PETITION OF PERSONAL REPRESENTATIVE FOR ORDER FOR APPROVAL
OF SALE OF REAL ESTATE TO PERSONAL REPRESENTATIVE UNDER
PROVISIONS OF SECTION 546 OF THE FIDUCIARIES ACT OF 1949
AND FOR FIXING AMOUNT OF ADDITIONAL BOND UNDER SECTION 541
TO THE HONORABLE, THE PRESIDENT JUDGE OF SAID COURT:-
The petition of CHARLES FLEET respectfully represents:
•'
1. That Fannie Waddy, a/k/a Fannie L. Waddy, a/k/a Fanny L. Wadd ,
died, intestate, May 16, 1971, a resident of the City of Washington, Washington
County, Pennsylvania.
2. That your petitioner, Charles Fleet, was named as Administrator,

duly qualified, and Letters of Administration were duly issued on June 1, 1971.
3. That an Inventory and Appraisement in said decedent's estate as
not yet been filed, but the assets consist of a checking account in the Mellon
Bank, Washington Office, in the amount of $2,095.00, and property which is the
subject of this petition v.alued at $23,500.00. This was assessed by the County'
Assessor at a total value of $3,210.00, Certificates of Assessment being attached
hereto and marked Exhibit A.
4. To be included in the inventory, inter alia, is the real estate
described in the Article of Agreement attached hereto and marked Exhibit B.
5. That the names of all parties in interest at the time of the
death of Fannie L. Waddy was Kenneth E. Ware, a brother of the deceased, who,
at the time of her death, was sui juris.
6. Kenneth E. Ware, decedent•s brother and sole heir, died, testate,
~mrch 16, 1972, a resident of Staunton, Virginia, and Letters Testamentary were'

issued to Robert P. Caul, Executor of the Will, and issuance of letters being
attached hereto and marked Exhibit c.
7. That Charles Fleet, your petitioner, desires to purchase the real
estate described in Exhibit B and to pay the sum of $23,500.00. Prior to
Kenneth E. Ware's death he had consented and agreed to the sale and a copy of
that agreement is attached hereto and marked Exhibit B.
8. That Robert P. Caul as Executor of the Estate of Kenneth E. Ware
consents to the sale of the terms and conditions listed in the Article of
Agreement, the consent being attached hereto as Exhibit D.
9. That also attached hereto are Affidavits of Value of the premises
set forth in Paragraph 4 hereof, made by two dis-interested persons, marked
Exhibits E and F.
10. That with the down payment from the purchase of the real estate,
the amount in the checking account and income from the real estate, adequate
money will be available for payment of debts and expenses.
11. That this sale will be accounted for in the First and Final Account
to be filed in the within estate.
12. At the time of the issuance of letters, the Administrator filed a
Bond in the amount of $5,000.00, the same having been renewed June 1, 1972.
WHEREFORE, your petitioner, showing as aforesaid, prays your Honorable
Court to approve the proposed sale of said real estate to Charles Fleet upon
payment to himself as Administrator of the Estate of Fannie Waddy, a/k/a Fannie
L. Waddy, a/k/a Fanny L. Waddy, Deceased, of the sum of $2,500.00 down payment,
and to direct the clerk of the court, Russell Marino, to execute and deliver to
the petitioner a deed conveying the real estate to him subject to the terms and
conditions set forth in the Agreement attached hereto as Exhibit B; and also
requests the Court to issue an Order excusing the posting of additional bond
or requiring the posting of additional bond in accord with Fiduciaries Act of
1949.

Between CP..ARLES FLEET, Administrator of the Estate of Fannie L. Waddy, deceased,------

CHARLES FLEET, of the City of Washington, Washington County, Pennsylvania--------------
--------------------------------------------------------------(hereinafter called "Buyer").
\VITNESSETH, that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agTee as follows:
l. Seller agrees to sell and convey to buyer on or before January 3, 1973
by special warranty deed in fee simple absolute, clear of all mortgages, judgment liens
a;1cl tax liens and other encumbrances affecting its marketability (except as hereinafter set forth) all the real property
described in Paragraph 8 hereof.
2. Buyer agrees to purchase said real property and to pay Seller therefor the sum of TWENTY-THREE
THOUSAND FIVE HUNDRED--------------.,-($ 23,500.00 ) Dollars as follows: Five Hundred ($500.00)
Dollars·upon the execution of this Agreement, the receipt whereof is hereby acknowledged
and upon final approval of the sale by the Orphans' Court Division of the Court of Co~~on
Pleas of Washington, Pennsylvania, an additional sum of $2,.000.00, making a total of
$2,500.00o The balance ·iS to be assumed under terms of a mortgage and bond to the Estat€
of Kenneth E. Ware, or its duly authorized representative.

4. Buyer and Seller shall each pay one-half of all state and local realty transfer taxes payable upon this
transaction, but real estate taxes, sewer charges, and rents and royalties shall be prorated on a calendar year basis
between Seller and Buyer as of date of delivery of possession of the premises, except as hereinafter set forth:
5. From and after the elate of this agreement, insurance shall be provided and paid for as follows:
Seller shall endorse the policy or insurance presently on the premises so that the interest
of the buyer will be protected. If the buyer wants additional insurance, he shall pay for
the same.
6. Time is of the essence of this Agreement.
7. The parties further agree as follows:
The terms of the mortgage and bond referred to above in paragraph 2 shall be as follows:
The balance due of $21,000.00 shall be payable at the rate of $200.00, or more, per month,
with interest at six-one/half percent (6~%) per annum on the declining monthly balance.
Payment of the entire amount shall be made at the end of a five-year period from the date
of the first payment.

8. The real property which is the subject of this Agreement is described as follows:
LOT NO. 100
ALL that certain lot of ground situate in the 6th Ward of the City of
Washington, Washington County, Pennsylvania, being 1ot numbered one hundred
(100) in the plan of lots called "Linn's Extension" to the City of Washington;
fronting forty (40) feet on the Sotith side of Murtland Avenue and extending bacl
therefrom of equal: width in·a southerly direction for a distance of 220 feet,
more or -ldss, to the northerly ~ine of lot Number 97" in said plan.
BEING the same property conveyed to Robert C. Waddy and Fannie L. Wadd
his wife, by deed of Grace Salamon (Salamone), dated January 25, 1934, and
recorded in the Recorder's Office of Washington County, P~nnsylvania, in
Deed Book 593, page 529. The said Robert C. Waddy died
leaving the entire right, title and interest vested in F~a~n~n~i~e~L~.-,mva~d~d~y~a~s----
surviving tenant by the entireties. Said Fannie L. Waddy died May 16, 1971,
intestate, and Letters of Administration were issued to Charles Fleet by the
Register of Wills of Washington County, Pennsylvania, on June 1, 1971.

ALL that certain lot of ground situate in the Sixth Ward of the City
of Washington, Washington County, Pennsylvania, being part of Lot No. 99,
Linn's Extension, which plan is recorded in Plan Book 1, page 41, and being

9. If Buyer defaults in payment or performance for days, Seller may, at Seller's election,
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a) rescind this agreement and retain all sums paid on account hereof as liquidated damages, in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agree.ment for cancellation;
(b) eject Buyer from said real estate, for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment again'st Buyer in an amicable action of ejectment,

Dear Frank:
A review of the estate papers indicates that the real estate
of decedent was sold to the fiduciary and apparently only a small part
of the purchase prlce was pa\d tn cash and the balance was to be
secured by a mortgaqe and bond. Please furnish a copy of the mor~gaqe
and bond and give the recordlnq data. It would appear that the above
estate holds the mortgage and bond as an asset to be distributed to
Kenneth E. Ware. As Mr. Ware died in Vtrqlnta and the audit petition
indicates that Robert P. Caulls the only devisee in the Ware Estate,
I shall appreciate it U you ""ould furnish a certified copy of the Ware
Wtllln order to show a cbaln of title to Robert P. Caul.
As decedent died ln 1Q71, lt wUl not be possible to allow
the 19'72 red estate taxes as deductions for Pennsylvania Inheritance
Tax purposes. Normally, taxes and other expenses of malntalning
real estate must be deducted from the rental income and cannot be
claimed as deductions for inheritance tax purposes.
Your request for dlstrlbution is quite unusual but U the above
