PETITION FOR ORDER FIXING AMOUNT OF ADDITIONAL BOND
TO BE GIVEN PRIOR TO CONVEYANCE OF REAL ESTATE
UNDER SECTION 541 OF FIDUCIARIES ACT OF 1949
TO THE HONORABLE PAUL A SIMMONS,PRESIDING JUDGE OF SAID COURT:
The petition of ETHEL M.WRIGHT respectfully represents:
1.That Edith M.Myers,late of the Borough of Marianna,
Washington County,Pennsylvania,died,intestate,on April 25,
1971.
2.That on July 19,1971,Letters of Administration on the
Estate of Edith M.Myers,deceased,were issued by the Register
of Wills of Washington County,Pennsylvania,to Ethel M.Wright,
your petitioner,upon the filing of a Bond in the amount of
$3,600.00,with Hartford Accident &Indemnity Company as surety.
3.That your petitioner has filed of record an Inventory
and Appraisement of the assets of the Estate of Edith M.Myers',
deceased,showing assets in the total amount of $2,000.00.A
copy of said Inventory and Appraisement is hereto attached,and
marked Exhibit "A".
4.That the only asset of said decedent's estate is the
following described real estate:
ALL that certain tract,piece or parcel of
land,situate,lying and being in the Borough of
Marianna,in the County of Washington,in the
Commonwealth of Pennsylvania,that is designated
as Lot No.403 in a plan of lots laid out by
Bethlehem-Cuba Iron Mines Company,and recorded
in the Office for the Recording of Deeds in and

for said County of Washington on October 3,1945,
in Plan Book No.7,at pages 146 and 147,said
tract,piece or parcel of land having erected
thereon a house known and referred to as No.403
Third Street.
UNDER AND SUBJECT to the exceptions,reserva-
tions,conditions,etc.,set forth in Deed Book
764,page 168,Washington County Records.
BEING the same premises as conveyed by Bethle-
hem-Cuba Iron Mines Company to William Myers and
Edith M.Myers,his wife,by deed dated July 28,
1949,and of record in the Recorder's Office of
Washington County in Deed Book 764,page 168.
AND the said William Myers died on May 29,1963,
whereupon,title to said premises became wholly
vested in said Edith M.Myers,as surviving tenant
by the entireties.
5.That the aforesaid real estate is assessed for tax pur-
poses by the County Commissioners in the sum of $1,195.00.A
Certificate of said assessment is attached hereto,and marked
Exhibit "B".
6.That the decedent left to survive her,as her only heirs:
at law,two daughters,Blanche Lively and Ethel M.Wright,and
two granddaughters,Beverly Jean MOore and Janet Marie Reis,
children of Charles W.Myers,a son of decedent,who predeceased
her.All of said heirs are sui juris,and reside in the Common-
wealth of Pennsylvania.
7.That your petitioner believes the settlement of the
Estate of Edith M.Myers,deceased,will be facilitated if the
assets thereof are converted into cash.
8.That Rolland Engle and Elisa Engle,his wife,have
agreed to purchase the real estate described in paragraph 4
hereof for the sum of $2,000.00,and pay cash therefor.
9.That attached hereto are Affidavits of two responsible
persons familiar with the value of real estate in the Borough of
Marianna,Washington County,Pennsylvania,and with the value of
the property proposed to be sold,setting forth that the sum of

$2,000.00 is a fair and reasonable price therefor.Said Affi-
davits are marked Exhibits "c"and liD".
10.That there are no liens of record of any nature against
the decedent known to your petitioner,and all debts of the
decedent or her estate have been paid or provided for.
WHEREFORE,your petitioner requests your Honorable Court to
fix the amount of additional Bond to be given by her,if any,
under the provisions of Section 541 of the Fiduciaries Act of
1949.
