FOURTH:That the said Bernard Wise is so mentally defective that
PETITION FOR GUARDIAN
To the Honorable,the Judges of said Court:
The petition of Sadie Wise,of Donora,Pa.,respectfully
represents:
FIRST:That your petitioner is a resident of Donora,Pa.,and is
a sister of Bernard Wise,who is now an inmate of the home for
mental deficients in Somerset County,of this State,of which
institution he has been a resident for a period of approximately
five years.
SECOND:That the said Bernard Wise,prior to his removal to such
institution,resided at the home of his parents at Donora,Pa.,an<
that is his legal residence.
THIRD:That,since his removal to such institution,it has been
discovered that the s8.id Bernard Wise/had a polic.y of insurance
which contained a disability clause allowing him the sum of
approximately $15.00 per month for disability arising after the
date of such policy,and the insurance carrier has expressed its
1'1illingness to make payment of such sum but requests,that,by I
reason of his condition,a guardian of his estate be first appointEd.I

he is unable to take care of his property and,in consequence ther
of,is liable to dissipate or lose the same and become the victim
of designing persons.
FIFTH:That the next of kin of the said Bernard Wise,in addition
to your petitioner,B~e his mother,Mollie Wise,who resides with
your petitioner at Donora,Pa.;a brother,Abe Wise,of Newell,_.
Pa.;a sister,Mrs.Hannah Krapin,of Washington,Pa.;a sister,
Pearl Wise,who resides at Donora,Pa.;and a sister,Esther Stern,
of Girard,Ohio.
~Your petitloner,therefore',respectfully prays your
Honorable Court for an order fixing a time and place for a hearing
of the facts set forth in this petition,and,after such hearing,
upon the finding of the mental deficiency of the said Bernard Wise,
for a further decree appointing a proper guardian of hi.s estate.

above Ntmber in Equity,alleging your inability mentally to take
care of your business,and asking that a guardian be appointed to
look a.fter your esta.te.That in said proceedings the Court made
an order fixing the 27th day of June,1942,at 10:00 o·clock A.M.,

You are hereby notified that the undersigned,sister of
Bernard Wise,caused a petition to be presented to the Judges of
the Court of Common Pleas of Washington County,Pa.,on the 13th
day of June,19~2,setting forth,inter alia,the alleged mental
deficiency of one Bernard Wise,now confined in the home for menta
deficients in Somerset County,Pa.;that such individual was
possessed of certain personal property,therein detailed;that the
petitioner believed him to be so mentally deficient as to be unabl
to care for his affairs,and asked that a guardian of his estate b
appointed.
That such Court,on such date,made an order fixing the
27th day of June,19~2,at 10:00 o'clock A.M.,at the Court House
Washington,Pa.,as the time and place at which the Court would
consider the merits of such petition a~d determine upon the
necessity of the appointment of a guardian;and directed that

Charleroi,Washington County,Pa.,is held and firmly bound unto
the Commonwealth ot Pennsylvania in the sum of Five hundred ($500.00)

Commonwealth,her certain attorney and assigns,to which payment,

WHEREAS by proceedings in the Court ot Common Pleas ot
Washington County.Pa.at No.4241 -In Equity,the Court,under and
by virtue ot the authority in it vested by the Acts of Assembly of

found that one Bernard Wise was so teeble minded as to be unable
to prop~rly oare for his estate and so might become the victim of
designing persons,and directed that the Charleroi Savings and
Trust Company,ot Charleroi,Pa.,be appointed guardian of his
estate,first tiling bond in the sum ot $500.00,without surety,
and to be approved by the Court;therefore,

Ipollcy provides for a waiver of premium and monthly allowance for
disability.
3.That in error,the insured's correct age was not
given at the time the policy was issued,and the insurance company I
requires that such error be now corrected and policy re-Issued,
wIth correct date and consequent change in values made;and has I
Irequestedyourguardiantoprocurecourtapprovalofguardian's \

to effect such correction,and so fac~litate paymont of present I

guardian of the said Bernard Wise~
SECOND:That as such guardian it now has in its possession the
sum ot 143g.4g,representing disability payments trom July 10,1940
and it will receive approximately the sum ot $13.00 per month as
long as such disability is payable under the terms ot the policy
held by its ward.

TO THE HONORABLE,THE JUDGES OF SAID COURT:
And now,this 14th day of April,1952,comes
the COMMOl-iWEALTH OF PENNSYLVANIA,DEPARTMENT OF REVENUE,and
petitions the Court as follows:
1.Bernard Wise is,and has heen,an inmate
of Somerset State Hospital since May,1941,and the cost of his
maintenance from that time to the time of the filing of this
petition amounts to the sum of $397L,.•60 (Balanoo)Attached hereto
is a detailed sworn statement of said maintenance,made by and
under the se~l of the Department of Revenue,in compliance with
the provisions of the Act of 1915,P.L.661,section 5,as
amended by the Act of 1929,P.L.704,Section 3.

showing the sum of $960.03 for distribution,on Msy 9,1949.Your
Honorable Court approved said account and directed the guardian to
pay to the Commonwealth of Pennsylvania the sum of $800.00 on
account of its claim for the care and maintenance of the said
Bernard Wise at the Somerset State Hospital,which sum was paid
on July 7,1949,and which sum was properly credited to the account.
The First National Bank of Monongahela was appointed successor guardian
to the Charleroi Savings and Trust Company.

per month,and there is presently a sum in the hands of the
guardian in excess of $968.37.

reimburse the Commonwealth for maintenance incurred to date.
