NO. 63 -71 -259 EXCEPTION TO ACCOUNT AND EXCEPTION TO PROPOSED SALE TO EXECUTRIX AND NOW, this ~day of September 1974, MARGARET MORVIN, legatee in the above captioned Estate, and SALVATORE GRAFF, beneficiary of the Estate of HELEN GRAFF, legatee in the above captioned Estate object to the account filed by Elizabeth C. Karpy, Executrix of the Estate of Mike Dudas, a/ k/ a Michael Dudash, and to the proposed Petition of Elizabeth C. Karpy, Executrix of said Estate for leave to purchase certain lots of ground listed as assets of the Estate, for the following reasons: l. The accountant has set forth in the account the name of Helen Graff as a beneficiary of the estate, whereas the said Helen Graff died, testate, on January 13, 1974, subsequent to the death of Testator who died January 6, 1971, and by her Last Will and Testament did give, devise and bequeath her entire estate to her husband, Salvatore Graff, exceptant herein. Insofar as the said Helen Graff died subsequent to the death of Testator, her interest in said Estate had vested in her and would pass under the terms and provisions of her Last Will and Testament, wherein she did give, devise and bequeath her entire estate unto her said husband, Salvatore Graff. 2. The accountant proposes to present her Petition to the Court for lease ·to purchase certain assets of the Estate, being Lots Nos. 731 and 732 in the La Belle Heights ADotment, and Lot No. 184 in the Arlington Heights Allotment, all in Trumble County, State of Ohio, for the total sum of $450. 00, whereas the fair market value of said lots if sold on the open market is $3,400.00 3. The accountant has failed to include in the assets of the Estate the sum of $16,317.72, being the principal amount on deposit in a Joint Savings Account #066 -5072 held in the Mellon National Bank & Trust Company, Canonsburg, Office, Canonsburg, Pennsylvania, in the names of Mike Dudas or Elizabeth C. Karpy, and opened on August 13, 1965. This was a convenience account, and all sums on deposit in said account were the sole property of decedent, Mike Dudas, and were properly includible in his Estate. 4. The Exceptants herein therefore request of Your Honorable Court: a. That the distributive share of the Estate vested in 'Helen Graff, now deceased, be awarded directly to Salvatore Graff, sole beneficiary under the terms of the Last Will and Testament of the said Helen Graff, Deceased. b. That Elizabeth C. Karpy, Executrix, be directed to file an amended inventory and appraisement setting forth the sum of $16, 317. 72, the proceeds of Savings Account #066-5072, Mellon National Bank & Trust Company, Canonsburg Office, Canonsburg, Pennsylvania, as an asset of Decedent's Estate. c. That the Petition of Elizabeth C. Karpy for leave to purchase Lots Nos. 731 and 732 in the La Belle Heights Allotment, and Lot No. 184, in the Arlington Heights Allotment, Trumble County, State of Ohio, be denied. d. Judge Hanna has been assigned to the January-February and November-December terms; Judge Gladden has been assigned to the March-April and September-October terms; Judge Sweet has been assigned to the May-June term and Judge DiSalle to· the July-August term. Judge Sweet will handle desertion and nonsupport and administrative duties; Judge Hanna will handle summary convictions and the overflow from juvenile; Judge Gladden will handle motions related to divorce and the overflow from Orphans' court; Judge Simmons will handle orphans' court and juvenile court and assist in argu- ment court. In view of his membership on the Judicial Council, Juvenile Judges Com- mission and Regional Board of Crime Commission, Judge DiSalle will not have an additional assignment. Twelve general holidays have been fixed. Six two-week criminal terms and four two-week civil terms have been scheduled. The civil list will be made up· of cases which have gone through pretrial.
