Hancock, deceased, (hereinafter referred to as "the Decedent"), died on May 2, 1971. 2. That a Petition for Probate of the Last Will and Testament and for Grant of Letters Testamentary was made by Helen H. Thomas, Executrix, (hereinafter referred to as "the Executrix"), on May 24, 1971. That Letters· Testamentary were granted to the Executrix on May 26, 1971, as evidenced by the Register of Wills' Book 112-124-2324. 3. That on August 22, 1977, a certified demand letter was sent to the Executrix, advising that the Inheritance Tax Return for the Decedent had not been filed. A receipt was signed and returned to the County Inheritance Tax Office. Attached hereto and made a part hereof is a copy of said letter and receipt marked Exhibit "A." t • 4. That as of the date of this Petition no Inheritance Tax Return has been filed by the Executrix of this estate as required by Section 701 of the Act of June 15, 1961, P.L. 373, Article VII (72 P.S. 2485-701), and Section 703 of the Act of June 15, 1961, P.L. 373, Article VII, as amended (72 P.S. 2485-703). 5. That under Section 821 of the Act of June 15, 1961, P.L. 373, Article VIII, (72 P.S. 2485-821), the Secretary of Revenue is authorized to request the Court to issue a Citation directed to those subject to any duty imposed by the aforesaid Act, commanding such persons to appear and show cause why the requirements of this Act should not be met. WHEREFORE, your Petitioner prays your Honorable Court to issue a Citation upon the Executrix, directing the Executrix to appear and show cause why said Inheritance Tax Return in the estate of the Decedent, should not be filed as required by law; and to further direct that the costs of this action shall be borne by the Executrix. Attached hereto is a copy of the will of the decedent which was filed of record. 3. Letters were issued to Helen H. Thomas May 26, 1971, and advertising of the estate was made in the Washington County Legal Journal and in the Observer-Reporter, the advertising being completed June.l7, 1971. Cop~es of the proofs of advertising being attached hereto. 4. An inheritance tax return was filed on or about October 27, 1977, and all inheritance tax has been paid in the above estate. The assets of the decedent consisted of the following: a. Personal property Pittsburgh National Bank, Savings account Pittsburgh National Bank, Checking account b. Realty Property known as 711 Beech Street and valued at TOTAL $1,000.65 62.90 7,500.00 $8,563.55 Attached hereto is an accounting showing the administration of the estate in terms of the expenses incurred and paid and expenses to be incurred and paid. All of the monies necessary to retain the real estate in kind have been advanced by the two grandchildre set forth above. ·• 5. The only parties in interest are those persons named herein and all known creditors have been paid. 6. Attached hereto is a family agreement requesting that th estate be distributed by a certification of real estate to the Recorder's Office in which Helen H. Thomas retains a life interest in the estate and the grandchildren retain all of the fee simple interest rather than Helen H. Thomas retaining one- half of the residue. A proposed certification of the real estate o the Recorder's Office is attached.
