committing unto Him the administration of all and singular the goods and
chattels,rights and credits,which were of said deceased,and requiring Him

make,publish and declare this to be my Last Will and Testament,
hereby revoking all Wills and Testaments or Writings in the nature
thereof by m~at any time heretofore made.
FIRST:I direct my just debts,funeral expenses and
costs of administration to be paid as soon as may be conveniently
done after my death.
SECOND:I direct that my Executor,hereinafter named,,,
shall erect a suitable grave marker on my grave and pay the cost
thereof from the residue of my estate.
THIRD:I direct that all estate,inheritance,succession,
legacy,and other duties or taxes of any nature which may be

BREZA,and files this Petition to Substitute an Executor in the

Estate of Mary Breza,Deceased,and in support thereof states
the following:
1.That Mary.Breza .died on October 11,1971,leaving
her Last Will and Testament dated August 24,1969,which was
duly probated in the Register of Wills Office of Washington
County,Pennsylvania,on October 19,1971.
2.That pursuant to said Will,Larry A.Breza,was
duly appointed Executor of said Estate by the Register of Wills
of Washington County,Pennsylvania.
3.The grant of letters was duly advertised in the
Daily-Herald of Monongahela,Pennsylvania,and the Washington
County Reports,Washington,Pennsylvania,and the complete
advertisement was made on November 11,1971.
4.That on May 18,1974,the said Larry A.Breza
died.

5.That Item 7 of Mary Breza's Last Will and Testa-
ment reads:
"SEVENTH"I nominate,constitute and
appoint my Son,LARRY A.BREZA,to be the
Executor of this my Last Will and Testament,
but if he predeceases me or fails to act as
Executor for any reason,then I nominate,
constitute and appoint ROBERT LEE BREZA,to
act in his stead as Executor of this my Last
Will and Testament.
Therefore,inasmuch as Larry A.Breza died and
cannot act as Executor,Robert Lee Breza should be made the
substitute Executor in accordance with the above Item of the
decedent's Will.
WHEREFORE,it is respectfully -requested that ROBERT LEE
BREZA,be named as Executor of the Last Will and Testament of
Mary Breza,Deceased.

TO THE HONORABLE,THE JUDGE OF SAID COURT:

The Petition of Robert Lee Breza,Administrator/C.T.A.
of the Estate of Mary Breza,Deceased,respectfully represents:
1.That Mary Breza died on October 11,1971,leaving
her Last Will and Testament dated August 24,1969,which was
duly probated in the R~gister of Wills Office of Washington
County,Pennsylvania,on October 19,1971.
2.That pursuant to said Will,Larry A.Breza,
was duly appointed Executor'of themEstate of Mary Breza,
Deceased,by the Register of Wills of Washington County,Pennsyl-
vania,and letters testamentary were duly issued and completely
advertised according to law.
3.That on May 18,1974,the said Larry Breza,
Executor,died and your Petitioner,Robert Lee Breza~duly
u.B.N.
filed an application to be appointed Administrator,/C.T.A.of
the Estate of Mary Breza,Deceased.Pursuant to said appli-
cation,letters om administration were duly issued to Robert
Lee Breza.
4.That among the assets of the Decedent is certain
real estate situate in the First Ward of the City of Monongahela,
Washington County,Pennsylvania,which is described as follows:
BEGINNING at a point on the right of way line
of Ellen Street and the Northwesterly corner of Purpart No.1
in the Nelson Fanm as was surveyed by C.C.Hanlon,in December
1909;thence from said point of beginning and along Purpart
No.1,South 24°07'West,a distance of 715.55 feet to a point
on lands now or formerly of the Consolidated Coal Company;
thence along the same and through Purpart No.2,North 65°53'
East,a distance of 253.0 feet to a point on the Easterly edge
of Purpart No.3 in said Plan;thence along the same,North 24°
07'West,a distance of 693.36 feet to a point on said Ellen
Street aforesaid;thence along the same,South 72°51'East,
a distance of 234.88 feet to a point;thence continuing along
the same,South 49°51'East,a distance of 20.67 feet to a
point at the place of BEGINNING.
5.That the only person interested in the decedent's
real estate under said Will is Robert Lee Breza~_your Petitioner
D.D.fl.
herein and the duly appointed Administrator,lc.T.A.of the
Estate of Mary Breza,Deceased.
6.Said real estate was specifically devised to the
said Robert Lee Breza by the "Fourth"paragraph of the said
decedent's Will which provided as follows:

real estate which I may own at the time
of my death with all improvements erected
thereon and the contents contained there-
in which shall include any tools am

7.That an inventory was filed on or about the

17th.day of June,1974,wherein the total value of the
Decedent's real estate,:was shown to be $7,SOO~OO,and the
total value of the personal property was $115.00 making a
total value of the entire estate in the amount of $7,615.00.
8.That your Petitioner has signed a bond with
sufficient security with the Register of Wills Office of
Washington County,Pennsylvania,in the amount of $10,000.00.
9.That your Petitioner has entered into an Agree-
ment of Sale with Walter David Boyce and Hettie Lou Boyce,of
Monongahela,Washington County,Pennsylvania,for the private
sale of the aforesaid premises for the sum of $19,000.00 in
cash,subject to the approval of your Honorable Court,a copy
of which Agreement is attached hereto as Exhibit "A".
10.That at the tLme of the Decedent's death,the
real estate was appraised at $7,SOO.00 and after the death
of Mary Breza,your Petitioner's mother,he made extensivei'
repairs and improvements to said premises and the present value
of the real estate is $:l:9':,pOO;.00.Attached hereto and made a
part hereof,are affidavits of value by two competent persons
acquanted with the real estate in the vicinity of the premises
in question and are attached he reto as Exhibits "B"and "C".
Said appraisals reflect the value of the property as of October
11,1971.
11.That your Petitioner respectfully requests the
Court to allow this sale without additional bond inasmuch as
the total value of the Estate in accordance with the inventory
filed is $7,61S.00 and your Petitioner has entered a bond in
the amount of $10,000.00 as hereinabove stated.
WHEREFORE,your Petitioner prays your Honorable

make,publish and declare this to be my Last Will and Testament,
