That Lenora Doak, formerly of Washington, Penna., died testate on April 13, 1971, and Letters Testamentary on her estate were granted June 1, 1971, to Walter A. Doak, one of her four sons. A photo of her Will is attached hereto and marked Exhibit A. 2. That the Estate of deceased consisted of household goods appraised at $94.00, cash in the amount of $35.00, and a house and lot in the Seventh Ward, 1rJashington, Pennsylvania, hous nQ~bcr 225 Henderson Avenue, appraised at $6,000.00. A copy of the Inventory in this Estate is attached hereto and marked Exhibi B. 3. That at the time of her death Lenora Doak lived in th first floor of 225 Henderson Avenue with her daughter, Ruth L. Doak,and her son, Boyd A. Doak lived on the second floor of said house \vith his wife and paid $40.00 per month rent. That Ruth L. Doak is an incompetent epileptic. 4. That Lenora Doak had caused two joint savings account to be set up for Ruth L. Doak in the Pittsburgh National Bank, Washington, Pennsylvania, both in the names of Ruth L. Doak or Walter A. Doak or Clarence M. Doak, the amounts in them on 1/1/19 1, being $1167.70 and $4,366.68, respectively. That Ruth L. Doak receives no Social Security, but, through her deceased father, \<Jalter B. Doak, gets a monthly Railroad Retirement check now in the amount of $141.89. 5. That the Will of Lenora Doak, after directing the payment of her just debts and funeral expenses by the "Second" paragraph thereof, gave her home at 225 Henderson Avenue, Washington, Pa., to her son, Boyd A. Doak, "upon condition that he provides a home for my daughter, Ruth L. Doak, for and during the period of her natural life". Said will gave all the rest of her estate to Ruth L. Doak. 6. That Sanford S. Finder, Attorney, has notified your Petitioners Attorney that he represents Boyd A. Doak, whose last address was Apt. 23, 750 Michigan Avenue, Washington, Penna. 7. That after Lenora Doak's death, Boyd A. Doak desired to reside on the first floor of decedent's home and one room on t second floor, thus giving Ruth L. Doak two rooms on the second floor. He further requested that her Railroad Retirement check be turned over to him and he would furnish her with food and clothing. Walter A. Doak did not agree to these terms, but stated his siste should be left on the first floor where she had always been. 8. That Boyd A. Doak and his wife, after the death of Lenora Doak on April 13th, 1971, continued to reside in the up- stairs of said home until April, 1972, when they moved of their own free will. They paid no rent during this time~ nor did they pay any of the 1971 real estate taxes on the property, but they did pay one-half (%)of the utility bills·. 9. That after the death of her mother, Ruth L. Doak has resided continuously,alone, in the downstairs of said home up to the present time. Her brother, Willard Doak and his wife, live next door. 10. That since April 13, 1971, gas, electric, telephone, water and sewage bills have been paid out of Ruth L. Doak's moneys, the total paid being $1364.43. 11. That since April 13, 1971, the sum of $1019.28 has been paid out of Ruth L. Doak's money for County, City and School taxes on said real estate. $198.00 has been paid out of her money for fire and liability insurance on said real estate. 12. That since April 13, 1971, the sum of $699.92 has been paid out of Ruth L. Doak's money for a new gas heater and plumbing for said house. '\ ... ~. <;. ·, i.' •• l 13. That Boyd A. Doak collected life insurance on the life of Lenora Doak and paid $1490.00 on the funeral bill of deceased while the balance of the bill of $40.00 was paid out of Ruth L. Doak's money. Doak, Executor of the Lenora Doak Estate, which account has been filed to the November, 1975 Term and will be audited the week of December 8th, 1975. 14. That the costs of administation and inheritance taxes in this estate paid to date have be~n paid out of the money of Ruth L. Doak. · WHEREFORE, showing as aforesaid, your Petitioner requests your Honorable Court to find that Boyd A. Doak has failed for four and one-half years to provide a home for Ruth L. Doak and has forfeited all his right to the real estate referred to in the Second Paragraph of the Will of Lenora Doak. That the Will of Lenora Doak, after directing the payment of her just debts and funeral expenses by the "Second" para;~_raph thereof; gave her home at 225 Henderson Avenue, ,· ' Wa'shington, Pa., to her son, Boyd A. Doak is incapacitated by epilepsy but has continued to reside at 225 Henderson Avenue, from the date of her mother's death to the present date. 6. That the utilities used by her, the taxes and insur-. ance on said real estate, repairs needed on said house, costs of • ...:· administration and inheritance taxes, have all been paid out of Ruth L. Doak's monies since the date of her mother's death. 1. That Ruth L. Doak is in need of a home for life and her mother, Lenora Doak intended by her Will, by the "Second" paragraph thereof, to give her a home for life at 225 Henderson Avenue. 8. That Ruth L. Doak, Walter A. Doak, Boyd A. Doak, Willard Doak, and Clarence Doak, are all the heirs at law of Lenora Doak, a/k/a, Nora Doak, deceased. None of said heirs desire reimbursement for bills of the deceased paid by them. 9, That a Petition To Declare A Forfeiture of the right of Boyd A. Doak to take title to said real estate was filed at 63-71-552, following the filing of a First and Final Account at said Number and Term (November, 1975), said account being set for audit on December 9th, 1975. 10.
