PETITION FOR FAMILY EXEMPTION
TO THE HONORABLE P.V.MARINO,JUDGE OF SAID COURT:
The Petition of Cheryl Marie Johnson respectfully represents:
1.That your petitioner resides at Box 542,Ellsworth,
washington County,Pennsylvania.
2.That on April 14,1970,Clayborn W.Foster d~ed
domiciled at the Borough of Ellsworth,Washington County,
Pennsylvania.

3.That the petitioner is a child or the decedent and
is of legal age and formed part of his household at the time of
decedent's death'.·
4.The decedent was not survived by a spouse.
5.The decedent was survived by the following children:
Cheryl Marie Johnson,age 22;Marjorie Ellen Foster,age 20i
Dorene Mae Foster,age l8i Clayborn Woodrow Foster,Jr.,age l6i
John Thomas Foster,age lSi Norman DuWayne Foster,age l4i and
Douglas Patrick Foster,age 13.
6.No Letters of Administration have been granted on the
decedent's estate,and no application for Letters of Administratio
will be made on the decedent's estate.

7.The personal estate of the decedent consists of the
amount of Five Hundred Sixty-Six Dollars and Seventy Cents
($566.70)due on the Black Lung Claim from the Department of
Health,Education and Welfare,Social Security Administration.
8.All the expenses incidental to the burial of the
decedent have been paid.
9.Your petitioner claims the aforesaid amount of Five
Hundred SixtY-Six Dollars and Seve~ty Cents ($566.70)as part
of her Family Exemptio~under Section 211 of the Fiduciaries Act
of 1949,as amended.
WHEREFORE,Y9ur'petitioner.requests the Court,pursuant
to Section 211 of the Fiduciaries Act of 1949,as amended,to set
aside and award to her the amount of Five Hundred SixtY-Six
Dollars and Seventy Cents ($566.70)due on the Black Lung Claim
from the Department of Health,Education and Welfare,Social
Security Administration,as a part of her Family Exemption and
further prays your Honorable Court to direct the Department of
Health,Education and Welfare,Social Security Administration,
to make payment of the aforesaid amount of Five Hundred Sixty-Six
Dollars and Seventy Cents ($566.70)to your Petitioner.
And she will ever pray.

Cheryl Marie Johnson,under the authority of Section 211 of the
Fiduciaries Act of 1949,the amount of Five Hundred Sixty-Six
Dollars and Seventy Cents ($566.70)due on the Black Lung Claim
from the Department of Health,Education and Welfare,Social
Security Administration,as a part of her Family Exemption
from the Estate of Clayborn W.Foster,deceased:and further,
that a copy of this Order shall be adequate authority for the
Department of Health,Education and Welfare,Social Security
Administration,to make payment of the aforesaid amount to
Cheryl Marie Johnson.'
