The Petition of John F.Tomayko respectfully represents:
1.The name of your Petitioner is John F.Tomayko
who resides at 367 Marbury Road,Bethel Park,Pennsylvania.
2.The name of the decedent is Millie E.Tomayko,
also known as Millie Tomayko,age 79,who died of natural causes
at her former residence at 507 Meadow Avenue,Borough of
Charleroi,Washington County,Pennsylvania.

3.That your decedent died testate,leaving a Last
Will and Testament dated November 15,1962,and probated on
September 22,1971,in the Register of Wills of Washington
County,Pennsylvania,at Will Book Vol.112,in which Will the
said Millie E.Tomayko,a/k/a Millie Tomayko,devised and
bequeathed a life estate to Donald Tomayko for and during theI
.term of his natural life and following his death,to Margaret
Vandermer,Charles Tomayko,John F.Tomayko,Mildred Preckre1,
Louis Tomayko and Betty Huber in equal one-sixth shares.John F.
Tomayko,Petitioner herein,was appointed Executor of said Last
Will and Testament on September 22,1971.
4.The decedent died seized of no real estate but
having the following assets in personalty:
(a)36 shares of American Telephone
and Telegraph Company common

at First National Bank and Trust

property or real estate in her own name solely except the
assets referred to in the preceding paragraph.
6.There are no outstanding debts of any nature due·
and owing which have not been paid by the'said'Uonalcl Tomayko.
7.That Donald Tomayko of 507 Meadow Avenue,Borough
of Charleroi,Washington C~unty,Pe,nnsy1vania,is the only person,.
entitled to share in the family exemption under the Fiduciary.Act of 1949 as amended;that it is unnecessary to have said
assets appraised and valued.
WHEREFORE,your Petitioner prays your Honorable Court
to direct distribution of the assets of the Estate of the
decedent,Millie E.Tomayko,a/k/a Millie Tomayko,to Donald
Tomayko,pursuant to the terms of .the decedent's Last Will and
Testament,and as his family exemption under the provisions of
Section 211 of the Fiduciary Act of 1949,as'amended.
