(as is affirmed), possessed of divers goods and chattels, rights and credits, within the said County,

by reason whereof the:power of granting administration thereof doth belong to me; I therefore, confiding
in your fidelity, do by these presents grant unto you these LETTERS OF ADMINISTRATION, here-

PETITION TO COMPEL PAYMENT
AND NOW comes DON DALEY, on behalf of himself and EILEEN DALEY,
his sister, a minor, by and through his Attorney, THOMAS 0. VREELAND, ES-
QUIRE, and respectfully represents the following:
1. That the petitioners reside at East VanOwen Street, Orange,
California 92667, with their mother, Lois C. Morrison.
2. That Lois C. Morrison was married to Donald D. Daley, and
the decedent herein was his Aunt.
3. That Mary C. Young died on February 13th, 1971, intestate.
4. The decedent was the great-aunt of the petitioners herein.
5. That Rose Daley, surviving sister of the decedent, was ap-
pointed Administratrix of the Estate of Mary C. Young, and did administer
the same.
6. That Rose Daley resides at 239 Smithfield Street, Canonsburg,
Pennsylvania 15317.
7. That included as an asset in the Inventory in the above es-
tate was a bank account titled as follows:
Mary C. Young, Trustee for Don Daley and Eileen Daley,
minors, Savings Account No. 3767, at Slovenian Savings
and Loan Association of Canonsburg. Balance as of Feb-
ruary 13th, 1971, $747.72. (See EXHIBIT "A").

8. That Rose Daley holds the passbook to said account, and has
refused to deliver the same to the petitioners herein.
9. That the petitioners have attempted to withdraw the funds
in said account, through direct request to the Slovenian Savings and Loan
Association of Canonsburg, as well as by contacting the Administratrix of
said estate by letter and by 'phone. (See EXHIBIT "B").
10. That on numerous occasions Rose Daley has attempted to
withdraw the balance of said account and convert it to her own use, con-
trary to the intentions of the decedent.
11. The Slovenian Savings and Loan Association of Canonsburg re-
fuses to release the funds in said account until a Judicial determination
is made as to the distribution of the same.
12. The balance in said account is now $1,236.00.
13. The petitioners are the rightful owners of the proceeds of
said account.
14. The above estate was not insolvent.
WHEREFORE, the petitioner herein respectfully requests that the
Court compel the Administratrix in the above estate to surrender said
passbook to Account No. 3767 at the Slovenian Savings and Loan Associa-
tion of Canonsburg to the petitioner herein; in the alternative, that the
Court order the payment of the balance in Account No. 3767 at Slovenian
Savings and Loan Association of Canonsburg to the petitioner herein; or in
the alternative, to order the payment of the balance in Account No. 3767
at the Slovenian Savings and Loan Association of Canonsburg into Court,
pending a hearing on this matter.

PETITION FOR CONTEMPT
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
AND NOW, comes DON DALEY and EILEEN DALEY, by and through their
Attorney, THOMAS 0. VREELAND, ESQUIRE, and respectfully represent the
following:
1. That they are the petitioners in this proceeding.
2. That on September 4th, 1980 Rose Daley was served with a Ci-
tation (See EXHIBIT "A") commanding her to appear before the Honorable
Judge Thomas J. Terputac on Tuesday, September 30th, 1980, at 1:30 o'clock
P. M. for a hearing in order to show cause why she should not surrender a
certain passbook, Account No. 3767, at the Slovenian Savings and Loan As-
sociation of Canonsburg.
3. The said Rose Daley did not appear on Tuesday, September 30th,
1980, at 1:30 o'clock P. M.
4. As a result of the said failure of Rose Daley to appear, the
Honorable Thomas J. Terputac delivered a letter (See EXHIBIT "B") to her
granting her an extension of time until Tuesday, October 14th, 1980 to de-
liver the said passbook to the attorney for the petitioners.
5. That as of October 16th, 1980 said passbook has not been de-
livered, nor has any communication been received from Rose Daley concern-
ing the same.

6. That, notwithstanding all of the aforesaid, Rose Daley has
failed and refused to comply with the requests and Orders of this Honor-
able Court.
WHEREFORE, the petitioners pray that your Honorable Court hold
Rose Daley in contempt and take any and all actions necessary to compel
compliance.

It has come to the attention of the court that a certain
passbook is being held by you relative to funds in Slovenian
Savings and Loan Association re~pecting the Estate of Mary C.
Young, deceased.
I am informed that this is a tentative trust, or what we
someticies call a Totten trust and th~t the beneficiaries, Don Daley
and Eileen Daley, are entitled ·to the ·funds. I am further informed
that the beneficiaries have made many requests to you so that the
passbook could be delivered so th~t they could secure the funds
from the bank.
A hearing was held on Tuesday, September 30, 1980, at
which y6u were duly notified to be ~re~ent respecfing your refu~al
.to hand over the passbook and you failed to appear ..
You are hereby granted until Tuesday, October 14, 1980,
and if by that time you do not deliver the passbook to Attorney
Thomas o. Vreeland, for the beneficiaries, or an affidavit that
·the passbook is lost and completely unavailable, I will entertain
a petition to hold· you in contempt of co~rt and impose appropriate
penalties.

That Sc.hedule A attached hereto and made part hereof sets forth fully and in detail all the
real -Property in the Commonwealth of Pennsylvania of which decedent died having an interest therein. It
also sets forth the mortgage encumbrances upon each parcel of real property at the date of death, giving
the amount still due at death, name of mortgagee, date, rate of interest, and book and page of record
thereof. It also sets forth in the columns provided therefore the assessed valuation of each of said
parcels, the estimated market value thereof as of date of death of decedent.
That Schedule 8 attached hereto and made part hereof sets forth fully and in detail all personal
property wheresover situated owned by the decedent at the time of death; all moneys left by the decedent
at the time of death, whether in decedent's immediate possession, standing to decedent's credit in banks
of deposit, savings banks, trust companies, or other institutions, whether individually, or in trust for
any other person or persons giving also separately the accrued interest thereon, if any, down to the last
interest day prior to decedent's death in the case of savings banks, and to the date of decedent's death
in all other cases; all bonds, postal.savings, treasury·certificates or notes and other evidence of in-
debtedness of the United States to the decedent; all obligations, whether by statute or agreement they
are designated as tax free, of the United States, or any state, or political subdivision thereof, or of
any foreign country, which are owned at the time of 'death; all wearing apparel, jewefry, silverware, pic-
tures,. books, works of art,_ )lousehold furniture, horses, carriages, automobiles, boats, and any and all
other personal chattels of whatsoever kind or nature, left by decedent, together with the fairly estimated
market value thereof; all bonds and mortga~es held by decedent and of all claims due and owing decedent
at the time of death, and all promissory notes or other instruments in writing for the payment of money
of which decedent died possessed, of whatsoever nature, with interest thereon, if any, giving the face
value and estimated fair market value thereof, and if such estimated fair market value be less than the
face value, it sets forth briefly the reasons for such depreciation as to each item; all moneys payable
to the estate from life insurance polici-es carried by decedent; all annuity and endowment contracts the
proceeds of which were payable upon the death of the decedent; and all the corporate stocks and dividends
due thereon and unpaid as of the date of death, bonds and accrued interest thereon to the date of dece-
dent's death and other investment securities owned by the decedent at the time of death, with the market
value thereof at such time.

In the case of securities of close or family corporations, the values reported. are as far as
possible substantiated by financial statements of the corporations, showing the assets and liabilities
thereof as of the date of death. The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business, and in support of the value of such interest there is annexed to
said schedule, financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business, its location, and such other facts
pertaining to the ousiness as may be pertinent to a fair and just appraisal-of the decedent's i~tere~t
therein m~ISt be submitted. It should. also set· forth· fn itemized form, togethe~ ~ith the fair market value
thereof, any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer. to each inquiry
contained therein and in the case of transfers ofproperty, real or personal, within two years of decedent's
death, in contemplation of decedent's death, or intended to take effect in possession or enjoyment at or
after death, said schedule sets forth the nature and value of such property, to whom transferred, the
_relationship of the transferees to the decedent, the proportionate-share received by_ each transferee and
all other facts of a pertinent nature regarding said transfers. In the case of transfers intended to
take effect in possession or enjoyment at or after death, there is also attached to the schedule a co~y
of the deed,· tfust ag~eefuent or other instrument creating the trust. Th~rR is also·set forth in said
schedule a list of all property, real and personal, with its value, which passes at decedent's death by
virtue of the exercise by decedent, either individu~lly, orjoiQtly with another, or any power of appoint-
ment vested in decedent, either individually or jointly, by the will, deed, or other instrument of another,
' ' with a copy of the instrument creating such power attached to the schedule.
That Schedule D attached hereto l.tnd made part hereof sets forth~ the·names and addresses of all
persons beneficially interested in this estate at the time of decedent's death, the nature of their res-
pective interests, their relationship, if any, to the decedent, together with the ages at the time of
decedent's death of all minors, annuitants and beneficiaries for life under decedent's Will. It also
contains a statement showing which of the beneficiaries named in the decedent's will, if any, died prior
to decedent, the dates of their death, their issue, and the relationship of such issue to the beneficiary.
That Schedule E attached hereto and made a part hereof sets forth all property, real and per-
sonal, owned by the decedent jointly with another or others, including intangible, standing in the name
of the decedent and others; plus the ·date and place of record of instruments effecting the vesti ture of·
real estate and the date of acquisition of personalty, plus the name, address and relationship, if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate, including funeral expenses paid;
family exemption, where applicable; costs of administration of this estate; counsel fees and fudiciary's
commissions paid or to be paid; cost expended for burial trusts, tombstones or gravemarkers, and reli-
gious services, in consequence of the death of the decedent; debts and claims owing and tmpaid at time of
death; taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
651 of the Inheritance and Estate Tax Act); together with a statement of collateral pledged for obliga-
tions, if any. It is agreed that the fiduciary will present proof of said claimed obligations upon re-
quest, that if the amount actually paid in settlement of any fee, commission or debt is less than the
estimated amount claiming and allowed, that the same will be reported to the Register of Wills, and that
the amount of tax assessed can be reassessed in accordance therewith.
That the totals of the appropriate columns in Schedules "A", "B", "C", "E", and "F" as directed therein,
have been carried forward and pr~perly registered in the Summary.

on behalf of Don Daley and his minor sister
Eileen Daley. Both now reside with their
mother, Lois C. Morrison, in O~~nge,

California. They are not here today for
obvious reasons. They are i~'sphool .. in
California. However, Mr. Daley was prese~t
in the Commonwealth during the month of
August this year and contacted me through
his grandfather with respect to these matters
at which time we filed a Petition to Compel
Payment and a Citation was served upon
Rose Daley, administratrix of the estate, bV
certified mail on September 2nd and I have
the return receipt card received the 4th of
September, signed by Rose Daley at the
address at which we sent notice to her, as
well as a copy of this Petition to Compel
Payment.

MR. VREELAND: Yes, I am.
THE COURT: I think you
ought to have an affidavit, Mr. Vreeland,
to that effect.
MR. VREELAND: All riqht,

MR. VRF.ELAND: As our petitio
recites, the estate of Mary C. Younq was
opened on the 13th of February, 1971, wnen 1

she passed on. As a result of her passinqt
her sister, Rose Daley, was appointed as thf
j administratrix in the above estate. At that

time, an Inventory was filed on behalf of t~e
Estate and in the Inventory was listed an I

item that reads: "Mary c. Younq, Trustee f?r
Don Daley and Eileen Daley, minors, Savings[
Account No. 3767, at Slovenian Savings and I
Loan Association of Canonsburg. Balance

as of February 13, 1971 (which was at the
time of death) was $747.72."
First, it is
our contention that the account was
account, a Totten trust set up for these
minors with the trustee being then the
decedent, holding a interest in this accoun
up to her death, and the beneficiaries,
Don Daley and Eileen Daley, having of cours
a beneficiary interest and it could be cut
off any time prior to the decedent's death.
However, as such, it was not a Probate asse
and was improperly listed on the Inventory.
However, the administratrix holds the
passbook and refuses to release the same
to the two minors, as well as their mother,
Mrs. Morrison. Included as exhibits in ou
petition are a letter from the Slovenian l
Savings and Loan Association of Canonsburq,\
I Pennsylvania, to Mrs. Morrison, wherein shei
I ~ had requested payment of the funds in this j

account to the children and they advised het

they needed the passbook in order to releasl
the same, and the letter she wrote on March :
22, 1978, to Mrs, Daley, requesting that Mr~.

reply. I might add that these two
documents, the two letters, are just part oF
the requests that have been made, most of t1em
oral on the phone and so forth, and when
they visited in Pennsylvania with other mempers
of the family and all to no avail.
THE COURT: Why does
Mrs. Daley refuse to do this?
MR. VREELAND: There are a
number of stories. One is that Mrs. Daley
feels that her sister meant her to have the
money. The one name on the account,
Don Daley, was I believe Rose Daley's d's
name and she insists that is what her siste
meant, Don Daley her husband and not Don !
Daley the minor in this case. However, t~e
account specifically reads for Don and Eiletn
Daley, minors, and if it has been intended j
for the husband, he would not be listed as I
a minor. That is one explanation the
family has given. The other explanation
that I have received is from Mr. Modrak,
the attorney for the estate and he said
Mrs. Daley is a very hard individual to wor
with, that she has been to about every
attorney in Canonsburg at one time or another
for things, that he had much difficulty
with her in completing this estate, that
she's an obstinate person.
The estate is
closed with the decree signed and the only
asset in the estate was real estate, after
debts and so forth were paid.
THE COURT: I assume Mrs.
Daley has not shown up even though properly
served.
MR. VREELAND: I don't see heft-
and she hasn't responded to calls. I have
also notified the Slovenian Savings and
Loan Association, throuqh their attorney,
Mr. Zeman, and Mr. Zeman and I have been
discussing the matter. We did not feel it
was necessary for him to be here. He says
the bank has refused to pay pending
presentation of the passbook. However, if
a court order were to issue ordering the
bank to do so, they would relinquish the
funds to the designated beneficiaries at

that time. They were concerned with
Rose Daley assigning the passbook to some
third party and that third party showing up
at the bank and presenting the passbook to
secure the funds.
THE COURT: All riqht.
Do you have a proposed form of order?
MR. VREELAND: No, Your Honor

What I would like to propose is that the batk
be ordered to pay to the beneficiaries, witlout
the bank book, and perhaps the Court would
entertain, for safety sake as far as the
bank is concerned, maybe an advertisement
to that effect. I don't know whether
that's in order or not. I'm still

anticipating that somebody could present to!
the bank a passbook as an assigned passbook!
I and the bank would not of course pay it ovet
f but the holder, I guess, could go back agaifst
Rose Daley, and not either of the be~eficiafies.

sort of notice to that effect that the pass~ook
is void and the funds have been paid out?
