Dear Mr. Fer gus:
A judgment was entered against Sarah and Ada Davis on May 23, 1966,
at No. 315 May Term 1966 DSB by the Estate of Elizabeth McNulty and John H.
Davidson. ,.
The Courthouse records indicate that you handled the estate of Mrs. 1VIcNulty.
In a telephone conversation today you informed me that Mr. Davidson, now deceased,
would have inherited the claim. I am forwarding the following information to you
in order that you can pass it on to the attorneys who set-tled Mr. DaviE1son1s Estate.
The amount for distribution in both estates is roughly $8, 100.00. The
Cmnmonwealth has claims against the estates ·in excess of $20, 000. Under §3392
of the Probate Code these claims would be entitled to priority over the McNulty
clailn. In addition, the Commonwealth holds judgments entered at 158 November
1973, A. D. ($4000) and 1 March, 1973 A. D. ($2000).

PETITION FOR THE PRIVATE SALE OF
REAL ESTATE
The petition of Robert J. Parask.a, Administrator C. T. A. of the
Estates of Sara V. Davis and Ada M. Davis, deceased, respectfully repre-
·sents as follows: ·
1. Petitioner is Robert J. Paraska, an adult individual who on
September 30, 1971, was appointed Administrator C. T. A. of the Estates of ~
Ada M. Davis, deceased and Sara V. Davis, deceased.
2. Ada-M. Davis died testate on May 19, 1967. Her Will is recorde
in the Office of the Register of Wills of Washington County in Will Book ll2,
page 451; a copy of her Will is attached hereto as Exhibit "A".
• 3~ Sara V. Davis died testate on January 13, 1970. Her Will is
·recorded in the Office of the Register of Wills of Washi'ngton County in ·· ..

decedents are insufficient for paying the debts of either of their estates; ·and
it is necessary ~hat your petitioner sell all of their real estate.
6~ The petitioner respectfully petitions this Honorable Court for
an Order permitting him to sell under Section 543 of the Act' of April 18, 1949
P. L·. 512, Article V, ·so that said sale has the effect of a judicial sale, all that
certain lot of ground situate in the Borough of East Washington, Washington
County, Pennsylvania, bounded and described as follows:
. Comm.encing at the Northeast corner of lot now
or formerly of Thomas Allen and the .line of the Washington
and Williamsport Pike, as located by D. ,J. McAdams and ··
J. A. Schmidt; thence South 71 1/2 ° East 150.'8'feet to a fifteen
foot alley, thence by said alley North 51 1/2° East 15 feet
to a post; thence by other lot now or formerly of John I-t.
C?liver North 48 5/10 o vyest 126 3/10 feet to a line of said
Turnpike; thence by said line of Turnpike as located by
said McAdam and Schmidt South 51 1/2 o West 76 feet to the
place of beginning. This lot of ground being a part of the
same piece of ground which was conveyed to John H. Oliver
by Alexander Murdoch, Executor of the Last Will of A. R.
Frisbie by.a deed dated November 25, 1865, and recorded in
the Office of ~h~ Recorder of Deeds· of Washington County,

·Pennsylvania in Deed Book G, Vol. 4th, page 442;
said W. H. Davis died March 19, 1901, and his Will is
record~d in the Office of the Register of Wills ci Washing-
ton County, Pennsylvania in Will Book 18, page 158, wherein
. he devised a life estate in said real estate to his wife, Lucy
M •. Davis~ with the remainder thereof to be divided among
his children in such proportion and shares as his wife, Lucy
M. Davis, should deem proper. Lucy M. Davis, widow of
W. H~ Davis, died on Aug. 17, 1901; her Will is recorded in
the Office of the Register of Wills of Washington County,
Pennsylvania in Will Book 18, page 343, wherein she devised
all of"the above real estate to her three daughters, Martha C.
Davis, Sara V. Davis and Ada M. Davis.
To the best of the knowledge of the petitioner, Sara V. Davis and
Ada M. Davis are the sole, surviving beneficiaries of the. above two estates
and are the owners o~ the entire fee simple interest therein.
7. No real estate in the above two decedent's estates has been
sold without a petition to this Honorable Court.
8. Copies of the inventory in the Estates of Ada M. Davis and
Sara V. Davis are attached hereto resp'ectively as Exhibits C and D.
9. A list of the known debts of·.Ada M. Davis is attached hereto as
Exhibit E; a list of the known debts of Sara V. Davis is attached hereto as

Exhibit F·.
10. The proposed purchaser of the above described real estate is
Robert Bruno, ·an adult individual, who resides at 58 Harris.on Street,
Washington, Pennsylvania .
. ll. The proposed purchaser has .signed ·a written offer to purchase t
the above described real estate, which offer has been accepted by Robert J.
Paraska, petitioner herein. A copy of the offer and acceptance is attached
. hereto and incorporated herein as Exhibit G.
12. The proposed purchaser h~s tendered to Robert J. Paraska,
Administrator, Seven Hundred Fifty ~nd no/100 ($750. 00) Dollars to be applie
as payment on account of the total purchase price of Seven Thousand Five
Hundred and no/100 ($7, 500. 00) Dolia~s for the above described real estate.
13. Petitioner avers that the cash sale price of Seven Thousand

14. Affidavits of two competent realtors supporting this petition

543 of the Fiduciaries Act for the price and under the terms set forth in the
attached Exhibit. G.

STIPULATION OF FACTS
1. Ada M. Davis died testate on May 19, 1967 a resident
of Washington County, Pennsylvania. Her Will is recorded in
the Office of the Register of Wills of Washington County in
Will Book Vol. 112, Page 451.
2. Ada M. Davis died seized of an undivided One-half
(1/2) interest in property located at 404-406 East Beau Street,
Washington, Pennsylvania.
3. The Commonwealth of Pennsylvania, Department of Public
Welfare, entered a judgment against Sarah v. Davis and Ada M.
Davis on April 2, 1964 at No. 706 February Term 1964 DSB in the
Prothonotary's Office in Washington County, Pennsylvania in the
amount of $4,000.
4. At the time of the entry of the judgment described in
paragraph 3 of this Stipulation, the Commonwealth of Pennsylvania
had advanced to the said AdaM. Davis two payments of $21.80 each
and 19 payments at the sum of $21.20 each or a total of $446.40.
5. Robert J. Paraska qualified as Administrator C.T.A. of
the Estate of Ada M. Davis on September 30, 1971.
6. The judgment described in paragraph 3 of this
Stipulation was revived at No. 340 November Term 1968 and at that
time there was no p~rsonal representative of Ada M. Davis upon
which notice of the·,revival could be served.

7. The Estate of Elizabeth D. McNulty and John H. Davidson
entered a judgment against Sarah v. Davis and Ada M. Davis on
May 23, 1966 at No. 315 May Term 1966 D.S.B. in the amount of
$1,000.
8. After letters \ATere raised in the Estate of Ada M.
Davis, notice of the claim.of the Estate of Elizabeth D. McNulty
and John H. Davidson was served on counsel for the personal
representative of the Estate of Ada M. Davis, a copy of which
is attached hereto and marked Exhibit A.
9. · The Commonwealth of Pennsylvania, Department of Public
Welfare, advanced to Ada M. Davis during her lifetime the total
sum of $6,251.61 and included therein is the $446.40 advanced to
her prior to the entry of the judgment at 706 February Term 1964
D.S.B.
10. There is a balance for distribution in the decedents'
Estate of $3,691.50.

necessary papers. I believe everything is in order
except I do have two comments on this estate. First,
there has been a change in the account which we have
reflected in the Audit Petition. I have corresponded
with Mr. Vlachos on that. Secondly, in the last day
or so, it comes to my attention that a judgment was
entered against Miss Davis and her sister, Sarah Davis
the next estate on the list, back in 1966, by an estat~

I contacted Attorney Harold Fergus yesterday about
this and he agreed to inform the attorney in Pittsburg
who handled Mr. Davidson's estate.
I do not believe that this claim would
be paid, since these estates are insolvent. And the
claim of the Commonwealth would take priority over the
claim. But I did want to call it to the Court's

attention. I sent/hand-delivered letter to Mr. Fergus
yesterday, which he agreed to forward.

wealth has a priority, would depend on whose judgment

to this attorney .. And you also mentioned somebody else
besides the attorney for Davidson, some other person
thatyou named who might have an interest.
