PETITION FOR APPROVAL OF LEASE.
To the Honorable P.V.Marino,Judge of said Court:
The petition of James W.Stocking,successor trrustee
under the will of the above named James S.Stocking,deceased,
respectfully represents:
1.By decree of the Orphans Court of Washington
County,Pennsylvania,dated October 9,1944,and filed to
No.70,August Term,19L~~,O.C.,petitioner was duly appointGd
successor trustee of the trust estate set up under the will of
James S.Stocking,late of Washington,Washington County,Penn-
sylvania,deceased,which will was duly probated and is now of
record in the office of the Register of Wills of vias hington
County,Pennsylvania,in Will Book 29,332;and petitioner
thereafter duly qualified and has continued from the date of
said appointment and is now acting as such trustee.
2.Among the assets of the trust estate is a lot of
ground fronting approximately 40 feet on the easterly side of
South Main Street in the Fourth Ward of the City of Washington,
111l8shington County,Pennsylvania,directly oppos i te the Court
House,and extending back on Schaeffer Avenue,bounded on the
north by property known as the Washington Trust BUilding property,
on the south by property now or late of A.B.Caldwell heirs,
bein~part·of Lot No.276 in the General Plan of the City,and
being designated as Nos.20-24,South Main Street.Upon said
premises is erected a five-story brick store and office building

with basement,fronting on Main Street and Schaeffer Avenue,
known as the Brown Building.This petition concerns the basement.
3.The tenant of the said basement having gone out
of business and surrendered use of the basement,petitioner has
negotiated a lease,subject to approval of your Honorable Court,
for said basement,with Maboy,Inc.,a corporation,now lessee
of the first and second floors of said building,for a term to
end on February 28,1983 (coinciding with the end of the said
lease of the first and second floors),at a rental of $450.00
per month,or six percent (6%)of gross sales of merchandise on
the demised premises,whichever is larger,as more fully set out
in copy of lease,marked Exhibit "A lt ,attached hereto and made
part hereof.
L1-.Said lease of said basement is to the best
interest and advantage of said tr~st estate,and as good as
can be obtained for said premises in the circumstances.
Wherefore,petitioner respectfully prays that'
your Honorable Court approve the said new lease,pursuant to
the provisions of section 962 of the Fiduciaries Act of 1949,
P.L.512,20 PS 320.962.And;j'Will ever.pray,etc.
