MEMORANDUM AND ORDER On or about March 14,1974,Elizabeth Walsnovich filed a petition requesting that a Citation be issued upon the heirs of John Cider to show cause why a certain writing purporting to be his Last Will and Testament should not be admitted to probate.On August 30,1971,Helen Nickle and Steve Chider were appointed to administer the estate of John Cider,deceased.Prior to this petition for Citation,the said Helen Nickle and Steve Chider,after having been demanded to do so,refused to surrender the Letters of Administration to the Register of Wills and further refused to take any affirmative action to challenge the writing that was submitted by Elizabeth Walsnovich for probate.This writing which was submitted by Elizabeth Walsnovich was dated July 22,1970,and purported to devise and bequeath all of the property of the testator to the said Mrs.Elizabeth Walsnovich. The question in issue is whether or not this purported will was signed by John Cider.A handwriting expert was engaged by all of the parties and said expert appeared before the Court on September 12,1974. The name of the expert was Mr.Joseph Tholl,of Peninsula,Ohio.Mr.Tholl qualified as a handwriting expert and testified that the handwriting on said purported Will was in fact the handwriting of John Cider.In the light of that testimony,it is the order of the Court t hat the Letters of Administration heretofore issued to Helen Nickle and Steve Chider in the above estate shall be declared null and void and the order of the Register of Wills issuingsaid Letters of Administration to the said persons is hereby vacated.Further the Register of Wills is directed to admit for probate the Last Will and Testament of the decedent dated July 22,1970.The said Elizabeth Walsnovic may make application to act as personal representative of this estate inasmuch as it is apparent that she is the sole heir and devisee of the decedent.A full opinion consistent with this Memorandum and Order will be written if the same shall become necessary. Well,I was on the telephone,I work for the Humane Society,he had come in and he'd asked if he could use my typewriter,and I said,"No,"I didn't have no paper.But I was still on the phone,and he had got th"s slip from his pocket and he just went ahead and did this.And when he was through,he had asked my son to pign and my son-,-,""~-I told him then,I said,"John,I don't think that's any good."I said,"I was under the impr=>s- sion you had to go to an attorney." Yes,sir.These were submitted yesterday about 1:30 in the afternoon.And I proceeded to make a number of tests.In making these tests,I used various magnifying glasses and simple microscopes.of varying magnifications The signature,that is the WillIs signature,the alleged Will signature,and the known signatures to be comparati ely and analytically ~;xamined,not only as to thenoverall signature,but as to all the structural details and writing habits,and this was especially vital,since the Will signature was made with pencil,which does render it somewhat more difficult to examine and fortunaiJely we did have one penciled signature on the application to the Volunteer Fire Department,which is marked as Proponentls Exhibit "C";and these signatures,that is the handwriting itself was examined as to the various factors which I could go into and explain. Of course,first of all,the form of the letters, the details of structure of each individual letter. Like some letters in John,certain pecularities.In fac~, they all did,but some had them more than others,such things as pen stops where there were characteristic pen.:~stops.Because John Cider did make certain pen stops. ;'t ..,....,~• I ,!,....' in porpo·r,b'ion's.6f .theletters'o'f one or the other; because in handwrit~ng,there is a porportion which is maintained,more or legs~It tends to vary less in other r 'I 1n factors and is an indication of things like the alignment, the base line or how the signature sits on the line,whetter it is rounded 'or ~urrips up,..and·,doWI).,or certain letters f • • '~I •• jump up and down.Those are all very vital things. Things like pressure indications,slant habits,what I "call the final terminal strokes and initial terminal strokes;things like thei dots,'the way the signature was set into the space.Also examined were the details of execution;that is as to whether the signature was drawn or whether it was written in a free,normal, coordinat~d movement as a genuine signature is written, or whether it was drawn piecemeal slowly and more like a drawing,which relates more to the forgery. Now these are all the tests that I made. I also considered such things----these are general,and of course,I ca1 go into more detail---I considered such things as the folds in the paper,which intersects letters. I considered the ink in the typewriting;I considered the typewriting itself.I considered the paper;that is the paper is very fragile and it is very absorbant· and verytthiu~:~You couldntt erase on it very well.I considered the size of this instrument,the fact that it is not much bigger than about six postage stamps.And so I considered all of the circumstances relating to the document itself as well as to the handwriting. 11 Q Do you have an opinion that you are willing to testify here today as to the genuineness of the signature on the purported Will as it compares to those other exhibits? on this piece of paper,and that it was made by the What is your opinion,sir? Now as for Proponentts Exhibit "C",we have an example of the signature of John Cider.Counsel referred to the fact that the 01 is divid~d here,it is divided here and it is divided here in all three.Yet on here the letters are run together.It looks like CI.' And of course,on Proponentts Exhibit tlF"also there is a division,and C and I are separated.Yet on this Exhibit here on Proponentts Exhibit lICit,which is ·the Volunteer Fire Department,these letters are run together.Now actually,they are still separated. This is the point infue examination, this I runs into the D.And there is a separation. These come in separately.The same thing exactly occurs md you can see it under magnification in the Will signature. There is a stop where the I is joined onto the D. In this case,I can s~y that he does run the I and the D together in Exhibit "C II just as he doe s in the Will signature.Of course,there are many other , factors besides that.The'i'e are other differences which I ~••"I ...t Ii.,."~~-, we have in the other exhibits;that is they differ from exhibit to exhibit,b~t yet when they are all put together,the sumto'tal 'of tnosel:'characteristics is foun in the questioned signa~ure :on,the Will.Like the H, the letter H,all the H's appear to be a,certain form in all of the exhibits with the exception,that is the known exhibits,with the exception of Proponent's ExhibiJ liE II ,where we have a Tounded H.It ha s a rounded bottom.It's made very close.We have almost the same identical type of H on the Will signature,the H in John.That is the only place it occurrs. No further questions. THE COURT:It is your opinion,from all of the available specimens and after comparing the specimens with the signature on the Will,that the signature on this purported Will,which is Proponent's Exhibit "B", is in fact the handwriting of John Cider. 17 A That is his writing.It is his signature on that portion of the sales invoice which was hand-cut out of we know, another type of document. The top of the H intersects the letter above.And as I said,I feel that the signature has been slightly a process that takes several years.I am a little at a Ibss repaired and there has been 'mjgration.
