That Evan Harding, Jr. a/k/a Evan Hardi~g, was admitted· to the Veterans Hospital at Leech Farm Road, Pittsburgh, Pennsylvania, on March 18, 1963 and confined to said-Hospital until April 11, 1969, at which time he was temporarily on leave J at the Robert Kennedy Family Care Hpme, Kennedy Lane, Butler, · Butler County, Pennsylvania, for the purpose of making a satisfact ry adjustment; 3. EVAN HARDING, an alleged incompetent PETITION FOR APPOINTMENT OF GUARDIAN-. TO THE HONORABLE JUDGE OF SAID COURT: of 1971 The petitio~ of James Harding respectfully represents: 1. That your petit.l.oner, James Harding; resides at Route 88, R. D. t2, Finleyville, Washington County, Pennsylvania; and is ,a son of Evan Harding, Jr. a/k/a Evan Harding, the alleged incompetent. 2. The alleged incompetent was born September 27, 1922, and is presently forty-nine (49) years o{ age and is domiciled at Route 88, R •. D. #2, Finleyville, Washington County, Pennsylvania. Since 1961, the alleged incompetent has been a patient at the Veteran's Hospital, Leech Farm Road, Pittsburgh, Pennsylvania, presently on non-bed care status and is temporarily residing at the Robert Kennedy Family·Care Home, Kennedy Lane, Butler, Butler County1 Pennsylvania. The Veterans Administration by its Chief Attorney, Daniel J. Parent, has consented to and joins in the prayer of this petition .. (See Exhibit A attached hereto and made a part hereof.) 3. The names and addresses of the next of .kin of the .• alleged incompetent all of whom have signed a Joinder. in the prayer of this petition are: David Harding, 808 Liberty Drive, Fairfield, Iowa; Wayne Harding, 1114 Arkansas Avenue, ARt. 3, ' Dormont, Pittsburgh, Pennsylvania 15216; and Robin Harding, Route -88, R. D. #2, Finleyville, Pennsylvania, all of whom are sui juri . ' except Robin Harding who is 17 years of age. (See Exhibit B attac ed hereto and made a part hereof). Virginia M. Harding; wife of the alleged incompetent, died May 26, 1971. 4. That the estate of the said Evan Harding, Jr. a/k/a Evan Harding, so far as petitioner knows consis'ts of the following: Cash in hands of Veterans Administration· Hospital Legacy due from estate of Edgar Harding, deceased uncle of alleged' incompetent (Catherine Harding, Executrix, 3710 Troutman St., Munhall, Pennsylvania) REALTY: Residence property in Union Township, Washington County, Pennsylvania, consisting·of an irregularly shaped lot containing 0.75 Acre fronting 174 feet, more or less, on the Township Road leading from State Highway. Route 88 to Hackett and extending in a Northerly direction.therefrom~ Upon which is erected a famiiy residence the value ·of which is estimated at Being the same as conveyed to· Evan Harding and Virginia M. Harding, his wife ,···by deed of Anthony Tarnogorski et ux. dated May 28, 1960 and· recorded in the Recorder•·s Office for Washington County on June 2, 1960 in Deed Book 1076 page 459. $1757.00 1'00'0. 00 $2757.00 15000.00· 5. Your petitioner avers that· the alleged' incompetent receives from the veterans Administration benefits of approximate y $500.00 per month of which $100.00 is deducted for the use of the alleged incompetent's youngest son, Robin Harding. 6. That the alleged incompetent is mentally and physically infirmed because .of psychomotor epilepsy with conversion reaction, and is unable to manage his property or is liable to dissipate it or·become the victim of designing persons. 7. That petitioner proposes as.Guardian of the alleged. incompetent, Western Pennsylvania National Bank, which has one of its branches located-in Finleyville, Pennsylvania~ 8. No other· Court-has ever assumed jurisdi·ction in any proceeding to determine the-competency of the alleged incompetent. 9. The alleged'incompetent at present has no guardian of-his person or estate. WHEREFORE, petitioner prays Your Honorable Court pursuant to the Incompetent's Estate Act of 195.5 1 as amended (50 ·P.S. 3101 et seq.) to award a Citation directed' to the· alleged incompetent with notice:to his next of kin residing within the Commonwealth and to such other persons as the-Court may direct, to show cause why Evan Harding, Jr. a/k/a Evan Harding . . should not be· adjudged an· .incompetent and why Western Pennsylvania National Bank' should not be appointed guardian of his estate. "What did you observe? He vvas sort of shaking and he fell down and blacked out, sort of. Did you observe it more than once? No. I only observed it one time. Since your father has been in the hospital, have you and the members of your family visited there? A I haven't. My mother had and my one brother had. seen him once. In said A1ffidavit the doctor deposes that Mr. Harding ':vho is a patient at the hospital frornMarch 18, 1963 to April 11, 1969, that he has a long history of mental illness requiring locked ward supervisio~ during part of his hospitalization. That he has pronoun ed I ' memory irnpairrrtent and complete lack.·of insight. That Dr. . Buvinger examined the alleged incompetent on October 19, 1971, J ' •. He makes a further Affidavit concerning the mental condition of the alleged incompetent, which substantiates the one given by Dr . Buvinger. But he further says here, Your Honor, "The veteran operates best in a protective environment to which he is accustome!d. Any deviation from this becomes quite upsetting. He has been able to completely abstain from alcohol under his present living arrangements. However, any stress could cause him to again return to his previous habits. Therefore, it is not advisable to subject him to the stress of a court procedure."
