PETITION FOR SETTLEMENT OF ~STATE OF
$5,000.00 OR LESS UNDER PROVISION OF SECTION 202
. OF THE FIDUCIARY'S ACT OF 1949 a AS AMENDED
TO THE HONORABLE, THE JUDGE OF SAID COURT:
1. That the Decedent, HARRY W. VOGENBERGER, JR.,
resided at Craven's Hill, Carroll Township, Washington County,
Pennsylvania.
2 .• That the Decedent, HARRY W. VOGENBERGER, .JR.,
died on January 2, 1971.
3. That the Decedent died testate lea~ing a Last
Will and Testament in which his entire estate was willed to the
Petitioner, ROWENE C .. VOGENBERGER, wh~ 'is al~o his sur~:lving
spouse. The said Will has not been probated,. and a photo-static
copy of the same is attached hereto and marked as Exhibit "A". ·
4. That the sole assets of the estate consist of
United States Savings Bonds, Series E, the total value of said
bonds being the sum of Two ehousand seven hundred :four and 74/100
($2, 704. 74) Dollars and a check in the amount of E.ight hundred
eighty-eight and no/100 ($888.00) Dollars representing the
Decedent's interest in the Hi-Rise Investment Club, the total
value of said assets being the sum of Three thousand five
hundred ninety-two and 74/100 ($3,592.74) Dollars.

5. That the following constitutes a list of all
known creditors of the Decedent, and the same have been paid
in full by your Petitioner, ROWENE C. VOGENBERGER:

6. That your Petitioner, who is the surviving wife of
the Decedent, claims the amount of One thousand five hundred
and no/100 ($1,500.00) Dollars for family exemption.
7. That all of the above debts and expenses owed by
HARRY W. VOGENBERGER, JR., were paid by the Petitioner, and the
Petitioner requests that she be reimbursed for the same.

WHEREFORE, your Petitioner prays your Honorable Court
to ORDER AND DECREE that she be reimbursed the above expenses
and th~ balance of said estate, namely, the sum One thousand
four hundred seventy-five and 36/100 ($1,475.36) Dollars, be
distributed as family exemption to your Petitioner, ROWENE c.
VOGENBERGER, the surviving spouse of.HARRY W. VOGENBERGER, JR.,
deceased.

LAST WILL AND TESTAMENT
I, HARRY W. VOGENBERGER, JR., of Carroll Township, Hash-
ington County, Pennsylvania, being of sound mind and memory, do
hereby make·, publish and declare this to be my Last Will and
Testament, hereby revoking and making void any and all Wills by
me at any time heretofore made.
FIRST: I direct that all of my just debts and
the expenses of my funeral be paid.
I direct that all inheritance, succession
and estate taxes assessed because of my death, whether the prop-
erty or funds to t'lhich such taxes are· attributable pass under
this my Will or not, be borne by the principal of my residuary
estate and that my Executor pay or provide for the payment of
such taxes at such time or times and in such manner as he deems
to be convenient.
SECOND: All the rest, residue and remainder of my
estate, real, personal or mixed, of whatsoever nature or whereso-
ever situate at the time of my death, I give, devise and bequeath
to my beloved wife, Rm-1ene C. · Vogenberger. Should my said be-
loved wife predecease me, or should we both die as the result of
a common ace ident or at the same time, then, i~1 such event, I
give, devise and bequeath the same in equal shares to Jane Lynn
Vogenberger, Jo Ann Vogenberger, Pamela Dale Hetherington, James
Woodward Hetherington, and Thomas Carson Hetherington.
THIRD: In the event my wife predeceases me, I
hereby nominate and constitute Robert A. Martin and Barbara
Jean Martin as guardians of both the estate and the person of
my then minor children.
FOURT.H: I hereby nominate, constitute and appoint
my beloved wife, Rowene C. Vogenberger, as the Executrix of
' this my Last Will and Testament. Should my said beloved wife
predecease me, or, for any reason whatsoever, be unable to
serve, then, I nominate, constitute and appoint Robert A. Martin
and Barbara Jean Martin co-executors of this my Last Hill and
Testament.
IN WITNESS WHEREOF, I have hereunto set my hand and seal
to this, my Last Will and Testament, consisting of two (2)

VOGENBERGER to convert and/or cash the aforesaid check of
Hi-Rise Investment Club and the United States Savings Bonds,
Series E, to accomplish to aforesaid purposes.
