STANLEY PRICE, an alleged incompetent ( No. /~tJ 7 of 1971 ) PETITION UNDER §301 OF .THE INCOMPETENTS' ESTATES ACT OF 1955 FOR ADJUDICATION OF. INCOMPETENCE. AND APPOINTMENT OF.GUARDIAN OF ESTATE TO THE HONORABLE, THE JUDGES OF THIS COURT: 1. The Petitioner is Mrs. Elizabeth Evans of 457 Liberty Avenue, Monongahela, Pennsylvania. 2. Mr. V. Stanley'Price, is an alleged incompetent, and his home address is 1108 Lawton Street, Monongahela, Pennsylvania. He is an individu 1, . . whcse age is 72, and is a widower. He.presently is a patient at the Mayview State Hospital, Bridgeville,· Pennsylvania, having been admitted to that institution on June 16, 19 71. 3. It is believed that the alleged incompetent. if, brought to the hearin on this matter would not understand the nature of the proceeding. 4. The names and addresses of the next of kin of the alleged incom- pete'nt who would be entitled to :share in his estate should he now die intestate are: Elizabeth Evans, daughter, of 457 Liberty Avenue, Monongahela, Pennsylvania; Dorothy Hutchko, daughter, of 15456 Alameda Street, Oak Forest, Illinois 60452; and Mae Welsh, daughter, of R. D. #2, Finleyville, Pennsylvania 15332. 5. The estate of the alleged incompetent consists of approximately $28, 500. 00 in savings account; real estate situate in the Third Ward of the City of Monongahela having an approximate value of $7,500.00 and a pension from the Wheeling-Pittsburgh Steel Company which pays the alleged incompet- ent the sum <?f $239. 66 per month. { 6. The alleged incompetent was never a member of the armed forces of the United States. 7. It is believed that the alleged incompetent is physically and mentall incapable of handling his affairs or taking care of himself and is legally incom petent. 8. No other Court has ever assumed jurisdiction in any proceeding to determine the competency of the alleged incompetent. No guardian has ever been appointed for the estate of the alleged incompetent. 9. The proposed guardians of the estate is the petitioner, Mrs. Elizabeth Evans, and her husband; Mr. Harold Evans, of 457 Liberty Avenue, Monongahela, Pennsylvania, whcse ages are 49 and 47 respectively. 10. Mrs. Elizabeth Evans who is a daughter of the alleged incomp;tent served as a secretary to the high school principal in the Monongahela High School for several years. Her husband, Harold R. Evans, is a clerk for the United States Post Office Department, Monc:ngahela Office. Both of the pro- posed guardians are high school graduates. 11. Neither of the proposed guardians of the estate have an interest adverse to the alleged incompetent and are not fiduciaries of any estate in which the alleged incompetent has any interest. 12. The petitioner requests the court pursuant to the Act of February 28, 1956, P. L. (1955) 1154, as amended by Act of July 11, 1957, P. L. 794, §1, 50 P. S. §3301, to award a citation directed to the alleged incompetent, with notice to his next of kin residing within the Commonwealth and to such other persons as the court may direct to show cause why V. Stanley Price should not be adjudged an incompetent and why Mrs. Elizabeth Evans and Harold R. Evans should not be appointed guardian of his estate. I I. Mayview State Hospital iBridgeville, Pa. 15017 VICTOR STANLEY PRICE, #~422 October 13, 1971 EVALUATION FOR GUARDIANSHIP HElmiNG This patient is a 72-year-old, ivhite, widowed male, admitted as a Commitment of the \iashington County Court from Memorial Hospital in MOnongahela on June 15, 1971. The admission history was that the patient had been living alone since his wife's death and for the past year had been showing increased confusion \'lith memory loss to the·-.extent that he had. become out of contact With reality. On admission interV-iew, the pa1;.ient related readily' with. an affect of uncertainty. He was: oriented only .. for person. · He could give his place of ~esidence and his birthdate but he did not know the current year and he could not compute his age. He admitted that he had a poor memory. · His conversation was rambling and he tended to reminisce and confabulate. His insight was poor and his judgment was defective. :. The admission physical examination revealed findings compatible with the patient's age and a generalized arteriosclerosis. His laboratory findings were normal. His chest x-ray was normal as was his electrocardiogram. . On current interview, the patient 1 s confusion is noted to persist. He is largely out of contact. When asked how old he was, he stated that· .his age is 38. l-.Jhen asked where he lived, he stated, "Down along the river with my father and mother~" . . The appoirltment of a guardian is heartily' recommended 'due to the fact that. this·man is gross~ confUsed and unable to function in an unsupervised·environment. I prepared and filed and had signed the Order cone erning this hearing and served a copy of the Petition under Section 301 of tre Incompetents Estates Act upon the heirs, the children of V. Stanley Price, and also V. Stanley Price himsel was served at the Mayview State Hospital. I have the signed receipts evidencing service upon Dorothy Butchko, 15456 Alamed Street, Oak Forest, Illinois, and Mrs. Mae Welsh of R. D. #2, Finleyville, who is here in Court. I also have the Affidavit of Service by;Registered Nurse Rose S. Boyce of Mayview State Hospital, showing service upon the alleged incompetent. We also have a copy of the letter that was sent out to the other two daughters. THE COURT: Mr. Yohe, the service on the various heir is in conformity with the statutory requirements. We note that in the Affidavit of RoseS. Boyce, the Registered Nurse v;,rho served the alleged incompetent, V. Stanley Price, it states that it was . A Harold R. Evans. Q Where do you live? A 457 Liberty Avenue, 'Monongahela. Q What is your relation to the petitioner, Mrs. Elizabeth Evans who just testified? A Husband. Q Did you know about Stanley Price in his lifetime, who would be your father-in-law, is that correct? A · Yes. Q Wereyou in a position to observe his mental arid physical condition at the time of his commitment to Mayview and the year preceding? A I was. Q How would you descri~e it to the Court? A Very poor. 17 Q Well, can you amplify that a little? I A He was confused; he was run down in health. As my wife stated, he was running away all the time~ very poor memory, d·idn·'t remember; didn't know where he was part of the time. Q In your opinion, considering what assets he had, what money he did have, could he have been a victim of designing perso~s if he happened to run into ore? l() A Well, he, at one time, I would say yes. At one time he bro~ght a fellow up there from Clairton. He didn't even know him. He was in his car and didn't even know him, didn't even know where the man picked him up at or anything. They had been out drinking. He's not usually a drinking man. They ha~ I been out drinking. Q When did this occur? A I'd say about two months before we put him in the hospital. Q Now I'm going to ask yow, to the best of your knowledge--- I apologize to the Court if we don't have the bank statemen~s, it may be a failure of communication, I thought I told him to bring them---but to the best of your recollection, about the real estate, you heard your wife testify as to the location and the condition of the real estate. Do you have any opinion as to its market value? A Well, I'd say about $7500, $~000. Q Now that's the only real estate that he has, the property situate on Lawton Street in Monongahela? A As far as I know. Q Now the savings accounts, he has a savings account with Whe~ling Pittsburgh Credit Union. A Yes. Q Do you know the approximate amount of that? It was mentioned here when your wife was testifying when she was queried by attorney Tempest there is another accoun~ there. Will you explain the other account? That's when he was getting bad; later on I transferred it into my account • What was the size of the account you transferred? In the neighborhood of $3900.00. I don't know exactly. It was transferred to your checking account? Yes. And what was the purpose? Why did you do that? Well, we didn't actually know how much debts he did owe and how was you going to get him to sign it. A 1958; thirteen and a half years. 21 Q If you were, along with your wife, appointed as guardians of the incompetent's estate, are you familiar with what duties and responsibilities you would have? A The only thing I've gotta do is sell his house and belongin~s and put the money in a savings and pay his debts out of it. Q Are you willing to so serve? A Yes. Q Do you have any interest in this estate which would be adverse or against the alleged incompetent, Mr. Price? A No, I don 1 t. Q And the furnishings and everything that were in the house when he was living there, are they still there? A Most of them, yes. I sold the refrigerator. The money is at home. Q All right. No. You testified that the savings account had been trasferred to you and your wife's name and that you had signed that check. Is that correct? I, I'm pretty sure I signed it. I'm not positive. Whose account was it? It was his account. I was doing his---he had me go with him to the bank before and do his check work for him. Was this an account in the name of Victor Stanley Price? Yes. Was it in the amount of $3,945.99? That sounds pretty accurate, yes. And that money was to open up a new account or where was that money placed after it was transferred? I p·laced that in my account. I never even thought about it when they asked about it. When was your father-in-law examined to determine his competency? Do you recall that, the date? It was in the hospital when he was in the hospital in June. Are you saying then the account was transferred after he was determined to be incompetent? Yes. Was that prior to June 16, 1961 he was in the Monongahela Hospital?' A Yes. Q Was he examined th~re? A For health-wise; I don't know about the mental capacity. Q It is a fact though that some of the personal property has been taken out of the house. Is that correct? A Yes, sir. Q And has al:l of it been paid for? A Yes. You mean what was taken out? Q Yes. A No. That was a sister tliat took it out, his daughter. Q Was that with your permission? A Well, with everybody's permission except her, Mae. Q Was·she aware of what was going on at that time? Did you inform her? A I didn't inform her, no. I figured they had a right to it. If she wanted to come up, she can come up, take what she wanted. Q Would you have any objection to a bank or a bank trust institution being appointed as guardian for. your father-in law's estate? A No. Q If you and your wife were appointed, who would actually administer this estate, you or your wife or both? A It would be both of us. Q Have you had any training in investments that would be required in handling an estate of this kind? A No. Q Have you had any training in administering real estate,- the sale or upkeep of real estate? A No. I'd sell the house, get it appraised and sell it after I get it pl~stered. I'm waiting for this to be settled. They did take his pension check last month. I asked them---they called my wife and she told them to send us a bill, it woul~ be paid, which I would pay it out of the checking account. But they never sent a bill to us. Do you know whether or not your father-in-law has any other insurance such as Medicare or any other insurance that woul take care of his expenses at this state Hospital? No, he doesn't have any insurance. That's what they told us He had Medicare, but that has been run out. I don r .ti-:kno11, that's what they say. We waited for a bill. we never went down on a weekday. I work. And we never .did get .a statemen from them how much it was. We are willing to pay it. I know we'd have to pay more. 27 Q You say you can't go down during the week.because you work? A I work, yes. Q How many days a week do you work? A Five. Two jobs. Q Where are you employed?
