PETITION
The petitioner~ Robert J. Paraska, by his attorneys~ PEACOCK,

1. Petitioner is Robert J. Paraska, an adult individual, who
resides at 120 Rose Avenue, Washington, Washington County~ Penn-
sylvania and whose post office address is Box 335;, Washington,
Pennsylvania 15301. and on September 30, 1971 was appointed Admini-
strator C. T. A. of the· estate of Sara Davis, deceased.
2. Sara Davis~ of East Washington~ Washington County~ Penn-
sylvania died January 13, 1970 testate., and her Will was duly pro-
bated September 30, 1971 and recorded in Will Book No. 112~ page
3. Respondent is Mrs. Helen Thomas, an adult individual, who
resides in the Borough of Canonsburg, Washington County, Pennsylvania
and whose post office address is 119 Greenside Avenue,. Canonsburg,

Pennsylvania 15317.
4. On:.. Novemb.er 13, 1969 the Honorable P. V. Marino~ after
a petition and hearing in open court, handed down a Decree at No. 1074
of 1969 adjudicating Sara Davis an incompetent and appointing Mrs.
Helen Thomas guardian of the estate of Sara Davis.
5. From before November 13, 1969 and until her hospitalization
in the Washington Hospital on January, 1970, Sara Davis was a_ patient
at the Thomas Convalescent Home,. Canonsburg, of which Mrs. Helen
Thomas the proprietor.
6. Miss Sara Davis died while a patient at the Washington
Hospital on January 13, 1970.
7. During the month of January, 1970, Mrs. Helen Thomas,
while still acting as guardian of the estate of Sara Davis~ removed
certain items of personal property belonging to Miss Sara Davis from
Miss Davis1s residence at 404 East Beau Street, Washington, Pa.
8. Inter alia, the items removed from the residence of Sara
Davis by Helen Thomas consisted of :
(1) Two(2)beds;
(2) One flat chest;
( 3) One telephone stand;
( 4) One antique stand with a dressing mirror ori it;
( 5) Clothing :
(6) One antique Grandfather1s clock;
(7) Two (2) upholstered chairs;
(8) One coffee table;
(9) Various other miscellaneous items including pots and
pans, photographs, paintings, bric-a-brac;
9. Demand for the return of the above items of personalty
belonging to Sara Davis has been made upon Mrs. Helen Thomas,
but she has refused and continues to refuse to s4rrender these items~

WHEREFORE., Petitioner prays your Honorable Court to grant
relief to the estate of Sara Davis by requiring Mrs. Helen Thomas
to turn over and surrender to petitioner all personal property of Sara
Davis in her possession., including the items enumerated above, and
to require that an:· accounting for such personal property be made
to the administrator, and to provide such further relief as the court.,
acting under its equitable powers., may be deemed necessary and pro-
per.

PETITION FOR THE PRIVATE SALE OF
REAL ESTATE
The petition of Robert J. Paraska, Administrator C. T. A. of the
Estates of Sara V. Davis and AdaM. Davis, deceased, respectfully repre-
sents as follows: ·
1. Petitioner is Robert J. Paraska, an adult individual who on
September 30, 1971 .. was appointed Administrator C. T. A. of the Estates of
Ada M. Davis, deceased and Sara V. Davis, deceased.
2. Ada M. Davis died testate on May 19, 1967. Her Will is recorde
in the Office of the Register of Wills of Washington County in Will Book ll2,
page 451; a copy of her Will is attached hereto as Exhibit "A".
3! Sara V. Davis died testate on January 13, 1970. Her Will is
recorded in the Office of the Register of Wills of Washi"ngton County in
Will Book ll2, page 449. A copy of her Will is attached hereto as Exhibit
"B".
4. The names and addresses of all persons interested in the
Estates of AdaM. Davis and Sara V. Davis are as follows:

5. The personal estates, rents and profits of the above two .
decedents are insufficient for paying the .de"9ts of either of their estates, and
it is necessary that your petitioner sell all of their real estate.
6. The petitioner respectfully petitions this Honorable Court for
an Order permitting him to sell under Section 543 of the Act of April 18, 1949
P. L. 512, Article V, so that said sale has the effect of a judicial sale, all that
certain lot of ground situate in the Borough of East Washington, Washington
County, Pennsylvania, bounded and described as follows:
Commencing at the Northeast corner of lot now
or formerly of Thomas Allen and the line of the Washington
and Williamsport Pike, as located by D. J. McAdams and
J. A. Schmidt; thence South 711/2 o East 150 .. 8'feetto a.fifteen
foot alley, thence by said alley North 511/2° East 15 feet
to a post; thence by other lot now or formerly of John H.
Oliver North 48 5/10° West 126 3/10 feet to a line of said
Turnpike; thence by said line of Turnpike as located by
said McAdam and Schmidt South 51 1/2 o West 76 feet to the
place of beginning. This lot of ground being a part of the
same piece of ground which was conveyed to John H. Oliver
by Alexander Murdoch, Executor of the Last Will of A. R.
Frisbie by a deed dated November 25, 1865, and recorded in
the Office of the Recorder of Deeds of Washington County,

Pennsylvania in Deed Book G, Vol. 4th, page 442;
said W. H. Davis died March 19, 1901, and his Will is
recorded in the Office of the Register of Wills of Washing-
ton County,_ Pennsylvania in Will Book 18, page 158, wherein
he devised a life estate in said real estate to his wife, Lucy
M. Davis, with the remainder thereof to be divided among
his children in such proportion and shares as his wife, Lucy
M. Davis, should deem proper. Lucy M. Davis, widow of
W. H. Davis, died on Aug. 17, 1901; her Will is recorded in
the Office of the Register of Wills of Washington County,
Pennsylvania in Will Book 18, page 343, wherein she devised
all of"the above real estate to her three daughters, Martha C.
Davis, Sara V. Davis and AdaM. Davis.
To the best of the knowledge of the petitioner, Sara V. Davis and
Ada M. Davis are the sole, surviving beneficiaries of the above two estates
and are the owners of the entire fee simple interest therein.
7. No real estate in the above two decedent's estates has been
sold without a petition to this Honorable Court.
8. Copies of the inventory in the Estates of Ada M. Davis and
Sara V. Davis are attached hereto respectiVely as Exhihits C and D.
9. A list of the known debts of Ada M. Davis is attached hereto as
Exhibit E; a list of the known debts of Sara V. Davis is attached hereto as
Exhibit F.
10. The proposed purchaser of the above described real estate is
Robert Bruno, an adult individual, who resides at 58 Harrison Street,
Washington, Pennsylvania.
ll. The proposed purchaser has signed a written offer to purchase
the above described real estate, which offer has been accepted by Robert J.
Paraska, petitioner herein. A copy of the offer and acceptance is attached
hereto and incorporated herein as Exhibit G.
12. The proposed purchaser has tendered to Robert J. Paraska,
Administrator, Seve'n Hundred Fifty and no/100 ($750. 00) Dollars to be applie
as payment on account of the total purchase price of Seven Thousand Five
Hundred and no/100 ($7, 500. 00) Dollars for the above described real estate.
13. Petitioner avers that the cash sale price of Seven Thousand
Five Hundred and no/100 ($7, 500. 00) Dollars for the above described premise

is greater than could be obtained at a public sale thereof.
14. Mfidavits of two competent realtors supporting this petition
are attached hereto as Exhibits H and I.
WHEREFORE, petitioner requests this Honorable Court to approve

543 of the Fiduciaries Act for the price and under the terms set forth in the
attached Exhibit G.·

tendered to petitioner the sum of Seven
Hundred Fifty and no/100 ($750.00)
Dollars to be applied as payment on
account of the total purchase price of
Seven Thousand Five Hundred and
no/100 ($7,500.00) Dollars under a
written offer to purchase, .which offer
has been accepted by petitioner.
Return of sale and request for con-

On the above day fixed for confir-
mation, the court will entertain higher
bids on the same conditions as are
prescribed in the case of public sales;
that is, the court will entertain bids

Notice is hereby given that the undersigned, pursuant to Order
:of Court, will on August 28, 1972 at 10:00 o'clock A. M.· in the
Orphans' Court Room of the Washington County Courthouse, Washington,
Pennsylvania, requests this Hor1orable Court tc approve under §543 of
the Act of April 18, 1949, P. L. 512 V, the private sale of the below
··described real estate as a judicial sale, all that ·certain lot of ground
situate. in the Borough of East Washington, Washington County,. Penn-
sylvania, bounded and described as follows:
Commencing at the Northeast corner of lot now or
·formerly of Thomas Allen and the line of the Washington
and Williamsport Pike, as located by D. J. McAdams and
J. A. Schmidt; thence South 71 1/2° East 150.8 feet to a
fifteen foot alley, thence by said alley North 51 1 I 2 o East
15 feet to a post; thence by other lot now or formerly of
John H. Oliver North 48 5/10° West 126 3/10 feet to a line
of said .Turnpike; thence by said line of Turnpike as located
·by said ~cAdam and Schmidt South 51 1/2° West 76 feet to

The proposed purchaser of the above described real estate is
Robert Bruno, an adult individual who resides at 58 Harrison Street,·
Washington, Pennsylvania. The proposed purchaser has tendered
to petitioner the sum of Seven Hundred Fifty and no/ 100 ($750. 00)
Dollars to be applied as payment on account of the total purchase

· Return of sale and request for confirmation will be made to court
at the hearing to be held on-August 28, 1972 at 10:00 o'clock A. M.
On the above day fixed for confirmation, the court will entertain
higher bids on the same conditions as are prescribed in the case of
' public sales; that is, the court will entertain bids which are $500 or
ten percent in excess of the bid re~urned, whichever amount is smaller •
The terms of the sale shall be ten percent of the amount bid or $150,.
whichever amount is -larger, in cash upon the acceptance .of the bid; _
and the balance in cash to be paid on the confirmation of the sale by

President, the Chairman of the Finance Committee, the Chairman of the Insurance Executive Committee, any
Senior Vice President, any Vice President or any Second Vice President and duly attested and sealed, if a seal is
required, by any Secretary or any Department Secretary or any Assistant Secretary or when signed by the
Chairman of the Board, the President, the Chairman of the Finance Committee, the Chairman of the Insurance
Executive Committee, any Senior Vice President, any Vice President or any Second Vice President and counter-
signed and sealed, if a seal is required, by a duly authorized attorney-in-fact or agent; and any such bond, under-
taking, recognizance, consent of surety or written obligation in the nature thereof shall be valid and binding upon
the Company when duly executed and sealed, if a seal is required, by one or more attorneys-in-fact or agents
pursuant to and within the limits of the authority granted by his or their power or powers of attorney.

A judgment was entered against Sarah and Ada Davis on May 23, 1966,
at No. 315 May Term 1966 DSB by the Estate of Elizabeth McNulty and John H.
Davidson. ··
The Courthouse records indicate that you handled the estate of Mrs. McNulty.
In a telephone conversation today you informed me that Mr. Davidson. now deceased,
would have inherited the claim. I am forwarding the following information to :you
in order that you can pass it on to the attorneys who settled Mr. Davisson's Estate.
The amount for distribution in both estates is roughly $8, i 00. 00. The
Commonwealth has claims against the estates in excess of $20, 000. Under §3392
of the Probate Code these claims would be entitled to priority over the McNulty
claim. In addition, the Commonwealth holds judgments entered at 158 November
1973, A. D. ($4000) and 1 March, 1973 A. D. ($2000).

Judge Marino on July 28, )972 for the hearing on the confirmatior.
of the sale, private sale of .real estate by the Administrator,
Robert Paraska, in the estates of Sara Davis and Ada Davis at
Numbers 63 of 1971-990 and 63 of 1971-991. I believe the Court
has in front of it the original papers which we filed in the form of
<± a petition.
THE COURT: was your original paper on Xerox?
MR. ECKER: No, Your Honor.
(At the direction of Mr. Ecker, off-the-record discussion was
not recorded by the stenographer).
THE COURT: we will accept this, if you say that you filed
the original, and there are two estates involved, we will assume
that the original is at the other number. Go ahead, Mr. Ecker.
Where is the property located?
MR. ECKER: Your Honor. this property is located in the
Borough of East washington. And we have set forth a description
of the property, both in paragraph six of the petition and in the
proposed order which we have, and we will hand up to the Court
shortly. This property is in the estates of Sara and Ada Davis,
both deceased. And the names and addresses of all persons
i nt:erested in the estates are set forth in paragraph four of our
petition.
THE COURT: Are these creditors as well as devisees or
legatees?
MR. ECKER: These are legatees and devisees, Your Hono ,
and a list of creditors of both estates is also attached to the
petition as filed, and this is set forth in paragraph nine of the
pe·tition. The Inventories in both estates are attached as Exhibit
"C" and "D". The proposed purchaser, Mr. Robert Bruno, has

signed a written offer to purchase these premises. This has
been attaphed to the original petition, Your Honor. The offer ha~-
been accepted by Robert Paraska, Administrator, for both estat( s.
THE COURT: Mr. Paraska, the Administrator of the estat~,
as a creditor?
MR. ECKER: He 1s Administrator for the Commonwealth of
Pennsylvania, Department of Public Welfare, the creditor in the
estate, which will probably be preferred. There are Renunciatior~
filed by all the legatees and devisees under the Will and by the ba flli.
that was named as Administrator under the Will. The Order of
Judge Marino on the 28th of July directed that the petitioner
give notice as required by law of this hearing. And we have
prepared for the Court a copy of the notice of hearing which
was mailed to all heirs and devisees and legatees, and which was
mailed to a creditor of the estate, Mr. Estous Lee Davidson,
who is the Executor of the estate of John H. Davidson, deceased.
They had a claim against this estate and we notified them also.
Also attached is. the Affidavit of Robert
Paraska, Administrator, which avers that he complied with the
rules of Court by posting six handbills on conspicuous locations
on the premises, which las been done. And also attached to
the proposed Order are the Proofs of Publication from the
washington County Reports and the Observer-Reporter.
THE COURT: All right.

MR. ECKER: The Affidavits attached to the original petitioP,
by two competent real estate app:ra;i:S.ers aver that $7, 500.00
offered to be paid for these premises is greater than can be obtai ed
at a public sale.
THE COURT: Now, Mr. Ecker, it's been brought to my
attention,and obviously this is the reason for the two numbers and
terms, that there is a one-half interest in this property in each
estate. And Mr. Paraska then is representing both estates in the
sale of this property. Is that correct?
MR. ECKER: That is correct~ Your Honor. Whether
it's really one-half of one estate or one-half in the first estate
and the whole interest in the second estate, I -imagine it would
be for the Court to decide on distribution.
THE COURT: One of these sisters predeceased the other
and left everything to the survivor.
MR. ECKER: That is correct, according to the Wills.
THE COURT: ~ndl Mr. Paraska, in his deed, is going to
convey all the right, title and interest of each estate.
MR. ECKER: That is correct, Your Honor. And we were
asking the Court to approve this as a judicial sale from these
estates. I think that Mr. Bruno, who is represented by Howard
Goldfarb, had undertaken this purchase under those conditions,

MR. ECKER: It's to Mr. Bruno in his own name solely.
THE COURT: That is what, Robert Bruno?
MR. ECKER: Robert A. Bruno, (think the middle initial is.
THE COURT: we are approving this with the appreciation
of $7500.00. I think it would be necessary, Mr. Ecker, to have
the bond reset in each estate here. What bond do you now have on
the Administrator?
MR. ECKER: I think it was five or six thousand originally.
$5, 000 in each estate, I think, Your Honor.
THE COURT: $5, 000 in each estate?
MR. ECKER: Yes. The Commonwealth of Pennsylvania
has paid $35.00 for the yearly premium for the $5, 000 bond in ea h
estate. I have co pies of the paid bills for those bonds .
THE COURT: we are looking at the Ada M. Davis estate.
I think---I see you have personatt:j/ .Is there any other personalty
that you know of in the Sara Davis estate?
MR. ECKER: There is a clock, Your Honor, for which
we have received a bid of $1500.00, which we intend to sell.
THE COURT: According to your inventory of record, you
haven't put that on there yet, except household items.
MR. ECKER: we didn't have possession of it at the time
we filed the Inventory.
THE COURT: You have $5, 000 in each estate?
MR. ECKER: Yes. we will have to file a supplemental

cause why she should not return and surrender to Mr. Paraska
certain pers0nal property of the decedent in Mrs. Helen Thomas's
possess ion. We are ready to proceed on behalf of the Adm inistrato
I note Mrs. Helen Thomas is present in Court, Your Honor. And
I have asked her whether she is represented b.) counsel and she
informs me that she is not. Perha·ps she would like to address the
Court on that at the outset. I don't know.

nephew came just a few times and that was all.
Q Did you continue paying rent to Mr. Lenk? You paid your $50.00
a month rent to Mr. Lenk, is that right?
A Yes.
Q On or about November 13, 1969, or sometime thereafter, did you
become aware that Sara Davis had been declared an incompetent
and that Mrs. Helen Thomas had been appointed as;;her guardian?
A That's what I was told.
Q And in fact was it our office that advised you oflhis?
A Yes.
Q How long did you continue to live at that 404 East BmuuStreet addre 3S?
A Until January of 1971.
Q Some time in 1970 didyou begin paying your rent to the guardian,

Q Were you aware that Sara Davis had been placed in the Washington
Hospital?
·I had been told she had, but that was all I knew about it.
Sometime after you became aware that Miss Sara Davis was in the
Washington Hospital, did you have occasion to meet Mrs ... Helen
Thomas, the guardian?
Yes. She came to the house.
You say Mrs. Helen Thomas came to the house', Do you remembe what
date that was?
About the 9th, I think, of January.
The 9th of January, 1970. Did I ask you to search your recollect"on
to come up with that date? Did I ask you to see if you could remember
that date?
Yes, sir.
You're pretty sure that's the date?
As far as I can remember it was about then.
Are you sure that this date was before Mrs. Sara Davis died?
Yes.
And areyou sure it was after the time you became aware that Sara
Davis was hospitalized?
Yes.
I want you to tell the Court what happened ion that day, the 9th of
January, 1970. Who came to the home on Beau Street?
A Mrs . Thomas .

A She had a lady and two men with her.
Q · Can you tell the Court ft.ow they arrived?
A· Well, I think they had a station wagon.

A She said she wasn't going to return the clock to anybody, that .it
was given to her by Sara Davis, and she said that Mrs. Davis
even asked for the clock back before she died, but she wasn't going
to give it to her.

Nobody was going to get the clock from her. And she said that Sara

of May, 1971. And that presumptively during this time, Mrs.

capacity. Also, Your Honor, with respect-to the dates of the hos-
pitalization of Sara Davis at the Washington Hospital, we have rece ved
a letter from the Washington Hospital in which they give us the date
of the 6th of January, 1970 as the admission date of Miss Davis;
and the date of death as the 13th of January, 1970. It would, of
course, be possible to subpoena the medical records librarian to'
bring these records to the Court; if .that is necessary we will be gL d
to do it. We didn't think that was necessary for this proceeding.
I don't believe there is any dispute about thoseroates, Your Honor.
Do you agree that these are the correct dates?
MhS. HELEN THOMAS: I couldn't agree to any dates. I have no date~
in my mind. As you say, there is a record of these things, if they
have to be shown. And what does the date have to do with it? The
thing that's important in this record, I have that letter, that's
the only thing I have to go by. Did you send for it?
Mh. ECKE.rt: Well, Your Honor, if you'd like, we could subpoena
the person to prove those dates. I don't know if the Court requi'res
that or not. We have a letter returned to us from the hospital.
