GUARDIAN OF AN INCOMPETENT
TO THE HONORABLE,THE JUDGES OF THIS COURT:
The Petition of Peter H.Smith...Executive Director of the
Washington County Public Assistance Board...by his attorneys,PEA-
COCK,KELLER,YOHE &DAY,respectfully petitions your Honorable
Court as follows:
1.The petitioner is Peter H.Smith...an individual...who resides
in the City of Washington...Washington County...Pennsylvania and whose
business address is 87 West Wheeling Street,P.O.Box 491...Wash-
ington...Pennsylvania 15301.
2.Mrs.LesterJ.Williams...the alleged incompetent...is an
individual who resides in the City of Washington...Washington County...
Pennsylvania and whose post office address is 1758 Jefferson Avenue"
May Belle Manor"Washington...Pennsylvania 15301.
3.The proposed guardian is Mrs.Rosemary Marriner...an
individual who resides in the City of Washington...Washington County...
Pennsylvania and whose post office address is 61 McKennan Avenue"
Washington...Pennsylvania 15301.
4.Mrs.Lester J.Williams is an adult...aged 80"who was
born on August 12,1890.
5.It is believed that the alleged incompetent is physically
and mentally incapable of handling her affairs or taking care of her-
self and is legally incompetent.
6.Mrs.Rosemary Marriner~the proposed guardian~has in
the past cared for the alleged incompetent~her mother~and presently
visits her mother daily in May Belle Manor N\1rsing Home.Mrs.
Marriner has consented to serve as guardian of the estate of Mrs.
Lester J.Williams as is evidenced by the consent to guardianship
which is attached hereto and made a part hereof.
7.Mrs.Rosemary Marriner is a daughter of the alleged
incompetent and has no adverse interest in the estate of the alleged
incompetent.
8.The alleged incompetent has no estate and her only source
of income are monthly grants of $142.70 paid by the Department of
Public Welfare of the Commonwealth of Pennsylvania and $146.70
OASDI which are used for the support and maintenance of the alleged
incompetent.The proposed appointment':is for the purpose of designatin
a proper person to receive and manage these assistance payments.
9.The alleged incompetent is not presently employed and has
been a patient at the May Belle Manor Nursing Home since April of
1969.The alleged incompetent is suffering from organic brain disease
with advance senility and requires complete and total nursing care.
The physician of the alleged incompetent is Dr.J.Paul Proudfit"

WHERE FORE1 your petitioner prays your Honorable Court
to appoint Mrs.Rosemary Marriner.,t Guardian of the estate of Mrs.
Lester J.Williams1 the alleged incompetent",for the purpose of re-
ceiving and managing assistance payments1 with authority to execute
any appropriate instruments~including reimbursement agreements~etc.
as may be required by the Department of Public Welfare in establishing
the incompetent's continued eligibility for public assistance.

with the provisions of Section 402 of the Incompetentts Estate Act
of 1955,as amended.
Said guardian shall have authority"inter alia"to receive and
administer the assistance payments paid by the Department of Public

wise authority to execute reimbursement agreements as required by

A Almost completely,yes.
Q Does she recognize members of her family?
A I do not know.
Q But you have known her and she has known youfor many many years
and you are doubtful whether she recognizes you?
A I am quite doubtful.
Q And in your opinion,Doctor.she would be unable to handle her busin~ss

A Absolutely.

A I have one sister living.There is another sister who was deceased
many years ago.
Q And I take it that your father is deceased as well,is that correct?
A Yes.

A Housewife.

Have you been taking care of your mother prior to that time?
For five years.
Was she in you r h9m e?
Yes.
Will you describe for the Court your mother's condition?
Well,mother moved in with us after my father died.And she had beE n
having trouble remembering even before that.And then she just got
progressively worse to the point where we could not take care of her
ourselves and therefore,'we put her in a nursing hOme.
You took care of her for approximately 6 years was it?
Yes.
She's been in the nursing hom e two years now?
Yes.
How would;.your mother act,if you could tell the Court very briefly?
Well,near the end,before we took her to the nursing home,she wo ld
be very confused as to where she was,what town she was in,who WE re
in the our house .And then she would get angry and if she were cros ed;
if we said no,mother,I don't want you to do this,she would become
angry and kick at furniture or s trike out at us.

Q This is why you sought to have her placed in the nursing hOme,is th t
correct ?
A This is right.We were afraid that she might do damage to herself

and we couldn't be in the rOOm with her every moment.Because she
was able to walk around and do things at that stage.
Q Is your mother still ambulatory?
A No.
Q Will you tell the Court what her fa'cilities are in the nursing home
and how she is cared for there?
A She's in a rOOm with two other wOmen at this stage,and they have
the bars along-the side of the bed.They get her up as often as they C:in,
but sbe cannot stand.It takes two people even to move her to sit her
in a chair.And they ha ve to tie her in a chair to make her even sit
up straight.There are sOm e days when she may feed herself if she
remembers to eat.
Q In other words~you r mother's memory has lapsed considerably reCE ntly.
A Yes.
Q Haveyou visited your mother recently in the nursing home and do yo
go periodically to see her?
A I go periodically and then if I don't go then I'm in touch by phone witl
the head nurse there.
Q I understand.Does your mother recognize you personally when you gp
to see her?
A I don't think she has since last October.And then I felt that there wa~
just a glirY'rrer.that she knew,not that I was her daughter,but
somebody familiar to her.
Q 1s she able to communicate with you?
A She hasn't said anything to me directly except to smile and say thank
yo~.She did'tell me one tiIY'e this winter how much she liked the nurse
out there,but that's all.

Nothing.
What is her source of income presently?
Her Social Security.
Does she receive an amount of $142.ob per month,approximately fr~m

A Yes.
Q And does she also receive $197.30 from the Pennsylvania Departmer t
of Public Welfare in a monthly check?

A Yes.
Q.Are those two checks the only sources of her income?
A Yes ..
Q Do you know of any other oy.t'standing claims or obligations against
her?
A No.I'm fairly certain that there are none.
Q What are the expenses of her maintenance at the nursing home on a
monthly bas is ?
A I think $340.00.
Q And is the money received from the Social Security and Department ( f
Public Welfare checks used to pay these monthly expenses at the
nursing home?
A Yes.
Q Is there any left over?
A There's $5.00;I believe,that the home uses for special things like,
oh,sometimes they buy extra milk or depending on what she needs,
like that in the food line.
Q In other words,she has a certain amount,five to ten dollars set asi e
for personal needs,is that right?
A Right.
Q Mrs.Marriner,do you yourself have any outstanding claims or obligations
againstyour mother?
A No.
