MARINO, PRESIDENT JUDGE OF SAID DIVISION: The Petition o£ Howard F. Carson respectfully represents: 1. That petitioner was the Attorney £or the alleged incompetent in her fiduciary capacity as Administratrix o£ the Estate o£ J. Raymond McRoberts, deceased; that he is also the Attorney £or the alleged incompetent in her individual capacity; that he is a member o£ the Bar o£ this Court; and that he re- sides at 405 Lookout Avenue, Charleroi, Washington County, Pennsylvania. 2. That as an o££icer o£ this Court your petitioner believes it to be his duty and obligation to bring the matters hereinafter set forth to the attention o£ the Court. 3. That the said Grace Louise McRoberts is 43 years o£ agve having been born February 11, 1928, and she is presently an inmate at the Mayview State Hospital, Allegheny County, Pennsylvania, having been confined there on April 11, 1971, as the result o£ an emergency action by the Mental Health Authorities o£ Wasnington County, Pennsylvania. 4. That the said Grace Louise McRoberts was formally Committed on April 29, 1971, £or inpatient care at said Mayview State Hospital, £or an indefinite period, by Richard DiSalle, a Judge o£ this Court. Said committment proceeding was had pursuant to the provisions o£ Section 406 o£ the Mental Health and Mental Retardation Act o£ 1966. 5. That the said Grace Louise McRoberts, because o£ her mental disablities which are characterized by bizarre behav- iors, paranoid idiations and delusions, all o£ which is sub- stantiated by the Affidavit o£ her physician, which is attached hereto, made a part hereof, and marked Exhibit "A", is unable to manage her property, and is liable to dissipate it or become a victim o£ designing persons. 6. That the estate o£ said Grace Louise McRoberts, so £ar as your petitioner knows, is as follows: a. Savings Account #209-30-9875.01 in the Washington O££ice o£ Mellon National Bank and Trust Company, entitled Raymond McRoberts or Grace Louise McRoberts, said account having a present balance o£ $4177.01 plus accrued interest £rom May 19,1971. b. Savings Account #179-30-1282.01, in the Charleroi O££ice o£ Mellon National Bank and Trust Company,~ntitled Grace Louise McRoberts, having a balance o£ $ 52.51 plus accrued interest £rom May 19, 1971. c. Savings Account #22193 in the First Fed- eral Savings & Loan Association o£ Washington, Pa.,entitled Grace Louise McRoberts, having a balance o£ $8869.37 plus accrued interest £rom May 19, 1971 -2- d. Savings Account #83-2076949 _in the Washington O££ice o£ Pittsburgh National Bank, entitled Raymond McRoberts or Miss Grace Louise McRoberts, having a present balance o£ $7221.16 plus accrued interest £rom May 14,1971. e. Savings Account #01-0023368, in the Charleroi O££ice o£ the Pittsburgh National Bank, entitled Raymond McRoberts or Grace Louise McRoberts, having a present balance o£ $8049.51 plus accrued interest £rom May 14, 1971. £. The alleged incompetent has other items of personal belongings, household furniture, etc., but the extent and value o£ her said personalty is unknown to petitioner. 27.82 $1600.00 70.00 Total known personalyy $30,067.38 7. That the proposed guardian is Pittsburgh National Bank; said proposed guardian is not related to the alleged incompetent and has no financial interest in nor any claim against the Estate o£ the alleged incompetent. The willingness of the proposed guardian to accept the appointment is indicated by the attached Acceptance by Corporate Guardian. -3- 8. No other Court has ever assumed jurisdiction in any proceeding to determine the competency o£ the said Grace Louise McRoberts, and the alleged incompetent has no guardian o£ her estate or person. WHEREFORE, your petitioner respectfully prays your Hon- orable Court to adjudicate and find that Grace Louise McRoberts is an incompetent, and to appoint the Pittsburgh National Bank, as Guardian o£ her Estate. PARSONS, a legally licensed physician in the Commonwealth of Pennsylvania, who, being duly sworn according to law, deposes and says that he is well acquainted with Grace Louise McRoberts; that he is familiar i I with her history after consulting with her cousin, Thelma Myers, J I and her friend and former landlandy, Dorothy Sutch, having learned thereby of her bizarre behavior, such as having lived in her automobile for several weeks prior to her confinement ' i I I I and of her constantly complaining of neighbors spying on her and! attempting to steal her money; that based upon this history and his examination of her, he finds a paranoid ideation of being persecuted by relatives and neighbors with insight and judgment generally impaired, that her contact with reality is dependent on paranoid thinking, and that she is extremely evasive and guarded; that his diagnosis is that Grace Louise McRoberts 1s mentally ill, th~t she is not physically or mentally able to ' I I come to Court to attend any incompetency hearing, that she might1 I suffer a relapse in her rehabilitation prossess, that she would I -- not comprehend such proceeding, and that no benefits or improve- ments in her condition will be forthcoming in the near future. SIMMONS, PRESIDING JUDGE OF SAID DIVISION: The petition of Pittsburgh National Bank, Guardian of the Estate of Grace Louise McRoberts, an incompetent, respectfully states: 1. Your petitioner was appointed Guardian of the Estate of Grace Louise McRoberts, an incompetent, by Decree of this Court, dated July 12, 1971. 2. As of the preparation of this petition your petitioner has these funds of the incompetent in its guardian's account: Cash $ 909.87 Investments (carrying value) $32,430.13 Invested Income $ 1,293.87 3. The ·incompetent was formerly an inmate at Mayview State Hospital, but on April 1, 1976 began a thirty day trial home visit! I in a boarding home operated by Mrs. Frances Bercosky, located at Marianna, Pennsylvania. 4. The trial visit was successful and on April 30, 1976, the incompetent was discharged by Mayview State Hospital and she was placed under the supervision of the Washington County Mental Health Program through the Centerville ~linic. 5. The Department of Public Welfare arranged for Mrs. Bercosky to charge $250.00 per month for the incompetent's care, beginning on June 1, 1976. 6. Your petitioner believes that it will be necessary for the incompetent to remain at the Bercosky home for sometime, therefore your petitioner requests authorization to pay the sum of $250.00 on a monthly basis for future maintenance costs withouti I being required to secure such authorization on a monthly basis. 7. The incompetent has requested the allowance of $10.00 per month for her personal needs, and her Caseworker at Mayview recommended that the request be granted. Such small allowance has the dual purpose of therapy for the incompetent and as a testing device to determine her ability to begin managing her own affairs. In light of the foregoing your petitioner believes that it is advisable to secure authorization to pay said $10.00 on a monthly basis beginning effective on June 1, 1976. WHEREFORE, your petitioner prays this Court for authorization: (a) to pay Frances Bercosky the sum of $250.00 per month for the care and maintenance of the incompetent beginning on! June 1, 1976, with such authorization to remain in effect until further order of Court; (b) to pay Grace Louise McRoberts, the incompetent, the sum of $10.00 per month for her personal needs beginning on June 1, 1976, with such authorization to remain in effect ~ntil further order of Court; and (c) to pay reasonable coun~el fees the preparation and presentation of this petition, for the payment or reimbursement of the costs of this petition, all as authorized by the provisions of Section 5536 of the Probate, Estates and Fiduciaries Code. Your petitioner was appointed Guardian of the Estate of Grace Louise McRoberts, an incompetent, by Decree of this Court, dated July 12, 1971. 2. A Guardian's Inventory and Statement was filed on January 5, 1972, showing a Savings Account, and two Checking Accounts with the Pittsburgh National Bank, Charleroi Office; a Savings.Account with the Pittsburgh National Bank, Washington Office; two Savings Accounts with the Mellon National Bank & Trust Company; a Savings Account with the First Federal Savings & Loan Association (Washington, Pa.); five-$25.00 U.s. Savings Bonds, Series "E"; jewelry and cash. The total of the items was $32,529.17. 3 •. The incompetent is presently an inmate at Mayview State Hospital, situate at Bridgeville, Allegheny County, Pennsylvania. 4. The incompetent has no dependents. 5. The following creditor of the incompetent has the claim indicated below: I Mayview State Hospital -$ 3629.22 (From April 11, 1971 to November 30, 1971; see copy of attached Statement.) 6. After investigating the mental condition of the incompe- tent, your petitioner believes that it will be necessary for her to remain at the Mayview State Hospital for sometime; therefore, your petitioner requests authorization to pay the sum of $100.00 per month as partial payment of future maintenance costs; and in addition thereto, your petitioner requests authorization to pay the sum of $200.00 per year for personal needs and routine pur- chases of clothing for this incompetent. As Your Honor may recall, due to the various circumstances, I have been acting as a petitioner as well as the attorney involved; and certain of the statements that I would be making would almost be in the nature of evidence. Now whether ther~ is any need for my being sworn, naturally that's up to the Court's discretion, whichever procedure Your Honor wishes to follow. This is 573 of 1971. THE COURT: .. And as the Affidavit bears out, upon being advised of the nature of the petition and the Citation and the purposes thereof, Mr. Carson again confirmed in May as he had done previously that being a resident of Illinois, he 2 preferred not to be involved in the affiars of his niece, Grace Louise ,_ _,, McRoberts, in any way. I also have an Affidavit under the same cover by Victor Delso, Jr., Constable of the Third Ward of the City of Monongahela, whereby he served the Citation and Petition upon Miss McRoberts at her place of confinement at the Mayview State Hospital in Allggheny County. And it's probably in the nature of hearsay. but she told me that just as Mr. Delso had, that she was present along with, I believe it was Dr. Parsons of the institution, when the papers were served upon Miss McRoberts, and Mr. Delso and Mrs. Klinger both told me that it was obvious that Miss McRoberts did not understand the proceeding. When I say that, it's a matter of she is not capable of understanding the proceeding. she was of the impression that she was suing me. That was the impression she got from the papers which, of course, is completely erroneous. ..: THE COURT: 0 What\is. VictorlDe)so. Junior's capacity? i: ... ~ A Constable in the Third Ward of Monongahela. Well, we have his Affidavit of Service here that he personally served the alleged incompetent. Sothat we will receive that in evidence vi ~ and make it part of the record, together with the Affidavit of Service ... II: 0 .. ~ made by counsel, Howard F. Carson. as far as the living relatives ... g of Miss McRoberts are concerned. Now Mr. Carson. will you give 0 .J < ij ii: ... 0 us some of the jurisdictional facts in this matter? MR. CARSON: Yes, Your Honor. Miss McRoberts has resided in West Pike Run Township in Washington County all of her life. I personally have known her all ofher life, I might add. And upon the death of her father, J. Raymond McRoberts, approximately two yea1 s ago. she, if she wasn't already going downhill mentally, the shock of it certainly contributed to that factor. And I brought her to your chambers and when I faced her with the letter she then said tl'rey were forgeries. And that she also told Your Honr r at that time she was quite satisfied with the manner in which I was handling the estate. At that time :;;I') had suggested that perhaps a guardian should be appointed for her. And at Your Honor's t~;uggestion I arranged an examination to be made of her by Dr. Bl<fsiolej of Monongahela. However, when we got to the doctor's office, he insisted upon her being hospitalized before he would examine her . She in turn refused to go to the hospital. So nothing further was dore at that time. For the record, it might be pointed out that the doctor's cuation was probably merited because Miss McRoberts is at least six foot two and probably weighs somewhere in the neighborhood of 360 pounds, and if she had become violent it would have require< several persons to restrain her. THE COURT: What is her age, Mr. Carson? MR. CARSON: She was born February 11, 1928, which would make her 43 at this time. She is presently confined as an inmate at Mayview, as I mentioned, having been taken there on April 11, 1971; approximately the first of March she left the home of Josepl Sutch, in West Pike Run Township where she had been living as a I • <t z ~ ..I ).. And for apprm i- mately five or six weeks she traveled around over Washington Cour y, doing such things as examining the merits of various police depart- ments and then reporting back to the police department in Charlero concerning the merits of the other cities police departments. Obviously she had no official capacity and the reason I know of the~ e matters, she sent these reports into Chief Thomas of the Charlero· Department. It was some time before they were able to locate her and talk her into leaving her automobile and going to the police station in Charleroi. And on the evening of April 11, I believe the day before Easter, this was finally accomplished and Sheriff Debreczer i was appropriately notified and he and two of his deputies then took 5 her into custody and took her to Mayview on an emergency confinement. And at that time the Judge formally committed her to Mayview. THE COURT: On what date? MR. CARSON: April 29, 1971. THE COURT: And has she been at Mayview continuously since that t'me? MR. CARSON: Yes, sir. She has been. Last Wednesday I talked <to Mrs. Klinger by telephone relative to rr.y coming down to visit with Grace because I wanted to visit with her before I appeared here this morning. And Mrs. Klinger recommended against it. She said that she is not making much progress. They were afraid what prog ess;, she's making ,to be told of the hearing might cause her to have a relapse and they felt it was not to her best interests to have this happen. Along that line, Your Honor, the Affidavit of Dr. Par ons, Dr. F. A. Parsons. is attached where he diagnoses Miss McRoberts as being mentally ill and states 'that she is not physically or mental y able to come to Court to attend any incompetency hearing, and he states in the same Affidavit she might suffer a relapse in her rehabilitation process. And that she would not comprehend such a proceeding. Of course, that was borne out by what Mrs. Klinger had told me on the phone that I recited earlier today. THE COURT: Mr. Carson. what general!y are the assets of the est te of Grace? MR. CARSON: Generally the assets of Miss McRoberts consist of 1 ' le 7 savings accounts as listed in paragraph six of the Petition in the Washington Office of the Mellon National Bank and the Charleroi Of ice of Melbn Bank. And the First Federal Savings and Loan Associatio ~ of Washington, and the Washington Office of Pittsburgh National I@a ~1~. And the Charleroi Office of Pittsburgh National Bank. I might add when she was traveling around for some five or six weEks she wrote checks on this particular account, and asked the bank to honor them. And the reason she did that, she, at my suggestion, ll~d opened a personal checking account, but when the checks were rec1 ived in the mail frow Pittsburgh National Bank, it had been damaged in transit and she refused to accept them for fear someone would forge her name. THE COURT: Well, the funds in the Administratrix account would actually be her monies because she is the sole heir, is she not? MR. CARSON: Yes, sir. And as you know, it's down to $27.82. I doubt if they have much value;from time to time she would give me certain of them, usually consisted of a picture of herself taken some 30 years, well, at least 25 years ago. It's typical of the item~ that are in that garage. 8 THE COlli T: Has she ever been the subject of any incompetency ..1 o( u ii: ... 0 proceeding heretofore? MR. CARSON: Only in this one respect, Your Honor. She filed a voluntary Petition for Guardianship previously before this Court. But nothing was done other than to file the Petition because, as I mentioned earlier, she refused to have the physica.:lrexamination that the Court has suggested. THE COURT: So that there was never any actual adjudication. 8 1 9 MR. CARSON: No, sir. THE COURT: And has she ever been a member of the Armed Force~ of the United States ? MR. CARSON: No, sir. THE COURT: Now with respect to your Affidavit of the physician, F. A. Parsons, is he connected in any way with the Mayview Hos pi al? ~ z ~ MR. CARSON: Yes, sir. I might add, Your Honor, that Mrs. Sutch and a distant cous'in of Mrs. Myers have visited with Miss McRoberts ~ few times at Mayview, and they report to me that they can see no change in Grace the way she was before she had been committed. That's a layman's opinion, but at least they don't notice any changE at all. THE COURT: We will receive the Affidavit of Dr. F. A. Parsons ir evidence and make same part of the record.
