That your petitioner is an adult individual residing at 520 Broad Street, Washington, Washington County, Pennsylvania. 2. That he is the son of Evelyn Downing, who died a resident of Washington, Washington County, Pennsylvania, on July 29, 1971. 3. That the said Evelyn Downing, deceased, a widow, was the mother of the following minor children: Jeffrey Downing Cindy Lou Downing John Downing Gary Downing Age 9 Age 10 Age 12 Age 13 ·~. 4. That during her lifetime, the said Evelyn Downing expressed a d~sire that in the event of her death that said children be placed in the Moosehart Home for Children at Aurora, Illinois. 5. That the Loyal Order of Moose, 139 North Main Street, Washington, Washington County, Pennsylvania, througQ its officers has made arrangements for the acceptance of said children at Moosehart Home for Children at Aurora, Illinois. 6. That your petitioner and the Child Welfare Service of Washington County, Pennsylvania, have been caring for said children since the death of their mother, Evelyn Downing. 7. That in the opinion of your petitioner, the welfare of the said children and their best interest will be promoted by placing the children at Moosehart Home for Children at Aurora, Illinois. 8. It is necessary that a Guardian be appointed to execute the necess~ry application to place the children in the Mooseh~rt Home for Children at Aurora, Illinois .. ·WHEREFORE, .your petitioner respectfully requests that your Honorable Court appoint your petitioner as Guardian of the persons of said minor children. That on October 17, 1971, th~ Honorable Court appointed your petitioner as guardian of the following named . . minor children; Jeffrey Downing, Cindy Lou Downing, John Downing and Gary Downing. 2. That your petitioner and the minor chi~dren were the only surviving heirs of Harold A. Downing and Dorothy Evelyn Downing, his wife. Harold A. Downing died, a resident of Washington, Washington County, Pennsylvania, on the 6th day of . .:.:A=-=u:cgL.::u=s:...:t:.___ ___ , ·.19 70; and Dorothy Evelyn Downing d;i.ed a resident of Washington, Waspington County, Pennsylvania, on July 29, 1971. 3. That Harold A. Downing and Dorothy Evelyn Downing entered into an Art_icle of Agreeme11t ·ror the purchase of real <. estate from Juanita Frye Morris, now known as Juanita J. Bromley, . ~ . said Agreement being dated May· 25, 196..7, and recorde-d .in the ' Recorder's Office of Washington County, Pennsylvania, in Deed Book 1281, page 53. Under the Article of Agreement, ~he total consideration was to be $4,650.00 payable at the rate of $150.00 down on the date of.the signing of the Agreement and $50.00 per month together with interest at the rate of 4%. A copy of said Article of Agreement is attached hereto and cailed Exhibit 'A11 • . --· 4. That the payments on the Article of Agreement are seriously in default; the property is in extremely poor condition and is not worth more than $3i250.00 at the present time. Your petitioner desires to quit claim any interest which he may have in said property as .an heir of Dorothy Evelyn Downing and he requests permission of the Court as guardian of Jeffrey Downing, Cindy Lou Downing, John Downing and Gary Downing to quit claim any interest which said minor children may have in said Article of Agreement upon payment to himself as guardian of said children of the sum of $100.00.
