I was advised of this. How 'ever, I asked the Accountant for affidavits and factual information to support his evidence. · And actually,-you are n<?t bound by the Federal Estate, Tax. Retm n, / A •. ' are you? We are bound---my job as District Supervisor 'is to pick up any items that are not reported for estate purposes, and which migt be taxable for Pennsylvania Inheritance Tax. You weren't bound, assuming that the Internal Revenue Service had made a finding and you didn't agree with it, you weren't bot nd by it, were you? I did not see any findings by the Federal Government. I did not have the adjustment by the Federal Government. I merely t< ok your copy of the 706 that you filed with the Register of Wills. I have a copy of my Federal Estate Return~and nowhere do thosE figures appear in my return. Are you familiar with the fact that those items were placed in the Federal Estate Tax Return by the Internal Revenue Service itself? I have no knowledge of that. However, isn't it true that the Federal Government gives an adjustment? They actually don't fix your figures in the 706. This is the first one I've seen, j-·-----------t----------------~----~----------------------~--------~------1 8 b!=cause I've handled a lot of 70o 's in my time. They'll give you a letter of adjustment showing the corrections they have made, .but I don't think they ever make changes as far as your form 70t i.'s concerned. I have never seen it before. MR. JOHNSON: If the Court please. I thin~ '¥ e are getting a little off track here. We're willing to base it on his testimony. We don't want to go into it anyway, Your Honor. For your benefit, well, I've examined quite a number of 706's in my time, in fact in Jhe last oouple of months I've gone througp. about 80 in two months. And I've never seen where the Federal Government changes the 706. If there are any changes made by the Federal Government~ they will give you a change letter . . So what I'm trying to contend, the figures that were put in the 706 were evidently put in by your ace ountant. MR. KUSTURISS: I have no further questions. When did you start with Falconi Leasing and Falconi Motor Company? January, 1948. Could you tell us what accounts, if any, you took charge of in that capacity that you have? Well, I had pretty much supervision of all the asset accounts, the liability accounts, the expenses, sales and costs, sales accounts and soforth. Q Were you in charge of Account Number 262? Now from what appears on this ledger, was the source of these funds,deposits, made into this account by Phillip or Domenick Falconi between 1948 and 1967? Yes • And from what would appear on ~his ledger, the deposits were n ade by Phillip Falconi after July 31, 1965. Right. . . What was the reason for rna intaining this account? What was the reason for maintaining it? Well, it gave the Falc< ni Motor Company funds on which to operate. In other words, the Falconi Motor Company, it's a corporation Yes. And did it consider each one of these deposits a loan as it was n ade? THE COURT: A loan to whom? It's shown on the statement as a liability account, shown as a note payable. Q And to whom is it shown as a note payable? A To Phillip. I'm not real certain of the specific date, but it would be in the middle fifties. Just a verbal understanding from Domenick that it was Phillip's How were you advised of that verbal understanding? How did you come to know of that verbal understanding? Well, basically~ when the franchise or the corporation was forrr ed, it was basically formed for the future benefits of Angelo Falconi and Phillip Falconi. And Domenick had told me repeatedly that these funds were Phillip's funds, that he would exercise control of them.
