3.That your petitioners as Administrators c.t.a.
of said estate have entered into an agreement to sell the above
described property to Mildred M.Smith for the sum of $4,500.00,
payable in cash on delivery of deed.
4.That there is attached to this petition the
affidavit of two responsible peisonsacquainted with real estate
values in the vicinity of said real estate setting forth the
fair market value of the property proposed to be sold.
5.That your petitioners have been unable at this time
to file an inventory of the assets of said estate but to the
best of their knowledge,the personal assets amount to approximate y
$14,000.00 and the real estate which is the subject of this
petition is the only real estate owned by decedent.
6.That at the time Letters of Administration c.t.a.
were issued your petitioners filed bond in amount of $2,000.00
with Travelers Indemnity Company as surety at the Register of
Wills Office for Washington County.
WHEREFORE,petitioners pray Your Honorable Court to
fix the amount of additional bond to be filed by your petitioners
before ~losing·out said transaction.

Please be advised that the Audit in the above captioned
Estate was continued by Curran,J.,specially presiding on
December 20,1972,to January 15,1973,at 3:00 o'clock P.M.
for the purpose of enabling MarieE.Pettit and Wheeling Clinic,
represented by Washington Credit Bureau,to present claims against
the Estate.
At Motion and Rule Court held on January 15,1973,at 3:00
o'clock P.M.,I requested the Court to close the Audit in the
absence of any appearance filed by either of the above claimants.
The Court had the Tipstaff call for both parties and no response
was received,whereupon the Court by Judge Curran ordered the

died after making a holographic will in which he left everything

WHEREAS,Ida J.Hale died June 1,1971,survived by
her husband,Simon D.Hale,and five (5)children,namely:Clyde
W.Hale of Struthers,Ohio,Robert D.Hale of R.D.#1,West
Alexander,Pennsylvania,Mae Frances Anderson of Akron,Ohio,
Marie E.Pettit of 507 Wayne Street,Washington,Pennsylvania,and
Carol D.Stewart of R.D.#2,Eighty-Four,Pennsylvania;and
WHEREAS,Simon D.Hale died August 1,1971,survived
by three (3)children,namely:John D.Hale of 878 Chartiers
Stree~,Washington,Pe~nsylvania,Leanna ~ierson of Poland,Ohio,
and Raynor E.Hale of R.D.#2,Claysville,Pennsylvania;and
WHEREAS,the said Simon D.Hale left his holographic
Will dated January 17,1970,wherein he bequeathed and devised his
entire estate unto his said wife,Ida J.Hale;and
WHEREAS,the children of the said Simon D.Hale and
Ida J.Hale desire to provide for the amicable disposition of the
estates of their respective parents.
NOW THEREFORE,in consideration of the foregoing and
in theinteres·t of family harmony ,it is agreed by and between the,c ,
parties hereto as follows:
1.That the Will of Ida J.Hale dated April 10,1951,
shall not be probated as the said Ida J.Hale owned her real and
personal property as tenants by the entireties with her husband,
Simon D.Hale.

2.That the holographic Will of Simon D.Hale dated
January 17,1970 be probated and Letters of Administration c.t.a.
thereon be issued by the Register of Wills for Washington County,
Pennsylvania unto
3.That notwithstanding the terms of the Will of the
said Simon D.Hale,the parties agree with each other~that the
balance of said estate after payment of inheritance taxes and
debts and expenses be awarded in equal shares among the children
of Simon D.Hale and Ida J.Hale abovenamed.
4.That at the time of the Audit of the First and Fina
Account of the Administrators c.t.a.in said estate,the said
Administrators c.t.a.will request the Judge of the Orphans'Court
Division of the Court of Common Pleas of Washington County,
Pennsylvania,to make distribution of the balance of said estate,
in accordance with this Agreement.

decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement showing which of the beneficiaries named in the decedent's wi~l,if any,died prior
to decedent,the dates of their death,their issue,and the relationship of such issue to the beneficiary.
That Schedule E attached hereto and made a part hereof sets forth all property,real and per-
sonal,owned by the decedent jointly with another or others,including intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments effecting the vestiture of
real estate and the date of acquisition of personalty,plus the name,address and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expepded for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims OWing and Impaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for obliga-
