1. That your petitioner is LILLIAN KERNOHAN, Executrix of the
Estate of Clyde W. Saxton, a/k/ a Clyde Saxton, deceased.
2. That the residence of the deceased was Borough of Burgettstown,
Washington County. Pennsylvania.
3. That the decedent died testate September 29, 1970.
4. That the estate of the decedent consists of:
Cash from the sale of 1969 Chevrolet Nova automobile.

to Section 202 of the Fiduciaries Act of April 18, 1949, p. 1. 512, 20 P. S.,
Section 320. 0 as amended, to award distribution of the balance in the amount'
of$ 284. 56 to your petitioner, LILLIAN KERNOHAN, as sole devisee under
decedent's will.

I, CLYDE w. SAXTON, an adult resident of the Borough
of Burgettstown, Washington County, Pennsylvania, being of sound
and disposing mind and memory, hereby ·re~oke all wills and codicils

as well as all instruments of a testamentary nature heretofore

made by me, and do hereby make, publish and declare this to be my
Last Will and Testament in manner and form as ·follows:
FIRST: I direct that all my just debts, funeral bills
and testamentary expenses shall be paid by my
Executor hereinafter,named, as soon as conven-
iently may be following·my death.
SECOND: All the rest, residue and remainder of my
estate, rea1, personal or ~ixed, of whatever
nature or wheresoever situate which I may own
or may have the right to dispose of at the
time of my death, I hereby give, devise and
bequeath to my dear friend, Lil~ian Kernohan.
THIRD: I hereby nominate and appoint Lillian Kernahan
to be the Executrix of this, my Last Will and
Testament.

COURT: ' He represents a son of the decedent,
Clyde· Saxton, and it appears that Mr. Bloom isnrt
prepared here to go forwatd, and also it appears that
Mr. Gregory. is not prepared for a hearing on this matter
either. And the Court has suggested a possible settlemen 1~.
So under those circumstances, the Court will reschedule
this matter to be held in this Courtroom on January
22 at 10:30 ln the morning, that is January 22, 1976.
Meanwhile, the Court would like to put on the record
the suggestion that this matter should be settled, in
light of reasonableness. It seems to me, Mr. Gregory,
perhaps you ought to amend your Petition because the
Petition doesn't include the silverware, which I understand
is a bone of contention.
MR. BLOOM: That is our only claim at this time, Your
Honor.

Our office, through Mr. Bloom and Mr. Gregory, Attorney
for the Estate, have entered into a stipulation which we woulc
like to put on record concerning the silverware. Our office
has the· sum of $150.00 which is for payment of the silver-
ware, which Mr. Gregory informed us is present in his
office. Is that correct,. Mr. Gregory?
MR. GREGORY: Correct.
THE COURT: Mr. Gregory, Mr. Sewak has stated
for the record in a correct manner the terms of this agree-

I, CLYDE w. SAXTON, an adult resident of the Borough
of Burgettstown, Washington County, Pennsylvania, being of sound
and disposing mind and memory, hereby revoke all wills and codicils
as well as all instruments of a testamentary nature heretofore
made by me, and· do hereby make, publish and declare this to be my
Last Will and Testament in manner and form as follows:
FIRST: I direct that all my just debts, funeral bills
and testamentary expenses shall be paid by my
Executor hereinafter.named, as soon as conven-
iently may be following my death.
SECOND: All the rest, residue and remainder of my
estate, real, personal or mixed, of whatever
nature or wheresoever situate which I may own
-or may have the right to dispose of at the
time of my death, I hereby give, devise and
bequeath to my dear friend, Lill·ian Kernohan.
TI-URD: I hereby nominate and appoint Lillian Kernahan
to be the Executrix of this, my Last Will and
Testament. -
