MR.PATRONO:This appears to be my term for complications.
I think w e have all the necessary papers here.But there are
complications.In this estate the decedent left a Will in which she
devised her real estate for life to a daughter,and the remainder
to her grandchildren.She also made a number of specific legacies
of various items of personal property.It turned out that the real
estate and the personal prope rty were not adequate to pay he r
expenses.So with minor exceptions,it was sold.So this brings up
one question and that is the abatement of the legacies.And then it
also brings up the question of how to handle .the items that remain iln
kind.Our suggestions as are set forth in the Petition under
Section 751 of the Fiduciaries Act are that first,the residuary

This is calculated in our suggested distribution.
Now there are some items that have remained
in kind which the personal representative has,and thos e we suggest
should be deducted from the award to the personal representative
after the abatement has been calculated and the cash awarded to hE r.
Now we have another problems.The real estate was awarded to
Betty Jean DeLanie for life and then to the grandchildren in
remainder.The grandchildren are her children.Of course,
the real estate has been sold,so I suppose the only thing we can de
is to have some trustee handle woo tever the net proceeds from the
sale of the real estate are,pay the income to Mrs.DeLanie for
life,and then at her death pay the balance to the children or grand
children.But the Will makes no provision for any trustee.And
so I suppose that we'd have to ask the Court to do this on some mot'on.
I believe that that covers the problems.

This appears to be my term for complications.
I think w e have all the necessary papers here.But there are
complications.In this estate the decedent left a Will in which she
devis ed her real estate for life to a daughter,and the remainder
to her grandchildren.She also made a number of specific legacies

expenses.So with minor e'xceptions,it was sold.So this brings up
on'e question and that is the,abatement ?f the legacies.And then it
also brings up the question ofhow to handle :the items that remain iin
kind.Our suggestions~as are set forth in the Petition under
Section 751 of the Fiduciaries Act are that first,the residuary
legacy of personal property abate.Secondly,that a legacy of $500.00,
a pecuniary legacy,which did not pertain to any specific item of
property,any bank account or anything like that,abate.And
thirdly,that legacies to persons who were not issue of the decedelh
abate.We think this is in conformity with Section 75 L If this be
