PETITION FOR SETTLEME~T OF SMJLL ESTATE
To the Honorable P.V.Marino,President Jucge of Orphans'Court
The Petition of Frances SCJmupitz respectfully represen s:
1.The decedent,Paul Schlaupi tz cied Septemper 6,1970,
intestate,a resident of North Franklin Township,Washingt?n
County,Pennsylvania.
2.Your Petitioner whose address ~s now 42 West Chest-
nu t street,Wa s hington;County,,:'Pennsylvania;is the wi dow of S8 id _
decedent having married hin May 28,1938,and on the date of his
death formed a part of his household.
3.All pers ons who are etUlti tl'ed to s hare in the de ce-
dent's estate are Elizabeth Martos,R.D.#2,Eighty Four,
Pennsylvania,a daughter born of their marriage;and Kenneth
Schlaupitz,R.D.#3 Marion,Michigan,and Carl Schlaupitz,
745 East Brentwood,Detrolt,Michiggn,both of whom are sons of
the decedent born to a prior marria~e of his.
4.Your Petitioner is entitled to the family exemption
in th'e amountof One Thousand Five Hundred Dollars,($1500.00).
5.The only asset in said estate js the sum of $1516.90
under the Federal Coal Mine Health 3nd SaPety Act of 1969,in the
at'm of Black Lung B,enefib:i for the months (,f February 1970
through August 1970,at $216.70 a m~nth.Decedent had filed
claim for said benefits which was nJt finally adjudicated until
after his death.
6.That the United Mine ~orkers Fund paid $350.00 of
the funeral expenses of decedent an,]t he balance of $1108.00 was
paid by peti tio'ner from her own funds t'J the Robert Gordon
Funeral Home of Washington,Pennsy17ania.
7.There are no unpaid bills or claims of petitionerIs
knowledge.

awarded One Thousand Five ~-{undred I'olla rs ($1500.00)of 'the sa i d
Black Lung Benefits as her family exemption and the balance of
$16.90,of said benefits to her as partial reimbursement to her
for her payment of part of said funeral bill
9.Wherefore Petitioner p~ays that the Court direct
distribution of said property and s~id estate as,requested,under
section 202 of the Fiduciaries act 0f 1949 as amended.
And she will ever pray
