APPEAL ON REFUSAL OF CLERK OF THE ORPHAN 1S COURT TO GRANT MARRIAGE LICENSE. To the Honorable, the Judge of Said court: NOW comes the petitioners, Vincent A. Tender, Jr. and Bonnie Reed, by their attorney, George R. Sewak, Esquire, and on appeal from the refusal of the Clerk of the Orphan''s Court to . issue a marriage license to them and your petitioners respectfully represent: 1. That this Court has jurisdiction to entertain this appeal under Section 9 of the Marriage Law of August 22, 1953, P. L. 1344, 48 P. s. Section 1 -9. 2. That the petitioner, Vincent A. Tender, Jr. is a minor, born March 6, 1951, and is presently 20 years of age. Vincent A. Tender, Jr. has received the consent of the intended marriage to the said petitioner, Bonnie Reed, which consent has been given by his mother, Helen J. Tender on the application for the marriage license. 3. That the petitioner, Bonnie Reed, is a minor, born February 8, 1955, and is presently 16 years of age and has not been able to obtain the written consent of either of her parents, Arthur Reed, her father, or Margaret Reed, her mother. 4. That the petitioners made an application for a marriage license with the Clerk of the Orphan's Court on July 1, 1971, and the said application ·was refused on July 1, 1971 by the Clerk of the Orphan ''s Court, from which refusal this appeal is taken. 5. The said petitioners have attempted to obtain the consent of either or both of the parents of the said Bonnie Reed without success. WHEREFORE, the petitioners request this Honorable court to direct the Clerk of the Orphan 1s Court to appoint a guardian Pro Hac Vice, in order that he may give his consent to the issu- ance of the marriage license.
