PETITION FOR THE APPOINTI1ENT OF A GUARDIAN
TO THE HONORABLE,THE JUDGES OF SAID COURT:
The petition of ARTHUR D.r1ARTIN respectfully repre-
sents:
1.Arthur D.Martin is a citizen of the Commonwealth
of pennsylvania,aged 60 years,and resides at 109 Church Street
in the City of Washington,washington County,pennsylvania,and
he has so resided for upwards of 15 years.
2.Anna May Meyer Martin is a citizen of this
Commonwealth,whose legal residence is at 109 Church street,wash-
ington,washington County,Pennsylvania,and such has been her
residence for upwards of 15 years.
3.Anna May Meyer Martin and Arthur D.Martin are
husband and Wife.
4.Anna May Meyer Martin is a patient at Dixmont
state Hospital,Allegheny County,pennsylvania.
5.Anna May Meyer Martin and Arthur D.Martin,as
tenants by the entirety,are the owners of property amounting to
about $6,500 •00 ,which consists of:
(a)vacant lot No.81 in the Colonial Heights Plan
of Lots in South Strabane Township,washington
County,Pepnsylvania,Plan Book 3,page 84 $1500.00

washington,pennsylvania $5,000.00
6.Anna May Meyer Martin has become and now is so
weak in mind that she is unable to take care of her property and
in consequence thereof is liable to dissipate or lose the same
and to become the victim of designing persons.
7.Your petitioner and Anna May Meyer Martin are the
parents of the following children:
Elizabeth Martin,unmarried,age 29 -109 Church street,
washington,Pennsylvania.
1012 East
Arthur D.Martin,Jr.,age 25 -/Broward Blvd.,Ft.
Lauderdale,Florida.
Elma Martin,unmarried,age 21 -109 Church street,
Washington,pennsylvania.
Alma Martin Sim¢,age 21 -North Main street,washington,
pennsylvania.
Martha Martin,unmarried,age 15 -109 Church street,
washington,pennsylvania.
8.Those of such children who are sui juris and resi-
dent in pennsylvania join in the prayer of this ptition.
9.There are no other persons interested herein.
WHEREFORE,your petitioner prays your Honorable Court
to adjudicate the said Anna May Meyer Martin to be unable to take
care of her own property,and to apPoint a guardian of her estate.

Before me,the undersigned authority in and for said
county and commonwealth,personally appeared JOHN H.DAVIDSON,who,
being duly sworn according to law,deposes and says:
1.On May 13,1952 he mailed in the Post Office at
Washington,pennsylvania,Registered Article No.36467,being a
copy,certified by counsel to be correct,of the petition for Ap-
pointment of Guardian and the Order of Court fixing as the time
for hearing in the captioned proceeding June 2,1952 at 9:00 o'clock
A.M.,E.S.T.,together with the letter as shown by the attached
letter copy,to Dr.Arthur D.Martin,Jr.,at 1012 East Broward
Boulevard,Ft.Lauderdale,Florida,as appears by Receipt for
Registered Article attached hereto.

Dear Dr.Martin:

Your father has agreed to sell the vacant lot
in Colonial Heights to which he and your mother hold title
as tenants by the entirety.In view of the condition of
your mother's health,it is necessary that a guardian be
appointed to execute the deed in her behalf.Obviously,it
is wise for Mr.Martin to sell this lot which represents an
annual liability in the form of local taxes,as well as re-
presents money tied up in a useless asset.
We enclose a copy of a petition for the appoint-
ment of a guardian which has been filed.It has been joined
in by the three of your sisters who are of age.The Court
has made an Order fixing Monday,June 2,1952,at 9:00 A.M.,
Eastern Standard Time,for hearing,and this is your official
notice of the whole of the same.
One of your sisters expressed some concern on
your part that this matter would be advertised.Such is not
the case for this proceeding.

PETITION FOR LEAVE TO JOIN IN THE SALE
OF REAL ESTATE UNDER THE INCOMPETENTS'
ESTATES ACT OF 1951.
TO THE HONO~LE,THE JUDGES OF THE SAID COURT:'
The petition of MRS.ELIZABETH MCGUIER respectfully
represents:
1.petitioner was appointed Guardian of the Estate
of Anna May Meyer Martin by Order of Appointment dated June 2,
1952.
2.On June 4,1952,Bond in the amount of $2,000.00
was approved by the Court and filed.
3.No personalty owned by the incompetent has come
to the knowledge of your petitioner.
4.Anna May Meyer Martin and Arthur D.Martin,her
husband,are the owners as tenants by the entirety of unimproved
real estate in South Strabane Township,washington County,penn-
sylvania,known,designated and described as follows:
Lot NO.81 in a plan of lots laid out by
C.H.Spriggs called "Colonial Heights"and recorded in
the Recorder's Office.for said Washington County in
Plan Book 6,page 2 and 3.
Said plan of lots embraces,inter alia,a
plan of lots laid out by the McClane Land Company,re-
corded in the Recorder's Office aforesaid in Plan Book
3,page 84 (the numbers of lots being changed on the

"colonial Heightsll Plan)and being the same premises
conveyed by the McClane Land Company,a corporation,to
the said C.H.Spriggs by deed dated November 24,1924
and recorded in the Recorder's Office aforesaid in Deed
Book 525,page 63.
Said Lot No.81 is more particularly bounded
and described as follows:
Said lot having a frontage of 50 feet on the
west side of Magnolia Drive;thence west to an alley 150
feet along the South boundary of Lot No.80;thence South
50 feet along said alley;thence East 150 feet along the
North boundary of Lot No.82 to Magnolia Drive,the
place of beginning.
Excepting and Reserving,however,from the
operation of this deed all the coal in and underlying
said lot or lots and the streets and alleys of said
plan,together with the same mining rights,privileges
and waivers of damage as are contained in the deed of
the McClane Land Company to Youghiogheny and Ohio Coal
Company,dated the 15th day of June,1921 and recorded
in the Recorder's Office aforesaid in Deed Book 491,
page 698.Also reserving all the oil and gas under the
same,but neither party having the right to drill there-
for.
5.Such lot was acquired by deed dated July 3,1925
and of record in Deed Book 533,page 258.
6.All of the funds for the purchase of such lot were
provided by Arthur D.Martin and all of the taxes and annual
charges since 1925 have been paid by Arthur D.Martin.
7.Said real estate is entirely unproductive and un-
improved and is a source of liability for annual taxes against the
owners.
8.By instrument dated April 1,1952,Arthur D.Martin,
in his own right and as spouse and natural guardian of the estate
of Anna May Meyer Martin,entered into an Agreement with Nancy E.
Kindamo,whereby he accepted $100.00 hand money and agreed to
sell the above described lot of ground for the sum of $1500.00,plus
the assumption by the purchaser of the 1952 taxes and plus a cove-
nant on the part of the purchaser to furnish legal counsel and pay
the expense of making title.

9.The rights of the purchaser under such agreement
were transferred to JOHN C.Richards and Gladys M.Richards,hus-
band and wife,by Assignment dated June 4,1952.
10.Petitioner is advised,believes and therefore
avers that the stipulated consideration in such agreement is a
full,fair and adequate consideration,that such price is a better
price than could be obtained at public sale,and in evidence of
such belief attaches hereto the affidavits of two qualified per-
sons having knowledge of real estate in the vicinity.
11.Notwithstanding that Arthur D.Martin has furnish-
ed all the consideration for the purchase of the lot and has paid
all the annual charges for the last 27 years,he has agreed with
your petitioner to share equally the net proceeds of the sale.
12.Your petitioner is informed and therefore avers
that Anna May Meyer Martin and Arthur D.Martin are indebted to
the Coramonwealth of Pennsylvania for the care and maintenance of
Anna May Meyer Martin in the amount of approximately $7500.00,
and notice of the presentation of this petition has been given to
Mr.John Charles,Revenue Agent for the Commonwealth of Pennsyl-
vania at Dixmont Hospital,Dixmont,pennsylvania,where Anna May
Meyer Martin is a patient.Notice of the presentation of this
petition has also been given to Elizabeth M.Martin,Elma J.Martin,
Alma M.8im and Arthur D.Martin,Jr.A minor child of your pe-
titioner's ward has received no notice.
13.As recited above your petitioner has already post-
ed a bond in the amount of $2,000.00 and at the conclusion of this
transaction will have in hand only approximately $750.00.
WHEREFORE,showing as above,your petitioner respect-
fUlly prays your Honorable Court to authorize,empower and direct

your petitioner to join with Arthur D.Martin in the sale of the
real estate described within upon the terms and conditions set
forth above,to accept for the estate of your petitioner's ward,
one-half of the net proceeds of such sale and to require no addi-
tional bond.

Office for said Washington County in Plan Book 6,pages 2 and 3.
Said plan of lots embraces,inter alia,a plan of lots
laid out by the McClane Land Company,recorded in the Recorder's

without such judgment for the amount due according to the terms

1.Petitioner was appointed Guardian of the Estate
of Anna May Meyer Martin by Order of Appointment dated June 2,
1952.
2.On June 4,1952,Bond in the amount of $2,000.00
was approved by the Court and filed.
3.pursuant to proceedings had at this number and
term,your petitioner received $750.00 as the proceeds from the
sale of real estate in which Anna May Meyer Martin had an interest.
4.Arthur Daniel Martin is the owner of improved real
estate known as 750 and 752 Duncan Avenue in the Seventh Ward of
the City of washington,washington county,pennsylvania,more ful-
ly described as follows:

No.4 to Washington,pa.,a plot of which is recorded .,'
in Plan Book 2,page 106 in the Recorder's Office,said
lot being more particularly bounded and described as

6.Anna May Meyer Martin has no interest in such real'
estate other than that of a spouse.
7.By instrument dated January 2,1954,Arthur
Daniel Martin entered into an agreement to sell the above des-
cribed real estate to Martha Claire Conkle and Clarence R.Conkle,
her husband for the sum of $8,500.00,and your petitioner joined
in such agreement for the sole and only purpose of undertaking to
conduct this proceeding.
8.Petitioner is advised and believes and therefore
avers that the stipulated consideration in such agreement is a
full,fair and adequate consideration.
9.Your petitioner is informed and therefore avers
that Anna May Meyer Martin and Arthur Daniel Martin are indebted
to the Commonwealth of Pennsylvania for the care and maintenance of
Anna May Meyer Martin in an amount in excess of $7,500.00,and she
is further informed by Arthur Daniel Martin that he intends to apply
the proceeds of this sale in relief of his liability to the Commonwealth.

have agreed to sell the premises known as 135 Church Street,and in the course
of making title to the same,have caused a survey to be made of the Church
Street one-half of Lot No.10 and have requested Arthur Daniel Martin to
make a quit-claim deed so that the division of Lot No.10 between 135 West
Walnut Street and 135 Church Street will be certain.
6.A copy of the deed proposed to be delivered is attached hereto
and marked Exhibit "A".
7.There is no actual monetary consideration contemplated,but it
is expected that the grantees in the proposed quit-claim deed and their re-
spective spouses will join in a reciprocal quit-claim deed as to 135 West
Walnut Street running to Arthur Daniel Martin.
8.Your petitioner is informed and therefore avers that Anna May
Meyer Martin and Arthur Daniel Martin are indebted to the Commonwealth of
Pennsylvania for the care and maintenance of Anna May Meyer Martin in an
amount presently unknown,and notice of the presentation of this petition will
have been given to the revenue agent for the Commonwealth of Pennsylvania
at Dixmont Hospital at Dixmont,Pennsylvania,where Anna May Meyer
Martin is a patient.
