HANNA,his wife,of 902 First Street,Canonsburg,Pa.,for $3,500.00,clear of encumbrances and all expenses of sale. 8.The agreement provides that the decedent1s estate shall pay all of the transfer stamps on the deed as well as all of 1972 taxes. 9.Said sale shall be subject to a sales commission of $200.00 to be paid by the decedent's estate. 10.Your petitioner has continuously tried to sell said real estate for more than one year.It was placed for sale with the F.J.Buckley Real Estate Agency in November 1971 and they have been unable to produce a buyer at any price.Said real estate has been offered to Cesare Falconi,Angelo Falconi, James Tomsic,William Tomsic,Kenneth Paul,George Loutsion, John Nikas,James Shearer,Walter Monahan,David A.Leichty, George Mantalis,Clyde Sheets,Quinton Patterson,Leroy Patterson,Kenneth Davis,Samuel Arcure,Washington County Redevelopment Authority,and thirteen other prospective buyers. 11.Said real estate is located in a gully,is subject to floods and high water,and is so delapidated and so poorly located that none of the above mentioned parties would make an offer of any amount to purchase same. 12.Your petitioner believes $3,500.00 is a fair price for said real estate and a better price than can be obtained at a public sale.The $3,500.00 offer made by Marshall J. Hanna et ux.,is not only the best offer your petitioner has had but the only offer. 13.A copy of decedent's will is attached hereto. J .M.;'Ward,an investigator for the Veterans Administration,checked the situation and then recommended to the Veterans Administration Committee on Waivers that this overpayment be waived. MR.CUMMINS:Yes.So they sent an investigator out.a man 2 by the name of Mr.W'ard.and he looked the situation over and decided there should be a waiver of this claim.And it was present!d to the Committee on Waivers of the Veterans Administration.and they advised me that they do not want to collect this bill. I have it in writing.'The thing that I want to ask the Court to do.is to instruct me or make an order.whether or no this should be paid.The claim apparently is valid.It arose from the fact that the veteran's wife.c:had died and he negle.eted to notify the Veterans Administration.and he was paid for a period of two 0 three months on the basis of one dependent.which resulted in this overpayment.So I think the overpayment is valid and the claim is valid.But Idohave this letter which reads as follqws: "We havereceived a decision from the CommittE e on Waivers concerning your requst for waiver of an indebtedness due to the V.A.in the amount of $315.00.This is to advise you that the Committee has decided to waive recovery collection of this overpayment."Well now.they don't cancel the debt.And the~ is enough money in the estate to pay this claim.IEsta valid claim.
