provide funds for the payment of debts"administration expenses and taxes and for
the further reason that neither the Petitioner"nor his son"the remaining heirs..desire
to take the same in kind.

original of an executed Agreement of Sale wherein~subject to the approval of Your
Honorable Court"your Petitioner agrees to sell the within described premises to Jane
Stein for the total price of $25..000.OO~of which $1.000.00 was paid down at the time
of the execution of said agreement of sale,ll and the balance thereof is to be paid"in
cash"upon the delivery of the deed"subject to certain conditions which are more speci-
fically set forth in said agreement"including,,'but not limited to"the holding of $1500.00
of the proceeds of the sale"in escrow"to secure the payment by the seller of the benefits
to bee ·ascertained and assessed by tt Board of View against the premises by reason of
the construction ofa sanitary sewage line and for the payment of the tap-in fee which
will be charged against the premises for and on account of the connection thereto.

$25.000.00,after deducting a brokerfs commission of $1750.00,the 1%Pennsylvania
Realty Transfer Tax in the amount of $250.00,and establishing the escrow account on
account of the sanitary sewage facility in the amount of $1500.00,all as provided for
in said agreement,will be $21,500.00.Also to be paid out of the proceeds of said sale,
is a principal balance of $3,000.00.without interest,due and remaining unpaid on mort-
gage of Delmar Hanley and Nellie C.Hanley,his wife,to Mary Grace Montague,dated
July 17.1954,recorded July 19,1954 in Mortgage Book VoL.445,page 503,in the original
principal amount of $10,000.00 and covering the premises described herein.which further
reduces the net proceeds of sale to $18,500.DO,which together with the aforementioned
personal assets in the estate in the amount of approximately $1500.00,will be more than
sufficient to pay all costs and charges due and owing by the estate"including.but not
limited to~decedent's debts,administration expenses~costs and fees and taxes.
12.Other than as set forth in paragraph"11"next preceding,there are no
liens of record on the subject premises,known to your Petitioner.
13.In the opinion of your Petitioner,the price and terms of 'said proposed
sale are better than could be obtained for said premises at public sale and represents
the fair market value thereof.
WHEREFORE,your Petitioner prays your Honorable Court to enter an Order
and Decree authorizing and directing your Petitioner to proceed with the aforementioned
sale of the within described premises,in accordance with the terms and conditions of

fee,and also any benefi~s that might be assess'ed agains t the
property~in accordance with an Article of Agreement which'
had been entered into between the Adm~nistrator of ,the es tate a~d
the purchaser of the property.
I called Mr.Sitko at Mount Lebanon Federal

-yesterday.He said the $300.00 tap-in fee had been paid out of he
fund,but the Board of View has npt handed down any benefits
yet.I didn't take that up in the audit.I felt we could handle
that at the time that the benefits were assessed.And any surpl]s

real estate and the date of acquisition of personalty,plus the name,address and relationship,if any,

That Schedule F attached hereto and made a part hereof sets forth fUlly and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including fUneral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fUdiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and unpaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed under Section

Your statement of August 30"1970 addressed to Grace C.Montague
in connection with the above captioned estate"was referred to the undersigned
for reply.
In response thereto"I have enclosed a photocopy of my file copy of
a letter addressed to your Harrisburg Office"to the attention of Karl P.Niehoff"
which I believe"is self-explanatory of the situation involved.
The principal asset of the estate of Nellie C.Hanley~other than the
jointly held bank account mentioned in your statement"is a one story"ranch type"
frame dwelling and lot situate at 218 W.McMurray Road"McMurray"Pa."which
we are having a difficult time selling for a reasonable price"and the proceeds from
the proposed sale of which are quite necessary for the payment of the debts,admin-
istration,expenses and taxes.We felt that the selling price thereof would satisfac-
torily fix a valuation for inventory and appraisement purposes and for this reason
have delayed filing an Inventory and Appraisement until such sale is made.
Every effert is being made to dispose of the property and as soon as
this has been done the Inventory will be filed..including the whole amount of the
joint bank account No.355-9563 referred to in your statement and a substantial
payment will be made on the Pennsylvania Transfer Inheritance Tax at that time.
The undersigned is acting as counsel for Delmar C.Hanley~the
Administrator of the estate and if you have any further questions regarding your
claim"I shall be glad to discuss them with you.

I have before me a copy of a letter addressed to the Inheritance
x Division of the Department of Revenue by Grace C.Montague,a sister
the decedent,under date of August 28.1971.relative to a checking account
No.355 -9563 in the Peters Township Office of the Mellon National 8e.nk and
Trust Company,which,at the time of decedent's death,stood in the names of
Nellie C.Hanley or Grace C.·Montague,her sister,as joint te.nants with the
right of survivorship,and which,following her death,was taxed by the Common-
wealth of Pennsylvania to the survivor on the basis of one-half the amount stand-
ing in said account as of the date of death.I also have before me your letter ot
reply,dated September 3,1971,in response to Mrs.Montague's letter.
Letters or Administration on the estate of the.above captioned
