PETITION FOR THE APPOINTMENT OF A GUARDIAN
FOR AN ALLEGED INCOMPETENT
TO THE HONORABLE, THE JUDGE OF SAID 'cou'RT:
The Petition of FRAN~ LEOPOLp, respectfully represents:
1. That the petitioner is the nephew of MARGARET ISABELL SIMPSON
and EDWARDS. SIMPSON, and resides at R.D.#I, Hickory, Washington County, Penn-
sylvania.
2. Margaret Isabell Simpson and Edward S. Simpson, the alleged incom-
petents, being 85 years of age, whose residence is Center Avenue, Burgettstown, Pa.
and are presently confined to Miller•s'Rest Home, R.D.#I, Claysville, Pennsylvania,
a private nursing home.
3. That the following is a list of the next of kin of the alleged incom-
pl'>.tents:
(a) Nellie Leopold, Sister-cind.'sister-ir:~-tci:;,,Suru\y-View:'r.fome, Butler Pa.
(b) Frank Leopold, Nephew, R. D. #1, Hickory, Pa.
(c) Margaret Jean Scull, Niece, Bocktown Road, Glen'¥illard, Pa.
(d) Willa Bane, .Niece, 415 N Main St Butler, Pa.
(e) William Simpson, Nephew, Hastings Avenue, Oakdale, Pa.
(f) James Simpson, Nephew1" Donnan Avenue, Washington, Pa •

4. That the estate of the said Margaret Isabell Simpson and Edward S.
Simpson are as follows:
Savings Account -un.known
Cash -unknown
Real Estate -unknown
Income Consists of:
Old age insurance benefits (Title 2 of the Social Security Act)
in the amount of$ 100.00 ± $70.00 for'a;tofal amount of $170.00
per month for both • '
5. The alleged incompetents, at no time have been members of the
Armed Services of the United States and, therefore, are receiving no benefits from the
United States Veterans Administration or its successor.
6. That the said Margaret Isabell Simpson and Edward S. Simpson, be-
cause of their mental infirmities or senility are unable to manage their property, and/or
are liable to dissipate it, or become the victims of designing persons.
7. It is averred that the proposed Petitioner, Frank Leopold, has no
interest adverse to the alleged incompetents.
8. No other court has ever assumed jurisdiction in any proceeding to
determine the competency of the alleged incompetents.
9. That Margaret Isabell Simpson and EdwardS. Simpson, the alleged
incompetents, have no guardian of their estate.
10. That Margaret Isabell Simpson and Edward S. Simpson, the alleged
incompetents, will not be present in Court at the time fixed for Hearing, and the depositi n
of Doctor .: J~ .K,. McCarrell·,·.' Hickory·;· 1 • " Pennsylvania, will be presented as evidenc
of the mental conditions of Margaret Isabell Simpson and Edward S. Simpson, in lieu of
their personal appearance in Court. Attached hereto and made a part hereof is Dr. McCar ell's
Affidavit.
WHEREFORE, your petitioner, prays your Honorable Court for a citation,
directed to the alleged incompetents, with notice thereof to their next of kin and to such
other persons as the court may direct, to show cause why they should not be adjudged
an incompetent and a guardian of their estate appointed.

TO THE HONORABLE THE JUDGES OF SAID COURT:
The Petitioner, FIRST NATIONAL BANK OF WASHINGTON, PA.,
respectfully represents:
1 • On the 3 rd day of September, 1971, your Honorable Court duly
appointed your Petitioner as Guardian of the Estate of Margaret Isabell Simpson and Edward
S. Simpson, weak and feeble minded persons, as will appear by reference being had to
proceedings at No. 730 of 1971.
2. Your Petitioner is duly qualified by giving Bond as required by Your
Honorable Court.
3. Your Petitioner 1s Wards are the owners in fee simple of a certain parcel
of ground situate in Burgettstown, Washington County, Pennsylvania, more particularly
bounded and described as follows, to-wit: . '
ALL that certain lot of ground situate in Smith Township,
Washington County, Pennsylvania, known as Lot No.2 . .
in Bellview Plan of Lots, laid out by John A. Bell and recorded
in the Recorder •s Office of said County in Plan Book 5, page 72
and 73; said lot is further bounded and described as follows, to-wit:
BEGINNING at a point at the corner of Lot No. 3 and Center .
Avenue; thence South 25° 241 East, 120;0 fee.t:· to a 16 foot alley;
thenc~ by said alley, South 64° 61 West, 40.0 feet to corner of
I ,:t LotNo. 1;thence by Lot No.1, North 25° 54 1 West, 120.0
feet to said Center Avenue; thence by said Center Avenue, North 72°

11' East, 20.98 feet to a point; thence North 64° 61 East,
19.33 feet to the place of beginning.
HAVING erected thereon a 'st~ry and.one-half frame house.
BEING the same lot of ground which was conveyed from Edward
S. Simpson et ux. to EdwardS. Simpson et ux. dated December
21, 1.953 and recorded in the office of the Recorder of Deeds of
Washington County, Pennsylvania, in Deed Book Vol. 884 page 503.
4. Your Petition is advised that their Wards are now eighty-five ( 85 )
years of age, and that it is very doubtful if-they will be able, in the future, to again ' ' ·~,. ..
resume the care and management of their property.

half frame and aluminum cottage design house. The aforesaid dwelling house is in serious

need of extensive repairs which will require substantial sums of money to maintain and heat
the house.
6. The above described lot of ground is not encumbered by any mortgage

7. Your Petitioner is of the opinion that it would be to the best interest of
the Wards if the real estate were sold, and their interest therein converted into cash. The
total assets of the Ward is more fully set forth in the Inventory, a copy of which is hereto
attached and made a part hereof.
8. An offer has been made by JAMES F. WARREN and SHIRLEY I. WARREN,
his wife, of Midway, Pennsylvania, to purchase said real estate for the sum of SEVEN
THOUSAND and no/100 ( $7, 000.00) DOLLARS, payable in ~ash upon delivery of a Deed;
subject, however, to the approval of such sale by Your Honorable Court.
9. Your Petitioner has attached hereto a Certificate from the Office of
the Board for the Assessment and Revision of Taxes, showing the assessed value of the real
estate herein described to be One thousand two hundred thirty five and no/1 00 ( $1, 235. 00)
dollars, as appears from Exhibit 11A 11 hereto attached.
10. Your Petitioner has attached hereto Exhibit" 11B11 being an Affidavit
by a competent person acquainted with the value of the real estate and the particular locatior
where the property hereinabove described is si~uated, setting forth that in his opinion the
price of SEVEN THOUSAND and no/100 ($7,000.00) DOLLARS for said property is a good

price for the same in its present condition and more could not be secured at a public sale
thereof.
11. Your Petitioner believes that the price offered for said real estate
is a fu II and fair price for the same in its present condit~on and a better price than could be
obtained therefor at a public sale.
WHEREFORE, your Petitioner prays your Honoroable Court to authorize . .
them, as Guardian of the Estate of Margaret Isabell Simpson and Edward S. Simpson, alleged
incompetents, to accept the aforesaid offer of JAMES F. WARREN and SHIRLEY I. WARREN,
his wife, to sell and convey the real estate, as hereinabove described and to execute,
acknowledge and deliver a Deed for the same for the price of SEVEN THOUSAND and no/10(
($7,000.00) DOLLARS.

being presented to the Court, upon cons ide ratio of the facts therein set forth, the Court
being of the opinion .that it will be to the interest and advantage of Margaret Isabell
Simpson and EdwardS. Simpson, alleged incompetents, that their interest in the real estate
described in the foregoing Petition be sold; and the Court being of the opinion that under the
circumstances, the price offered therefor is a better price than can be obtained at'public sal ,
and that the sale may be made without prejudice to any trust, charity, or purpose for which
the said real estate is held, and without the violation of a·ny law which may confer an
immunity or exemption from sale or alienation, IT IS ORDERED, ADJUDGED, and DECREED
that the prayer of the Petitioner be granted, and that FIRST N\ TIONAL BANK OF
WASHINGTON, PA., Guardian of the Estate of Margaret Isabell Simpson and EdwardS.
Simpson, alleged incompetents, be and hereby is authorized and empowered to make
a proper Deed conveying the interest of :their wards in the real estate described in the fore-
g?ing Petition at private sale for the sum of SEVEN THOUSAND and no/100 ($7,000.00)

PETIT ION FOR ALLOWANCE
TO THE HONORABLE, THE JUDGE OF SAID COURT:
The Petition of the First National Bank & Trust Company of Washington, Pennsylvania,
guardian of the Esklte of Margaret Isabell Simpson, an incompetent, respectfully states:
I. First National Bank & Trust Company of Washington, Pennsylvania, was
appointed guard ian of the Estate by P. V. Marino, Judge, dated September 3, 1971.
2. The inventory filed May 3, 1972 shows real and personal property with a value
therein stated of $13,725.07.
3. The address of the incompetent is Hillsview Rest Home, Box 473, Claysville,
Pennsylvania.
4. The Incompetent has no dependents.
5. The following Creditors of the incompetent have claims exceeding the income
of the incompetent as set forth in Exhibit 11A ": Hillsview Rest Home for Nursing Services.
6. Prior distributions have been allowed for payment of the incompetent's upkeep
and care, how ever, the incompetent 1s expenses now exceed her income.
WHEREFORE your petitioner prays that it be allowed to invade the principal of the
incompetent's estate for the payment of necessary expenses, under the provisions of Section
5536 of Probate Estates and Fiduciaries Code.
