1.Claude W.Holden,Sr.,died intestate on the 24th day
of August,1971,a resident of the City of Washington,Washington
County,Pennsylvania,at the time of his death.
2.Manelva Holden Williams was appointed Administratrix of
the Estate of Claude W.Holden,Sr.,on the 13th day of September,
1971.A bond of $2Xbo.~was posted.
3.Claude W.Holden,Sr.,was the owner of a tract of land
located in the Sixth Ward of the City of Washington,Washington
County,Pennsylvania,bounded and described as follows:
BEGINNING at a point which lies 50 feet
distant in the direction South 75 0 30'West from
the southwest corner of the intersection of Core
Street and Leet Street and is marked by a stone

stake:thence,South 50°28'West 55.18 feet to a
stake:thence,North 14°30'West 98.98 feet to a
stone pier on the southerly side of Core Street:
thence,along the southerly side of Core Street,
North 75°30'East 50 feet to the place of BEGIN-
NING.
TOGETHER with a perpetual easement or right
of way for passage,but for passage only,over a
strip of ground belonging now or formerly to J.
Walter Barnes et ux.,located in said Ward,
adjoining the lot above described and described
as follows:
BEGINNING at the southwest corner of the lot
above described,thence,South 50°28'west 55.18
feet to a point at the southwest corner of other
lands of the grantors on the east side of Cuhl
Alley:thence,along the east side of Cuhl Alley,

County,Pennsylvania,in Deed Book 748,at page
545.The said Giulia C.Holden predeceased
Claude W.Holden,Sr.
4.Your petitioner agreed to and did sell the estate's
interest in the above described real estate to Earl O.Holden on
August 11,1972 for the consideration of $15,000.00.

was a fair market value for the said real estate.
6.The heirs of the Estate of Claude W.Holden,Sr.,
authorized Mane1va Holden Williams,Administratrix,to sell the
property for the sum of $15,000.00.Said notarized authorization is
attached hereto,made a part hereof,and marked Exhibit "A".
7.No objection was raised to the sale for the said sum in
the settlement of your petitioner's accounts and an Adjudication and
Decree was issued on February 8,1973 distributing the proceeds of
the sale and the balance of the estate to the heirs.
8.It has come to the attention of your petitioner that a
Petition to Increase or Excuse Bond was never filed and that under
the current Pennsylvania case law this can create a cloud on title.
WHEREFORE,your petitioner respectfully requests your Honorable
Court to order that the entry of additional security in this matter
be excused.
