The petition of Richard E. Shonts, respectfully represents.
1. That your petitioner was named as executor by the Last
Wil.l and Testament of. the decedent,.Wilhelmin Shonts, which was
probated on June 28, 1971 and is to found of record in the Office of
the Register of Wills in Will . Book 112, page ..:2.-1 '/ • AC?opy o.f the
said.will. is attached hereto.
2. That· the will.of the decedent left to a grandson who joirs
in this.petition, Leroy Mark Nicholson, certain real estate located
in the Borough of California, washington County, Pennsylvania, and
the remainder to the seven surv~ving children of the decedent.
3.: That the only assett in the estate of the decedent is the
said real estate which has a value of $1,400.00 and is subject to
a lien in favor the Department of Public Welfare .•
3. That one of the children of the decedent did reside with
and make her home with the decedent in the real estate and is
entitled to the Family exemption.
4. That the daughter who resided with the decedent was is
Mildred Bennett and her address is R. D. # 1, Coal Center, Pa.
5. That there are attached hereto and incorporated by
referece herein the following:
a. copy of the deed to the property
b. appraisement of the property filed in the estate of the
decedent's husband, Oliver Shonts.

6. That the said Mildred Bennett has agreed to take the said
real estate as her family exemption and to,. in due course, satisfy
the lien in favor of the Pennsylvania Department of Revenue.
7. That the real estate is the only assett in. the estate of.
the decedent and the heir to the real estate joins in the prayer
o.f this petition and agrees that the real estate shall be set asid
to Mildred Bennett as her family exemption under Section 211 of
the Fiduciaries act of 1949 as amended.
8.. That the said real estate is of a value of less than that
allowed for fami.ly exemption in the case o.f a decedent who died
on June 9; 1971.
waEREFORE, petitioner praysyour Honorable Court set aside
the said real estate to Mildred Bennett as her family exemption~
and he will ever pray, etc.

AND NOW, this Rf -day of March, 1972, upon presentation
of the attached petition by the executor, joined in by the
devisee of the real estate, and upon motion of Morley M. Azorsky,
Esq., Attorney for the petitioners, it is ORDERED, ADJUDGED and
DECREED that the following described real estate is set aside as
the family exemption of Mildred Bennett, the daughter of the
decedent who made her home with the decedent prior to and at the
time of the decedent's death: the real estate is described as fol

ITEM I.. I direct the payment ~ut of ~y estate of the dehfs and ..
expenses of my last illness and funeral.
ITEM II. I give and devise the home property consisting of approximately
. one acre and situate in or near the Smallwood are'a of the Borough o,f California,
Washington County. Pennsylvania, to Leroy Mark Nicholson, his heirs and
assigns forever.
ITEM III. I give. devise and bequeath all the rest. residue and remainder
of my property, real and personal, wheresoever situate, in equal shares to
those of my children who survive me.
ITEM IV. I nominate and appoint Richard E. Shonts, Executor, of this
my Last Will and Testament.
