PETITION fOR SETTLEMENT OF.A SMALL ESTATE UNDER ~--~~~~~~--'
§ 202 OF TH~ FID~~IARIES ACT OF 1949, AS AMENDED
TO TH~ HONORABLE, THE JUDQES OF SAID COURT:
The petition of Anna Malinzak respectfully represents:

The decedent, Steve Malinzak, was a resident of
Fredericktown, Washington County, Pennsylvania, and died March
261 1971. ;

All persons entitled to share in this Estate are sui
juris.

The only property of the estate of Steve Malinzak is
a check due from the Social Security Administration for black
lung disability benefits in the amount of $3059.60.

The decedent, Steve Malinzak, owed no money and the
only creditor·is your petitioner who has assumed and paid for
the burial expenses in the amount of $1,350.00.

That your petitioner was residing with and dependent
upon the dece.dent, Steve Malinzak, . at the time of his death and,
therefore, claims the statutory widow's exemption of $1,500.00.

The following are all heirs of the decedent and entitled
to share in his estate:

Margaret Abbadini, Fredericktown, ·Pennsylvania;
Dorothy Kurtz, Marina, California;
Betty Terry, TUstin, California;
Bill Malinzak, Montebello, California;
Eugene Malinzak, Pico R,ivera, California;
Anna Malinzak, Fredericktown, Pennsylvania.
WHEREFORE, your petitioner respectfully requests this
Honorable.Court to enter an Order whereby the check from the·
Social Security Administration be paid over to the petitioner
to defray the expenses of. burial and for the widow's exemption;
and that the balance be distributed pursuant to the laws of
decent to Anna Malinzak, widow and Margaret Abbadini, Dorothy
Kurtz, Betty Terry, Bill Malinzak, and Eugene Malinzak, children.
Said amount to be less the amount properly deducted.for inheritan·e
purposes.

AND NOW, THIS f-J!!~a~ :£-~ , 1971, upon
consideration of the foregoing petition, and pursuant to the
provisions of Section 202 of the Fiduciaries Act of 1949 as amended,
the check due the Estate of Steve Malinzak from the Social Security
Administration in the approximate amount of $3,059.60 is to be
distributed and awarded as follows. The amount of $1,350.00 be
paid to Anna Malinzak as reimbursement for the funeral expense.
The amount of $1,50p.oo be paid to Anna Malinzak as the widow's
exemption. The balance to be distributed pursuant to the laws
of~ decent to Anna Malinzak, widow and Margaret Abbadini, Dor6thy.;-.:>t.
Kurtz, Betty Ter~y, Bill Malinzak, apd Eugene Malinzak, children.
