Russell Marino , Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington, in the Commonwealth of Pennsylvania,
the last Will and Testament of Blanche E. Boyce, aka Blanche Boyce, aka Mrs. Blanche
E. Boyce
late of Borough of Canonsburg in the County aforesaid, deceased,
(a true copy whereof is to these presents annexed), was duly admitted to probate; and
Loeita Adams
the Execu~~n said Will and Testament named, having appeared before me and taken and subscribed
the oath of office pr,escribed by law;
r NOW, THEREFORE, I, Russell Marino , Register as aforesaid, do
grant these LETTERS TESTAMENTARY, unto the said
Loeita Adams
committing unto her the administration of all and singular the goods and
chattels, rights and credits, which were of said deceased, and requiring her
to exhibit a 'true and perfect inventory thereof into the Register's Office, at Washington, within ninety
days from the date hereof, and to render a just and true account of said administration at the expiration
of six months from the date hereof, and to regard and comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.

PETITION TO EXCUSE ADDITIONAL SECURITY
TO THE HONORABLE, THE JUDGE OF SAID DIVISION:
The Petition of Bonnie B. Ross respectfully represents:
1. Blanche E. Boyce, a/k/a Blanche Boyce, a/k/a Mrs.
Blanche E. Boyce, died testate on May 14, 1971, a resident of the
Borough of Canonsburg, Washington County, Pennsylvania.
2. The Last Will and Testament of said decedent was
probated in the Office of the Register of Wills of Washington County,
Pennsylvania, on June 1, 1971, and remains on file in said office
in Will Book 112, page 143.
3. Letters Testamentary in the Estate of said decedent
were granted on June 1, 1971, unto Loeita Adams, the Executrix named
in the Will of said decedent, by Russell Marino, Register of Wills
of said County.
4. The said Loeita Adams, Executrix, died on July 14,
1972, while in the course of administering the Estate of said
decedent; and Letters of Administration D.B.N.C.T.A. in the said
Estate were granted unto your petitioner, Bonnie B. Ross, by the
said Register of Wills on July 21, 1972.
5. The said Bonnie B. Ross, Administratrix D.B.N.C.T.A.,
as principal, and the United States Fidelity and Guaranty Co.,
as surety, filed their bond in the amount of Six Thousand----and--
no/lOOths ($6,000.00) Dollars.
6. The said Blanche E. Boyce, a/k/a Blanche Boyce, a/k/a
Mrs. Blanche E. Boyce, died seized of the following described real
estate:
ALL that certain lot of ground together with the
buildings and improvements erected thereon, situate on
the west side of Jefferson Avenue in the Second Ward of
the Borough of Canonsburg, Washington County, Pennsylvania,
which said lot is bounded on the North by lot now or
formerly of Henry A. Sheaff, et ux., on the East by
Jefferson Avenue, on the South by lot now or formerly of
M. L. Armstrong, and on the West by lot now or formerly
of E. H. Beazell, et al. Having erected thereon a dwelling
house known as No. 239 North Jefferson Avenue, Canonsburg,
Pa.
BEING the same lot of ground, title to which vested
in Joyn Boyce, Jr. by virtue of the following two deeds
of conveyance, from Robert F. Boyce et ux., viz: Deed
dated February 11, 1920, and recorded in the Recorder's
Office of said Washington County in Deed Book Vol. 474,
page 569, conveying an undivided one-half interest therein;
and deed dated May 12, 1923J and recorded in said Recorder's
Office in Deed Book Vol. 50b, page 576, conveying the
remaining undivided one-half interest in said lot. The
said John Boyce, Jr., a/k/a J. W. Boyce, a/k/a John W. Boyce,
Jr. died seized of said premises on November 11, 1948,
testate, and by his Last Will and Testament duly probated
and on file in the Office of the Register of Wills of
said County in Will Book 89, page 563, devised all of his
real and personal property unto his wife, Blanche E. Boyce.
THE said Blanche E. Boyce, a/k/a Blanche Boyce, a/k/a
Mrs. Blanche E. Boyce, died seized of said premises on May
14 1971, testate, and by her Last Will and Testament
duiy probated and on file in the Office of the Register of
Wills of said County in Will Book 112, page 143, named
Loeita Adams as Executrix, to whom Letters Testamentary
were granted on June 1, 1971. The said Loeita Adams,
Executrix, died on July 14, 1972, while in the course of
administering the Estate of the said Blanche E. Boyce,
a/k/a Blanche Boyce, a/k/a Mrs. Blanche E. Boyce,
deceased, and Letters of Administration D.B.N.C.T.A. in
the Esta~e of the said Blanche E. Boyce, a/k/a Blanche Boyce, a/~/a, ~rs~ Blanche E. Boyce, deceased, were granted
unto Bonnie B. Ross on July 21,1972, all of which will
more fully appear by reference to the records thereof in the
Office of the said Register of Wills.

7. On May 20, 1972, the said Loeita Adams, as Executrix,
accepted an offer of Chris Vlachos to purchase the above-described
premises for the total price of $5,000.00, as more fully appears
from the "Offer to Purchase," and "Acceptance," a copy of which
is hereto attached, incorporated by reference herein and marked
Exhibit "A."
8. The price and terms of .said accepted offer are better
than could be obtained for said premises at public sale and the
price thereof represents the fair market value of the above-described
premises.
9. The total of the unadministered assets of the Estate
appear to be less than the amount of the aforesaid bond, which
total includes the selling price of the above-described premises.
WHEREFORE, your petitioner, showing as aforesaid,
respectfully prays that your Honorable Court make an order excusing
her from entering additional security or requiring additional
security, in order that she may consummate the aforesaid sale and
convey the above-described premises in accordance with the require-
ments of Section 541 of the Fiduciaries Act of 1949.

Honor. The complication, or rather the issue in this case arise~

out of the following situation: .all or' the legatees are daughters
of the decedent. One of the daughters died during the course of
administration. The daughter who died was the surviving joint
tenant of a joint bank account with the decedent in the amount of,
I believe $4, 000. 00 or in that neighborhood. Under the law,
it is my understanding that the Pennsylvania Transfer Inheritance
Tax is assessed on the devisee; fhat is would be paid from the
share of the specific devisee. This problem seldom arises
because ordinarily, theotax. is paid out of the residuary estate
and the residuary estate is divided into the s~gments or persons
provided for in the Will. However, in this case, the Transfe
Inheritance Tax on the joint account would ordinarily, as a
matter of law, be deducted from the sharE! of the now deceased
surviving joint tenant. How ever, the sisters, remaining sister
and the heirs of the deceased joint tenants, as part of their
election in ldnd, make this statement:

that Your Honorable Court, in its Decree of Distribution, charg

entered into an agreement. In the light of their .knowledg·e
and capacity to do this, if everybody is in agreement, it seems
to me that I can't see,and no one is objecting to it, I can't see
why we can't approve it.

percent discount is allowable. As to any tax that remains unpaid after nine (9) months
(fifteen months when death occurred from December 22, 1965 to June 16, 1971, inclusive;
and twelve months when death occurred prior to December 22, 1965) from date of death,
interest at the rate of six (6%) percent per annum is charged.
Any party in interest who is aggrieved by this notice may object thereto within
sixty days after receipt of said notice as provided by Section 1001 of the Inheritance and
