TO FIX BOND IN RE SALE OF REAL ESTATE UNDER THE
PROVISIONS OF SECTION '541 OF THE FIDUCIARIES ACT OF 1949.
TO THE HONORABLE p.V.MARINO,PRESIDENT JUDGE OF SAID COURT:
The Petition of Harry Amos respectfully represents:
intestate on'Decembe~18th,1970,and Letters of Administration
North Franklin Township,Washington County,Pennsylvania,died
1.That Thelma M.Davis,alkla,Thelma M.Amos',late of r

on her estate were granted to your Petitioner on June 21,1971,
and Surety Bond filed in the amount of $1,000.00.
2.That ~aid decedent died seised of personalty valued
at $100.00,and the following described real estate,valued at
$1500.00,to-wit:
ALL that certain lot of ground situate in the 8th
Ward of the City of Washington,Washington County,Penna.,bounded
and described as follows:
Fronting thirty (30)feet on the Southside of Ewing
Street and extending back therefrom of even width 150 feet to
Ross Alley and known and designated as Lot No.11,Block P in the
Plan of Lots laid out by James S.Stocking et al.,and called
"West End",Washington,Pa.

For source of title into Thelma M.Amos,later
Thelma M.Davis,see deed dated January 28,1949,and recorded
in Deed Book 749,page 478,Washington County,Penna.,records.
3.That the Estate of deceased is clearly SOlvent,there
being another piece of real estate val~ed at $4,000.00,in North
Franklin Township,Washington County,Pennsylvania.
4.That on or about February 17,1972,Harold E.Maloy
and Nancy M.Maloy,by written Agreement,agreed to purchase
subject real estate with the old house thereon for Fifteen Hundred
($1500.00)dollars,and your Petitioner agreed to sell same,sub-
ject to approval of your Honorable Court~That $200.00 was paid
down by said purchasers,who also agreed to pay for the transfer
stamps on said deed of conveyance.
5.That attached hereto and made a part hereof is the

affidavit of two responsible persons fami1iar with the value of
real estate in the vicini~y of the real estate proposed to be sold,
giving the fair value of the real estate herein described.
6.That your Petitioner has received no other offers for'
said real estate,has had it in a real estate agents.hands for sil'
months,and all the heirs at law wish this real estate to be sold I
for $1500.00.Said real estate is assessed.a~$470.00 for 1970
County Tax purposes.That said house cannot be lived in without
substantial repairs being made.That your Petitioner has paid the
funeral bill of Thelma M.Davis in the amount of $1500.00,out of
per~onal funds,but a hospital bill of $757.20 is still unpaid.
7.That your Petitioner desires to co~plete the proposed
sale and deliver a proper deed to the purchaser named in the sale.
WHEREFORE,your Petitioner prays your Honorable Court to make
an Order relative to Additional"Bon~~n '~his matter,if any,(youJ
Petitioner being already under Surety Bond in the amount'of One
Thousand ($1,000.00)dollars,in'accordance wit~the·act of

PETITION FOR HEARING TO DETERMINE HEIRS IN ESTATE
The Petition of Harry Amos,Administrator of Estate of
Thelma M.Davis,respectfully represents:
(1)That Thelma M.Davis,a/kia,Thelma M.Amos,died
'---~
intestate on December 18,1970,and Letters of Administration on
her estate were granted June 21,1971,by the Register of Wills
Washington County,Pennsylvania,to Harry Amos,brother of the
deceased.
(2)That the Estate of the deceased consisted of two
pieces of real estate valued at $5500.00,and personalt~valued
$100.00.See Inventory attached hereto and marked Exhibit "A".
(3)That deceased left no issue,but one brother,Harry
Amos,and a husband,Wilbur "Webb"Davis,whom she married on
June 23rd ,19~,and was never divorced.
(4)That it is known that Wilbur.Davis is still 1~.J.vJ.ng
but his whereabouts is unknown to your Petitioner except that he
was last known to be in the Uniontown,Pennsylvania area.
(5)That the Administrator of the Thelma M.Davis Estate
has already paid over $2700.00,on bills of deceased,not includin
costs of administration or inheritance taxes,about half of this
amount out of personal funds.
(6)That on or about June 21,1955,';wilbur;Davis went
to work from his and his wife's homeanq never came back.
(7)That Thelma M.Davis was Igranted an Order of Support
against her husband by the Washington County Pa.Court on August 9,
1955,in a Desertion and Non-Support Proceeding,of record at
No.193 August 1955,Q.S.That the records show no support has
been paid since February 18,1965.The first Order called for
$120.00 per month support,to which Defendant agreed in writing.
This Order was reduced to $50.00 per month on May 12,196_1___
(8)That for·several years prior to her death,Thelma M.
Davis worked and supported ~erself,living by herself,or with her

unmarried brother,Harry Amos,in Nokomis Park,Washington,Pa.
in 1964,
(9)That after the death of her mother,Emily J.Amos,
J.'1helmaM.Davis lived with her brother,Harry Amos,at~752 and
75 Nokomis Park,Washington,Pa.,and supported herself from money
received from a trust set up by her mother,and what financial
assistance her brother gave her.She received no support from her
husband from the date of Febr.uary·~8,1965-,.to")the date of her own
death,nor did she live with her husband during this period of
time.
WHEREFORE,showing as aforesaid,your Petitioner requests
your Honorable Court,under the Penna.Intestate Act (20 P.S.ch.l
.sec...1:••6')to find that Wilbur"Davis refused to provide for his
wife for more thari five years prior t6 her death,did not live
with her for more than 15 years prior to her death and has for-~
feited his intestate rights to share in her estate.He further
requests your Honorable Court to set a date for a Hearing on this
matter and decree the type of notice of said Hearing to be given
Wilbur:Davis.
