the State of Maryland, of Baltimore, Maryland, having an office and usual place of business at
301 Fifth Ave. Bldg., Pittsburgh , State of Pennsylvania, as Surety, are held and
firmly bound unto the COMMONWEALTH OF PENNSYLVANIA, in the sum of Twenty-five thousand

to be paid to the said Commonwealth, for which payment, well and truly to be made, we bind ourselves,

THE CONDITION OF THIS OBLIGATION IS, That if the above bounden John B. McCreight
administrat or cum testamento annexo of all and singular the goods, chattels and credits of
Mark R. Ulery deceased, do make or cause to
be made, a true and perfect inventory of all and singular the goods, chattels and credits of said de-
ceased, which have come or shall come to the hands, possession or knowledge of the said adminis-
trator or into the hands and possession of any other person or persons for said administrat or ,
and the same so made do exhibit or cause to be exhibited, into the Registrar's Office, in the County
of Washington within thirty days from the date hereof; and the
same goods, chattels and credits, and all other goods, chattels and credits of the said deceased at the
time of death, which at any time after shall come to the hands or possession of the said admini-
strat or or into the hands and possession of any other person or persons for said administrat or,
do well and truly administer according to law; and further, do make, or cause to be made, a just and
true account of said administration, in six months from the date hereof, or when thereunto legally
required, and all the rest and residue of the said goods, chattels and credits, together with the pro-
ceeds of any sales of real estate the said administrat or may make under the will of decedent,
which shall be found remaining upon the said administrat or account, the same being first
examined and allowed by the Orphans' Court of Washington
County, shall deliver and pay unto such person or persons as the said Orphans' Court, by their decree or
sentence, pursuant to law, shall limit and appoint, and shall well and truly comply with the laws of this
Commonwealth relating to inheritance tax; and if it shall hereafter appear that any Will or Testament
was made by the said deceased, and the same shall be approved according to law, if the said admini-
strat , being thereto required, do surrender the said letters of administration into the Registrar's
Office aforesaid, then this obligation to be void, otherwise to remain in full force.

having been presented to the Court and it appearing
that there is no personal property in the Commonwealth of
Pennsylvania belonging to said decedent's estate,·and that
an administrator'~ bond with approved corporate surety has
been filed in the amount of $2,000.00, NOW THEREFORE, IT IS
ORDERED that John B. McCreight, Ancillary Administrator of
the Estate of Mark R. Ulery, deceased, shall .file an additional
corporate surety in the amount of

The petition of John B. McCreight,.Ancillary
Administrator, respectfully represents:
1. That Mark R. Ulery a resident of Sussex
County, Delaware, died February 20, 1969, leaving a Last Will
and Testament dated November 23, 1955, a copy of which :is hereto
attached and made a part hereof.
2. The real estate proposed to be sold is that
parcel described in Paragraph 2 of the Will, which description
is herein incorporated by reference to said Will. In addition
to said·~eal estate•the decedent owned real estate described

in Paragraph 3 of said Will and undj.vided 210ths undivided
interest in the IL A. Ulery Farm referred to in Paragraph 1 of
the Will. No real e~tate has been previously sold.
3. ~here is attached hereto and made a part
hereof Aff.idavi.ts of tv-m responsibl,e persons e;ivi;ng the fair
market value of the property proposed to be sold.
4. The decedent owned no'personal property in
the CommomJeal th of Pennsy1 vania.
5. The bond filed on the grant of letters with
corporate surety was in the amount of $2,~00.00.
6. The proposed sale is a private sale to Mark

2. The real estate proposed to be sold·is that
parcel described in Paragraph 3 of the Will, whichidescription
is herein incorporated by reference to said Will. In addition
.to said real estate the de~edent owned real estate described
37 in Paragraph 2 of said Will and an undivided 210ths undivided
interest in the H. A. Ulery Farm referred to in Paragraph 1 o~~
the Will.and several vacant lots. The real estate described
in Paragraph 2 of the will has been sold·during administration
for the sum of $3,500.00.
3. There is attached hereto and made a part hereof
Affidavits of two responsible persons giving the fair market
value of the property proposed to be sold.
4. The decedent owned no personal property in the
Commonwealth of Pennsylvania.

5. The bond filed on the grant of letters with
corporate surety was in the amount of $2,000.00 and an additional
bond in connection with the sale Under Parag~aph 2 of the will
~as filed in the amount of $2,000.00.
6. The proposed sale is a private sale to Alvin A.
Barker and Irene Barker, in the amount of $4,500.00.
WHEREFORE your petitioner.prays that the Court fix
the amount of additional bond, if any, to be filed as a
condition to receipt of the s~le price of said real estate.

WITNESSETH, that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows: ·
1. Seller agrees to sell and convey to buyer-on or before April 1st, 1973
by special warranty deed in fee simple absolute, clear of all mortgages, judgment liens
and tax liens and other encumbrances affecting its marketability (except as hereinafter set forth) all the real property

THIS is a part of a larger· tract of land which was conveyed to Mark R.
Ulery by.W. I. Horn by deed dated Septembe~ 23, .1940, of record in the
Recorde~'·s Office of Wash.ington County in Deed Book 691, at page· 9.
The said Mark R. Ulery died February 20, 1969, at New Castle, Delawa~.e,
and by bls Will dated November 23, 1955, the above described real estate

9. If Buyer defaults in payment or performance for 30 days, Seller may, at Seller's election,
use one or more of the following remedies in addition to or instead of any other remedies provided by law: ·
(a) rescind this agreement and retain all sums paid on account hereof as liquidated damages, in
which. case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall s~render this Agreement for cancellation;
· (b) eject Buyer from said real es.tate, for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages, to include attorney's commission of 1 0 %
or $ and costs, hereby waiving stay of execution, exemption and inquisition, with release of all errors;
(c) affirm this agreement by delivery of deed to Buyer, declare all sums due· hereunder to be
forthwith due and payable, and cause judgment to be entered therefor, for which purpose Buyer hereby authorizes
and empowers any attorney of any Court of Record to appear for Buyer and confess judgment against Buyer for
the whole balance due, together with interest, attorney's commission of 1 0 % or $ ' and costs,
and hereby agrees to immediate execution thereon, waiving stay of execution, exemption and inquisition, with re-
lease of all errors.
10. This Agreement shall extend to and benefit and bind the heirs, executors, administrators, successors and
assigns of the parties. Whenever used herein, the singular number shall include the plural, the plural the singular
and the use of any gender shall include all genders.
NOTICE-THIS DOCUMENT MAY NOT SELL, CONVEY, TRANSFER, INCLUnE OR INSURE THE TITLE TO THE COAL
AND RIGHT OF SUPPORT UNDERNEATH THE SURFACE LAND DESCRIBED OR REFERRED TO HEREIN, AND THE
OWNER OR OWNERS OF SUCH COAL MAY HAVE THE COMPLETE LEGAL RIGHT TO REMOVE ALL OF SUCH COAL

The Petition of John B. McCreight, Ancillary Administra or,

respectfully represents:

1. That Mark R. Ule~y, a iesident of Sussex County,
Delaware, died February 20, 1969, leaving a Last Will and Testa-
ment dated November.23, 1955, a copy of which is hereto attached
and made a part hereof.
2. The real estate proposed to be sold is the interes
of the Decedent devised in Paragraph 1 .of the·Will, which
description is herein incorporated by reference to said Will.
In addition to said real estate the Decedent owned real estate
described in Paragraphs 2 and 3 of said w111 which have been sol
for $3,500 and $4,500, respectively, and four vacant lots
adjoining the real·estate described in Paragraph 3 of the Will
and known as Lots Nos. 47,· 48, 49 and 50 in Fairfield Plan of
Lots which vacant lots were sold for the sum of $800.
3. There is attached hereto and made a part hereof
affidavits of two responsible persons giving the fair market
value of the property proposed to be sold.
4~ The Decedent owned no personal property in .the
Commonwealth of Pennsylvania.
5. The Bond filed on the grant of-Letters with cor-
porate surety was in the amount of $2,000 and an additional Bond
in connection with the sale under Paragraph 2 of the . Wil.l was
filed in the amount of.$2,000~ a'further. a·dditional'Bond filed

in connection with the sale of the real estate in Paragraph 3 of
the Will was filed in the amount of $2,500 and that a further
additional Bond in the amount of $1,000 was filed in connection
with the sale of the vacant lots hereinabove ident~fied.
6. That the proposed sale is a private'sale to Leslie
P. Midla and Nancy Midlai his wife, for a gross sale price for
the entire A. J. Ulery Farm of $15d,ooo of which the Decedent's
6/35 interest would be $25,714.29.
WHEREFORE your Petitioner prays that the Court fix the
amount of additional Bond, if any, to be filedas a condition to
the receipt of the sale price of the interest of Mark R. Ulery
in said real estate ..

the estate of Geraldine Ulery. Mr. John
McCreight.,
MR. McCREIGHT: May it please the
Court, the required papers in this
estate were handed up at the time of the
original audit. The .audit, however, was
contin6ed at the request of Mr. Duane
bllery, who is in the courtroom. He is
represented by counsel. The problem that
·arose there is one which 1 can readily
understand. Th@y ~rere owners of a very
valuable farm in whom -or in which a
Mark Ullery had an undivided six-thirty-
f~ft~interest; Edith Ullery, an undivided
nine-thirty-fifth interest; and Geraldine
Ullery, the. person whose estate is before
usy.an undivided nine-thirty-fifth inter-
est. The sale of this farm took place
during the ad~inis~ration of all three
estates, so that instead of the Geraldine
~\lery estate showing on the inventory

And the Commonwealth had claimed. inheri-
tance tax on that but h~p not reserved
the right to reappraise that in their
appraisal .. · They made their appraisal
final and the 60 days for appeal had
elapsed. On the basis of this we have
made a ~equest for a refund of the amount
of the tax which was repre~~nted by that
increase between the inventory of the
Geraldine Ullery estate and the final
distribution as determined.by this Court
from the Edith Ullery estate. We have
not yet rece~ved any indication of a
determination. We don't know whether we
will prevail in this or not but we felt
it was too important an item to let
slide.
