Hoffmann~respectfully represents: 1.That your petitioner is the widow of Joseph Waivada,late of The Borough of New Eagle,Washington County, Pennsylvania. 2.That Joseph Waivada,herein called decedent,age eighty-four years,died domiciled in The Borough of New Eagle, Washington County,Pennsylvania,on December 25,1970. 3.That your petitioner was the spouse and surviving widow of the decedent. 4.That your petitioner and her late husband were married on November 18,1912,and maintained the family relation- ship up to the time of his death. 5'.':"..:That nei the r Let t ers Testamen tary 0 r Let t ers 0 f Administration have been granted to any person in decedent's estate. 6.That the Estate of the decedent consisted of only an underpayment of $433.40,being the amount due on decedent's Black Lung Claim.A copy of the letter of the Department of Health,Education and Welfare setting forth that asset is hereto attached as Exhibit IIA.II 7.That your petitioner has paid the following debts " '4::" 4•.- of the decedent's estate: L.M.Frye Funeral Home Father Lang Burial expenses Honorarium $1591.00 20.00 $1611.00 Neither the decedent or his estate are indebted to any person. 8.That decedentls estate is not subject to the payment of any Inheritance Tax due the Commonwealth of Pennsyl- vania. Your petitioner therefore prays your Honorable Court, pursuant to Sec.2114 of the Fiduciaries Act of 1949,PL 512,as amended,to make an order and decree awarding the Black Lung Claim in the amount of $433.40 to her on account of the Family Exemption from the Estate of Joseph Waivada,deceased.
