Madalena Florida of 120 Grove Avenue, Washington, Pennsylvani , died testate on the 9th day of September, 1971. 2. John Florida, the Petitioner, was appointed Aqministrator •, ' C. T. A. by the Register of Wills of Washington County, on September 24'-9 1971. 3. In paragraph 5, of the decedent's Will, attached hereto as· Exhibit "A", the testatrix directed that her house and lot at 120 Grove Avenue, Wash~Jfgton, Pennsylvania be sold, being certain lots of ground situate in the 8th Ward of the City of Washington, Washington County, Pennsylvania, known and designated C:s part of Lots No. 9, ~0, ll, 12 and 13 on Block_nD" in the plan of lots known as the Shirls Drive Addition. 4. The petitioner has -h~d this tract of land appraised by two Waffiington. County real es,tate appraisers, whose reports are attached hereto as Exhibits "B" and "C". 5. -In Exhibit "B", Mr. John Nelan has appraised the property for the sum of Four Thousand Two Hundred Fifty and no/100 ($4, 250. OO)-Dollars. 6. In Exhibit "C", Mr. J. C. McCleery has appraised the property for Four Thous:md Five Hundred and no /100 ($4, 500. 00) Dollars. 7. The petitioner desires to purchase this property and offers to pay the:.-average of the two appraisals, the sum of Four Thousand Three Hundred Seventy-five and no /100 ($4, 375. 00) Dollars. '' 8. In paragraph 5, of the decedent's Will, attached hereto as Exhibit "A", the testatrix directed the payment of the sum of Two Thousand Four:Hundred Twenty-nine and no/100 ($2, 429. 00) Dollars in payment of, "monies owen to the Florida children ... ". the balance to be paid to the Watchtower Society, of 124 Columbia Heights, Brooklyn, New York. 9. The petitioner has heretofore posted a bond in the sum of One Tlnusand and no/100 ($1, 000. 00) Dollars with the Aetna Casualty and Surety Company as surety. WHEREFORE, the petitioner requests this Court in accordance with the provisions of Section 546, ·of the Fiduciaries Act of 1949 to purchase this Property himself under such terms and conditions and after such reasonable notice to the parties in interest as the Court shall direct.
