A".
8.That the total additional cash made payable to the
Estate as a result of this sale of real estate is in the amount
of $24,000.00 and your Petitioner will acquire an additional bond
in the amount of $24,000.00,or such amount as the Court shall

of the subject premises made by a licensed real estate dealer for
the Commonwealth of Pennsylvania,who is Merico Lignelli,with
Offices in Monongahela,Washington County,Pennsylvania.
12.That the purpose of this sale is necessary to pay all
the just debts,funeral expenses,costs of administration and
inheritances taxes due from the Estate of Frances Vactor Derham,

conveyance of this real estate together with a complete itemized

The Petition of Charles D.Johnson,Administrator,C.T.A.
of the Estate of Frances Vactor Derham,a/k/a Frances V.Derham,

Hahn,respectfully represent:
1.That the Decedent,Frances Vactor Derham,a/k/a
Frances V.Derham,Deceased,died testate on January 3,1972,
a citizen of the United States and a resident of Canonsburg,
Washington County,Pennsylvania.
2.That the said Frances Vactor Derham,a/k/a Frances
V.Derham,at the time of her death was survived by Adolph L.
Zeman,who was the Executor of her Estate but the said .Executor's
health was such that the Executor felt that he could not con-
tinue to serve as Executor of the Estate and therefore he petit-
ioned this Honorable Court to revoke the Letters Testamentary to
him and further requested the appointment of the Reverend Charles
D.Johnson as Adm±nistrator,C.T.A.of the Estate of Frances
Vactor Derham,a/k/a Frances V.Derham,Deceased.
3.That Charles D.Johnson was duly appointed as

Administrator with the Will annexed for the Estate of Frances
Vactor Derham,a/k/a Frances V.Derham on April 13,1972,by the
Orphans'Court Division of the Court of Common Pleas of Washing-
ton County,Pennsylvania.
4.That Charles D.Johnson,as Administrator,C.T.A.,
acquired a bond in the amount of $2,000.00 to insure his faith-
ful fulfilment of his duties and said bond was acquired from the
United States Fidelity and Guaranty Comp~ny.On August 2,1972,
by Court Order filed at No.63~72-22 the Administrator,C.T.A.
was required to acquire an additional bond in the amount of
$30,000.00 in order to make a private sale of real estate,which
was sold for the total consideration of $24,000.00,therefore,
the total bond obtained by the Administrator,C.T.A.,Charles
D.Johnson,is in the amount of $32,000.00.
5.That the above decedent,at the time of rer·death,
as a part of heF Estate,owned a parcel of ground situate in:
the Second Ward of the Borough of Canonsburg,Washington County,
Pennsylvania,which is necessary to convey in order to pay
all the bills of the decedent and in order to make a proper dis-
tribution of the Estate of the decedent,and which said parcel
of ground·~s described as follows:
ALL that certain lot of ground or piece of land
situate in the Second Ward (formerly,West Ward)of
the Borough of Canonsburg,Washington County,Pennsyl-
vania,which fronts on the Western side of Hutchinson
Avenue (formerly,Herdman's Alley),described and
bounded as follows:
BEGINNING at a point in the Western boundary line
of said Hutchinson Avenue,formerly Herdman's Alley,
at the corner of property formerly owned by Daniel
Dungee,later by Abe Katz,which said point is at the
northern side of a private alley or way that extends
westwardly from said Herdman's Alley and is a part of
the premises herein described;and thence extending
from said point along the boundary line between said
private alley or way and said property now or late of
Abe Katz,South 86°West 12 1/2 perches to land now
or late of W.H.Wheeler;thence along said land now or
late of Wheeler,South 4°East 150 feet to property now
or late of Thomas Moss;thence along said property now
or late of said Moss,North 86°East 12 1/2 perches to
Hutchinson Avenue,formerly Herdman's Alley;thence
along the western side of Hutchinson Avenue,formerly
Herdman's Alley,North 4°West ISO feet to the place of
beginning.On which is erected a frame dwelling house.

SUBJECT to all the exceptions and reservations
in the Record chain of title.
BEING the same property conveyed to the late
Frances Vactor Derham by Deed of Sadie R.Vactor,
et al.,dated March 23,1949,and recorded in the
Recorder of Deed's Office of Washington County,
Pennsylvania,in Deed Book Volume 753 page 349.
The said Frances Vactor Derham,a/k/a Frances V.
Derham,above mentioned,died on January 3,1972,
testate,and her Will was duly probated on March 3,
1972,and recorded in Will Book No.113,Page 176.
ALSO BEING the same property which was the sub-
j ect of an action to quiet title in the Court of
Common Pleas of Washington County,Pennsylvania,at
205 July Term,1972 A.D.A final judgment was entered
at said number and term perfecting title to the with-
in parcel on June 6,1973.
6.All the bills of the decedent have been paid or

the necessary arrangements have been made in order to pay all
these liens and bills of the deGedent.
7.The Petitioner has executed a Deed for the sale
of the real estate to the Borough of Canonsburg,for the sum of
$8,500.00.A copy of said Deed is attached hereto and made a
part hereof as Exhibit "A".
8.That the total additional cash made payable to
the Estate as a result of this sale of real estate is in the
amount $8,500.00,and your Petitioner will acquire an additional
bond in the amount of $8,500.00,or such amount as the Court
shall direct pursuant to Section 3351,of the Probate';,_'Estates ,-and
~iduGia~ie?,Codeoof 1972,as amended.
9.That the property is assessed for tax purposes at
is of the opinion that the price of $8,500.00 is more than what

the County of Washington for $~1,465.00 ,and your Petitioner,
said property would ordinarily bring at a public sale.
10.That the said "Seventh"Paragraph of the Last
Will and Testament of Frances Vactor Derham provides as follows:
Seventh':"I direct my Executor hereinafter
to sell my real property situate at No.11
HutchkEon Avenue,Canonsburg,(sometimes known
as Herdman's Street or Herdman's Alley),and

being an undivided two-thirds interest
therein,at public or private sale for
such price and upon such terms and con-
ditions as he shall deem to the best inter-
est of my Estate.I direct that the pro-
ceeds of said Sale shall be distributed,
one-half thereof to Reverend Charles Dee
Johnson,and remaining one-half shall ~o
into,and form part of,my residuary
estate."
Pursuant to this Section the Administrator,C.T.A.has
caused this Petition to be filed.
Also be advised that the said Reverend Charles D.Johnson,
is the Administrator,C.T.A.,and the same person referred to
in Item "Seventh"of the decedent's Last Will and Testament.
11.That attached hereto as Exhibit 'IB"is an Appraisal
of the subject premises made by a licensed real estate broker of
the Commonwealth of Pennsylvania,who is Donald E.York,MAl,
with Offices in Washington,Washington County,Pennsylvania.
12.That the said Estate of Frances Vactor Derham has
the entire simple interest in the above described property by
virtue of a Deed of a two-thirds interest from Sadie R.Vactor,
et aI,to Frances Vactor Derham,dated March 23,1949,and
which said Deed was duly recorded in the Recorder of Deeds Office
of Washington County,Pennsylvania,in Deed Book Vol.753,Page
349.The Estate acquired the entire interest in the remaining
one-third by virtue of an Action to Quiet Title filed by Charles
Dee Johnson,Administrator,C.T.A.of the Estate of Frances
Vactor Derham,Deceased,at No.205 July Term,1972,A.D.and
whicR Order of Court was dated July 26,1972.
13.That a complete accounting of the proceeds of
the conveyance of this real estate together with a complete
itemized list of all debts paid by the Administrator,C.T.A.,
will be filed in accordance with the Laws of the Commonwealth of
Pennsylvania.
WHEREFORE,your Petitioner prays your Honorable

Court under Section 3351 of the Probate,Estates and Fiduciaries
Code of 1972 as amended to grant leave to your Petitioner,after
posting bond in the amount of $.8,500.00,or such additional
amount as is required by the Court,and to authorize and empower
him to execute and deliver a Deed to the said property to the
above prospective purchasers.

Court Division of Washington County to make distribution of
the balance left for distributi6n in said ~state,as shown by
the Account and Audit Petition as corrected under and in accord
with their aforesaid Agreement of July 26,1972,and in accord

NOW THEREFORE,in consideration of One Dollar ($1.00)
and other valuable considerations,intending to be legally bound

On September 21th,f.tr.Elmore and Rev.Johnson came to TtrY office
and signed the Agreemont between the parties in the above estate.
I have noted that only on the original were the dates
of signing inserted by all partieD.Thorefore,I am sending you
one of the siqned photocopies you sont me and a photocopy of the
original at the top of whieh we have noted "original".Also,I
am sending a photooopy of the oriqinal to the other parties.I am
