on the 25th. day of May A. D. 19 71, before me,
Russell Marino , Register for the Probate of Wills and Granting
Letters of Administration in and for the County of Washington, in the Commonwealth of Pennsylvania,
the last Will and Testament of
Annie P. Malone aka Anna PD Malone
late of Washington in the County aforesaid, deceased,
(a true copy whereof is to these presents annexed), was duly admitted to probate; and
James H. Malone
the Executor in said Will and Testament named, having appeared before me and taken and subscribed
the oath of otiice prescribed by law;
NOW, THEREFORE, I, Russell Marino , Register as aforesaid, do
grant these LETTERS TESTAMENTARY, unto the said
James H. Malone
committing unto him the administration of all and singular the goods and
chattels, rights and credits, which were of said deceased, and requiring him
to exhibit a true and perfect inventory thereof into the Register's Office, at Washington, within ninety
days from the date hereof, and to render a just and true account of said administration at the expiration
of six months from the date hereof, and to regard and· comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.

JAMES H. MALONE, the Executor of the Estate of ANNIE P.
MALONE, a/k/a ANNA P. MALONE, does respectfully represent:
1. That your petitioner was appointed Executor of the
Estate of ANNIE P. MALONE, a/k/a ANNA P. MALONE, on May 25, 1971,
and Letters Testamentary were executed on said date by the
Orphans' court of Washington County, Pennsylvania.
2. That the said Annie P. Malone's Last Will and Testa-
ment was probated on said date. A photostatic copy thereof is
attached hereto, made a part hereof and marked Exhibit A.
3. That an Inventory and Appraisement was filed by your
petitioner on the 7th day of December, 1972, at the above number
and term. A true and correct copy thereof is attached hereto,
made a part hereof and market Exhibit B. In accordance with sai
Inventory and Appraisement the only assets of the said estate
were a savings account of the decedent in the amount of $488.25
and the real estate of the decedent at 1041 Arch Street,
Washington, Pennsylvania.
4. That your petitioner further avers that the debts
filed by the various creditors in the said estate are as follows

and in addition thereto costs have been incurred in administratio
for Letters Testamentary, advertising, etc., to date, and further
costs will be incurred for the payment of executor's commission
and attorneys fees for filing account and audit costs, real estat
taxes and. inheritance taxes hereinafter set forth. Also, the
commission for the sale of the real estate by the realtor hired
for said sale by your petitioner.
5. The petitioner further avers that there not being
sufficient cash to make paymem.t of said bills, it became necessar
to sell the said real estate.
6. That your petitioner did on the 3rd day of April,
1974, enter into a contract for the sale of the said real estate
to Alvin E. Ford and Helen M. Ford for the sum of seven Thousand
Five Hundred ($7,500.00) Dollars. A true and correct copy of
the said is attached hereto, made a part hereof and marked
Exhibit c.
7. That the said real estate cannot be sold until the
said premises are vacated in accordance with the terms of said
contract referred to as Exhibit c.
8. That your petitioner further avers that the said Ann
M. Anderson, a daughter of the decedent and a sister of your
peti,tioner, did, without the consent of the executor, occupy
the premises at 1041 Arch Street since the date of the death of
the said decedent on May 16, 1971, and has never at any time
offered to make payment of rental for said premises nor has the
executor ever requested the said Ann M. Anderson to make payment

of rental, but on the contrary has always requested the said Ann
M. Anderson to vacate the said premises so that the same might be
sold for the payment of debts and the settlement of the said
estate.
9. That on April 25, 1974, after:mumerous oral requests
to vacate the premises, as well as written requests that your
petitioner through his attorney, I. C. Bloom, Esquire, did notify
by certified mail the said Ann M. Anderson to vacate the premises
that she occupied in the said estate. A true and correct copy of
the letter and the receipt is hereto attached, made a part hereof
and marked Exhibit D.
10. That again on June 19, 1974, your petitioner through
his a·ttorney, I. C. Bloom, Esquire, did notify the said Mrs. Ann
M. Anderson to vacate the said premises. Said notification was
sent by certified mail. A true and correct copy of the said
letter and receipt is attached hereto, made a part hereof and
marked Exhibit E.
11. That your petitioner further avers that through his
attorney, I. c. Bloom, Esquire, he has made every possible effort
to help and assist the said Ann M. Anderson to procure other
premises through the Washington County Authority so that she
might be able to vacate the said premises amicably.
12. That your petitioner further avers that a lien has
been filed on said real estate by the Inheritance Tax Department
in the sum of $310.33. A true and correct copy of the notice
of fil,ing of said lien by the Inheritance Tax Department is
attached hereto, made a part hereof and marked Exhibit E.
13. That your petitioner further avers that the contract
entered into by your petitioner for the sale of the said real
estate to Alvin E. Ford and Helen M. Ford, dated April 3, 1974,
will be cancelled by the Fords in the event the premises are
not vacated within the immediate future.

14. That your petitioner further avers that from the
date of death of the said Annie P. Malone on May 16, 1971, the
said Ann M. Anderson has occupied the said premises and has
received rentals from the Williams who occupy Pc:!-rt of the said
premises and has never accounted for the said rentals.
15. That your petitioner further avers that taxes have
been accumulating in the amount of $266.88 each.year. Taxes
for the years 1973 and 1974 have been liened.
WHEREFORE, your petitioner prays that a citation be
issued against Ann M. Anderson to vacate the s~~d premises in
order that the same might be sold and the court orderethe
Sheriff, in the event the same are not vacated immediately, to
dispossess the said Ann M. Anderson from the said premises, and
that a rule be issued to show cause why a citation should not be
issued by your Honorable court as above requested.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
The petition of JAMES H. MALONE, Executor of the
above Estate, respectfully represents:
1. That your Petitioner was appointed Executor of
the Estate of Annie P. Malone, a/k/a Anna P. Malone, deceased,
on May 25, 1971, and Letters Testamentary were executed on
said date by the Orphans' court of washington County, Pennsyl-
vania.

2. That the said Annie P. Malone, a/k/a Anaa P. Malone s
Last Will and Testament was probated on said date, a photostatic
copy thereof is attached hereto and marked Exhibit "A".
3. By the terms of the said Will, Exhibit "A", the
following appears:
SECOND: All the rest, residue and remainder of my
estate, of whatsoever nature and wheresoever found,
I give, devise and bequeath, in equal shares, to my
three children, JAMES H. MALONE, of washington,
washington county, Pennsylvania, EVA o. TYLER, wash-
ington, District of Columbia, and ANNA M. ANDERSON,

of washington, washington County, Pennsylvania.
In the event that any of my three children should
not survive me, then I give, devise and bequeath
all the rest, residue and remainder of my estate
of whatsoever nature and wheresoever found, to
the surviving child or children1 share and share
alike.
4. That your Petitioner further avers that there
will be a cash distribution due in said Estate by reason of
the sale of the said real estate by your Executor, The exact
amount due all of the three children mentioned in Paragraph
Three of said Will are to share and share alike in the distribu-
tion of the said Estate.
5. That your Petitioner avers that his sister, Eva o.
Tyler, was last seen alive in September of 1959, and her resi-
dence at the time was the City of Pittsburgh, Allegheny County,
Pennsylvania.
6. That your Petitioner further avers that since
said time the whereabouts of his sister, Eva 0. Tyler, is
unknown.
7. That your Petitioner further avers that the
marital status of the said Eva 0. Tyler at the time, in Septem-
ber of 1959, was that she was a widow.
8. That your Petitioner further avers that at no
time did your Petitioner know that the said Eva 0. Tyler had
a washington, District of columbia, address, this being the
given address in the Last Will and Testament of the said Annie
P. Malone, a/k/a Anna P. Malone, deceased.
9. That your Petitioner, on December 23, 1974,

December 30, 1974, and January 6, 1975, had published, for
three consecutive weeks, in the Observer Reporter, a newspaper
of general circulation in the City of washington., washington
county., Pennsylvania, an advertisement placed as personal adver-
tisement, said advertisement reading as follows: "Please call
412-225-4100 if you can assist in the location of EVA. o. TYLER,
also known as EVA o. MALONE, whose last known address was Pitts-
burgh, Pennsylvania." A similar notice was placed also in the
Pittsburgh Press, Sunday edition, for three consecutive weeks,
beginning on Sunday, December 22, 1974, the said Pittsburgh
Press being a newspaper of general circulation in the western
part of the State of Pennsylvania.
10. That your Petitioner further avers that he is
having a similar advertisement placed in the washington D. C.
Post, which is a newspaper of general circulation in the Distric
of columbia. Said advertisement will run for three consecutive
weeks in said newspaper.
WHEREFORE, Petitioner prays your Honorable Court,
under the provisions of the Probate, Estate and Fiduciaries
code, to decree the presumption of death of the said Eva o.
Tyler and the date of her death.

Letters Testamentary were granted to me by the .Registe·r-of Wills
of Washington County, Pennsylvania, on May 25, 1971.

That under the Will.of my mother, Annie P. Malone, who was a
widow at the time of her decease, she devised and bequeathed all
her estate to her children, namely, your affiant James H. Malone,
Eva 0. Tyler, and Ann M. Anderson.
That your affiant further states that the last time that he saw
his s~'ster Eva 0. Tyler alive was in Septembe:£11959, and her resid~nce at the said time was in the City of Pittsburgh, Allegheny
County, Pennsylvania. ·
That your affiant further states that since said date. ~amely
September 1959, the said Eva 0. Tyler's residence has been
unknown and that your affiant·has never seen her in person nor
heard of her through anyother person nor does the affiant know

Dear Mr. Marino:
At your request I am submitting herewith a
written opinion regarding the validity of the probate of the Last Will
and Testament of Annie P. Malone, deceased.
A hearing was held at the request of counsel
for the estate in your office on Friday, June 21, 1974.
Briefly, the facts are as follows. Counsel for
the decedent was Sigmund L. Bloom, Esq. and he testified clearly and
concisely that the X was made by the testatrix in his presence and the
presence of his employee, Miss Joan Lesnock. The testimony indicated
that the testatrix could not write her name but that she could make a
mark, and that otherwise her mental capacity was very good. Miss
Lesnock testified to the same effect. It appeared that both Mr. Bloom
and Miss Lesnock had signed their signatures on the line where the
name of the testatrix should have been subscribed but as a result of
inadvertence, the name of the testatrix was not so subscribed. The
matter is at issue under the former Wills Act of 1947, now amended
and superseded by the Probate, Estates and Fiduciaries Code.
The Will was dated September 21, 1967. and it
appears of record in Will Book ll2, page ll6. All of the requirements
of the Wills Act of 1947 have been faithfully complied with except that
through inadvertence, the name of the testatrix was not physically
subscribed by anyone in her presence at or about the time that she
affixed her X.
Furthermore, we are satisfied that all the
signatures and acts otherwise required under the Wills Act of 1947

were consummated in the presence of all three persons, namely,
Sigmund L. Bloom, Esq., Miss Joan Lesnock and the testatrix.
This Will was admitted to probate on May 25,
1971, and no appeal was ever taken therefrom. As I understand it,
the estate has been dormant for some years in the hope that a sale
of the real estate can be effected. Doubtless the testatrix had made
her mark in the presence of the two subscribing witnesses and it
would seem to me that substantial compliance with the applicable
provisions of the Wills Act of 1947 had been made.
Although the law requires strict compliance
with Wills made by mark, the most liberal, prevalent view seems
to be that substantial compliance which effectively obviates any taint
of coercion or fraud is sufficient: Cohen Will, 356 Pa. 161, 164, 165;
Rhodes Will, 399 Pa. 476, 482, 483, see Dissenting Opinion of Mr.
Justice Musmanno, pages 484 through 492 inclusive.
Therefore, I am of the opinion that the letters
testamentary should n0t be revoked and the Will should remain valid
as probated.

In accordance with your request, I am hereby submitting a
brief resume for the approval of the probate of the Will of Annie
P. Malone. The law is very clear that a Will should be signed by
the Testatrix, and in this particular case it is our contention that
the Testatrix did sign the Will by making her mark in the presence
of Joan Lesnok and Sigmund Bloom, an Attorney at the Bar. The
testimony clearly shows that they witnessed her Will at the request
of the Testatrix, and that the Testatrix did sign the Will by
making her mark. The most representative cases that we could find
are as follows: cohen Will, Pa. State Reports, Vol. 356, page 161~
Torhan Will, Pa. State Reports, Vol. 399, page 482~ Rhodes Will,
Pa. State Reports, Vol. 399, page 482~ Butzer Estate, D. & c. Reports,
Vol. 78, page 577~ and Publicker Estate, D. & c. Reports, Vol. 1 2d,
page 153.
After careful review of the above mentioned cases, it is
quite clear that the courts require the completion of all essential
elements for properly validating a will. It is our contention that
all essential elements are contained in the present case because the
Testator did everything that she could possibly do, the witnesses

were present throughout all stages of executing of the Will and, most
important of all, the Testator was present throughout all stages
of the execution of the Will and all of her intentions and requests
were carried out in the Will. In this case, all of the requirements
of the law as to making a mark were carried out with the exception
of the writing of the name of the Testatrix around the mark, as is
the usual practice. There is no question in this case that the
Testatrix' s Will was signed by her making the mark, and it was her
intention that her property should go to her three children, who
were her sole surviving heirs.
In this particular case no one could, in any way, file an
appeal or be sustaining damages, or suffer a loss by reason of the
fact that this Will is probated, as Judge Simmons of the Orphans'
Court has indicated that before this property is 'Sold he is going
to require the Executor named herein, who is the only son of the
Testatrix, to place a bond for the proper distribution of the
monies received from said sale. The amount involved in said sale
is $7,500.00.
If your attorney, Thomas J. Terputac, Esq., desires, we have
copies of the various cases that we cited, and he can examine same
and save him the time of briefing the above ment{oned citations.

to the Commonwealth of Pennsylvania, Department of Revenue, in the
amount of $331.11 for full payment of the inheritance tax plus in-
terest to December 9, 1974, which was liened against the above
captioned estate. This lien was entered for the amount of $310.33
in the Court of Common Pleas of Washington County, Pennsylvania, at
No. 420 September Term, 1973. Our check is for the tax due plus
interest to December 9, 1974.
We are also this date making payment to Russell Marino,
your agent in the Register of Wills Office of washington county, so
that he might satisfy the lien of record. The amount of our check
to Mr. Marino is $8.50.
Will you kindly authorize Mr. Marino to satisfy the lien
as the tax is now paid in full, plus interest.
We also wish to inform you that there no doubt will be a
rebate due the estate by reason of additional credits which will be
claimed in the Account. We will make a claim for the rebate after
we file the account and determine the exact amount of the ~g~~~

or purchasers of this property and is here. This deal
should have been closed on June 1st. I have assurance

client has a place to move to and that she will vacate

the agreement, to go through with the sale of this
real estate, provided that she can havepossession on
or before December 1st, 1974 .

at this time that the rule be made absolute, or the
Citation be made absolute, and that if Mrs. Anderson
does not remove herself from the premises on or before
December 1st, 1974, that I will ask the Court to issue
an order to the sheriff of this county for her to be
dispossessed from the real estate in question.

One time in the 16 years that I've lived there, it was
my second wife, Mabel, said it was the daughter Eva
was over there.
How long ago was that?
Sometime before Mr. Malone died.
Q Do you know when Mr. Malone died, approximately?
A He died in November, '65.

118 Caldwell Avenue, Canton Township.

During the time that you lived there, up until your
mother died, how close was that to your mother, or did

Would you repeat that? You mean when my mother died?

Eva 0. Tyler is my sister.
And was she older than you?
She is older.

And he is the executor of Annie P. Malone's estate.

The last time I saw her, I don't remember ever seeing he •
I never saw my sister. When I was younger she got up and
left.
When was that though, approximately? How old were you
at that time?
I guess I was about 15 or 16, I guess.
COURT: In other words, you haven't seen your
sister since you were 15 or 16 years old.
No, sir.
How old are you right now?
I am 48 .
So all during that whole time you have never seen your
sister.
No, I never saw my sister •
Do you know of her whereabouts? Of your own knowledge
do you know where she had been after she left?
I heard rumors that she lived in Washington, D. C. and
after that, Pittsburgh, Pa. But I never did see her.
You never saw her?
No.
Q And she never came back.
A No.
THE COURT: In other words, it will be almost 30 years
since you last saw her, your sister.

A Yes. I would like to see her, she's my sister.

alive or what happened to her.

was in September, 1959, and her reSdence at the said
time was in the City of.Pittsburgh, Allegheny County,
Pennsylvania.
