SHOULD NOT BE CONSUMMATED
TO THE HONORABLE,THE JUDGES OF THE SAID COURT:
The petition of Andrew W.Cummins,executor of the
above entitled estate,respectfully represents:
1.That decedent died testate on July II,1971 and
letters testamentary were granted to Andrew W.Cummins by the
Register of Wills of Washington County,Pennsylvania "on
July 22,1971.
2.The only persons interested in the Decedentts
estate under said will are VERONICA CASSANDRA LeMON,VALERIE
CYNTHIA,LeMON,VIOLET CHAROLETTE LeMON and VALIA CARLA LeMON,
all of whom are minors having as testamentary guardian of their
estates their Mother,ESTHER LeMON.
3.The personal estate and rents from real estate
of the decedent are insufficient for the payment of his debts,
and it is necessary that your petitioner sell his real estate
for this purpose.
4.The only real estate owned by decedent is three
lots in the First Ward Annex of the Borough of Canonsburg,
Washington County,Pennsylvania,known as lots Nos.171,172
and 173 in the McNary Plan of Lots recorded in Plan Book 7
page 10 and also in Plan Book 5 page 166.
5.Said three lots make a plot of 120 feet long and
120 feet wider upon which are located three shanties,two of
which are unOccupied.The third is occupied by Ester LeMon and
her children,named as residuary beneficiaries under decedent~s
will,for which no rent is being paid.
6.Satd real estate is known as 173 Moore Avenue,
Canonsburg,Pa.All of said lots and buildings are assessed
for a total of $1,095.00.
7.Under authority of Section 541 of the Fiduciaries
Act of 1949,your petitioner has agreed to sell all of said
real estate at private sale to MARSHALL J.HANNA and ANITA M.
HANNA,his wife,of 902 First Street,Canonsburg,Pa.,for
$3,500.00,clear of encumbrances and all expenses of sale.
8.The agreement provides that the decedent1s estate
shall pay all of the transfer stamps on the deed as well as all
of 1972 taxes.
9.Said sale shall be subject to a sales commission
of $200.00 to be paid by the decedent's estate.
10.Your petitioner has continuously tried to sell
said real estate for more than one year.It was placed for
sale with the F.J.Buckley Real Estate Agency in November 1971
and they have been unable to produce a buyer at any price.Said
real estate has been offered to Cesare Falconi,Angelo Falconi,
James Tomsic,William Tomsic,Kenneth Paul,George Loutsion,
John Nikas,James Shearer,Walter Monahan,David A.Leichty,
George Mantalis,Clyde Sheets,Quinton Patterson,Leroy
Patterson,Kenneth Davis,Samuel Arcure,Washington County
Redevelopment Authority,and thirteen other prospective buyers.
11.Said real estate is located in a gully,is subject
to floods and high water,and is so delapidated and so poorly
located that none of the above mentioned parties would make an
offer of any amount to purchase same.
12.Your petitioner believes $3,500.00 is a fair price
for said real estate and a better price than can be obtained
at a public sale.The $3,500.00 offer made by Marshall J.
Hanna et ux.,is not only the best offer your petitioner has
had but the only offer.
13.A copy of decedent's will is attached hereto.
Your petitioner,therefore,prays your Honorable Court
to issue a rule to show cause why said sale should not be
consummated.,

AND NOW,comes George E.Anthou,Attorney for Esther
LeMon,Guardian of the Estates of Veronica Cassandra LeMon,
Valerie Cynthis LeMon,VioletCharolette LeMon,and Valia Carla
LeMon,and makes answer to the Petition filed at the above number
as follows:
1.Paragraph 1 is admitted.
2.Paragraph 2 is admitted.
3.In answer to Paragraph 3,the Guardian,Esther
LeMon,does not have sufficient knowledge with which to answer
the allegations contained in Paragraph 3 and the same are,there~
fore,denied.Information supporting these allegations are with-
in the exclusive knowledge of the Executor of the Estate,Andrew
W.Cummins..Accordingly,proof of the assets of the estate and
the debts connected therewith are demanded.
4.Paragraph 4 is admitted.
5.In answer to Paragraph 5,it is admitted that said
three lots have dimensions of 120 feet by 120 feet,but it is
specifically denied that the three structures on the lots are
shanties.It is admitted that two of the structures are unoccu-
pied and that the third is occupied by Esther LeMon and her
children.
6.In answer to Paragraph 6 it is admitted that the
said real estate is known as 173 Moore Avenue,Canonsburg,Penn-

sylvania,and that said lots and buildings thereon are assessed
for a total of $1,095.00.By way of further answer,the Guardian
avers that the assessed figure mentioned above does not include
the structure which the residuary beneficiaries live and is not
a true or realistic assessment of said properties.
7.In answer to Paragraph 7,the Guardian has no
knowledge of the allegations therein.The information supporting
these allegations are within the exclusive knowledge of the
Executor of the Estate.Accordingly proof thereof and a copy of
the agreement is demanded.
8.In answer to Paragraph 8 it 'is.denied for reasons
set forth in Paragraph 7 above.

The veteran's Administration presented a claim for $315.00 for
overpayment of benefits to the decedent (See letter attached).Decedent's wife
died August 3,1970.Not being advised of the death,the veterans Administratio
continued to pay decedent for several months on the basis of a Veteran with one
dependent.This created the overpayment of $315.00.
J .M.;'Ward,an investigator for the Veterans Administration,checked
the situation and then recommended to the Veterans Administration Committee on
Waivers that this overpayment be waived.
This committee has decided to waive recovery (collection)of this
overpayment (see letter attached).
It should be noted that the Veterans Administration has not
cancelled this debt.It merely waives collection of it.In view of the fact
that there is enough money remaining in the estate to pay this bill,the

Your letter of September 14,1973,addressed to the Chief,Finance
and Data Processing Division,Veterans Administration,has been
referred to this office for attention regarding the overpayment of
$315.00 to Mr.Weatherspoon.
Waiver of indebtedness was authorized on the basis that Mr.Weatherspoon's
estate was insolvent and that insufficient assets would be available to
pay secured debts.On this basis the standard of equity and good conscience
authorized by law was applied to granting waiver.
It now appears that the factual information was incorrect and that there
are sufficient assets to pay the claim which is a priority debt.Accord-

If the Court please,the only thing that needs to
Veterans Administration 'claimed there was an overpayment of
benefits of $31-5.00.And I have a letter dated January 24,1972,

(to that effect.They kept pressing me for payment on this,'and
.I was not in the position to tell them Vo(hether there would be enoug
,money in the.estate'to pay them or not.

MR.CUMMINS:Yes.So they sent an investigator out.a man

by the name of Mr.W'ard.and he looked the situation over and
decided there should be a waiver of this claim.And it was present!d
to the Committee on Waivers of the Veterans Administration.and
they advised me that they do not want to collect this bill.

MR.CUMMINS:
Do you have tha t in writing?
I have it in writing.'The thing that I want to ask
the Court to do.is to instruct me or make an order.whether or no
this should be paid.The claim apparently is valid.It arose from
the fact that the veteran's wife.c:had died and he negle.eted to notify
the Veterans Administration.and he was paid for a period of two 0
three months on the basis of one dependent.which resulted in this
overpayment.So I think the overpayment is valid and the claim
is valid.But Idohave this letter which reads as follqws:
"We havereceived a decision from the CommittE e
on Waivers concerning your requst for waiver of an indebtedness
due to the V.A.in the amount of $315.00.This is to advise you
that the Committee has decided to waive recovery collection of this
overpayment."Well now.they don't cancel the debt.And the~
is enough money in the estate to pay this claim.IEsta valid claim.
They don't cancel it.but they say they will not push for recovery.
This leaves me in doubt as to whether I should 'pay 1.t or whether
I shouldn't pay it.

County,Pennsylvania,being of sound mind and memory,do
hereby make,publish and declare this to be my Last Will
and Testament,in manner and form following,hereby revoking
any will or wills heretofore made by me.
FIRST:I direct that all my just debts and
funeral expenses be fully paid and satisfied as soon as
conveniently may be after my decease.
SECOND:All the rest,residue and remainder of
my estate,real,personal and mixed,I give,devise and
bequeath,in equal shares,to the following named persons:
VERONICA CASSANDRA LE MON,VALERIE CYNTHIA LE MON,VIOLET
CHAROLETTE LE MON,and VALIA CARLA LE MON.
THIRD:I nominate,constitute and appoint ESTHER
