time set for a hearing on a Petition to
Settle Small Estate, pursuant to Section
3531 of the Probate, Estates and Fiduciar es
Code. William Johnson,. Esq., representf
. Joseph Hathaway, wao·~: is the claimant
as well as the administr.ator.
MR. JOHNSON: Your Honor, as
you have indicated, this is a Petition to
Settle Small Estate. I have with me
Mr. Joseph Hathaway, who is the administrctor
of the Estate of Paul D~ Babish, and who s
also the claimant. Mr. Hathaway will
testify as to the services that he renderEd
to Mr. Babish during :bhe later years of
his life and would also testify that all
claims against the estate have been paid
and that there are no known.heirs of
Mr. Babish. Mr. Babish had indicated
to him during his lifetime that he was
divorced, that there were no children and
that he had no other known relatives.
I also would propose to offer into the
record a cert'i.fied copy of the decree in
divorce a:t No. 35'Septerriber Term,.l950,

Yes.
You were appointed administrator of his estate in
February of 1971?
Ves, that's right. There was a will made out
there.·
Since tha.t time, has any person contacted you
purporting to be relatives, heirs or beneficiaries
of Mr. Babish's estate.?
No, no one.
·Have you paid any claims that were made against the
estate or any debts owing at the time of his death?
Yeah. I paid some taxes. I paid back taxes,
paid utilities up .. to summer time, until you could
turn them off.anq keep things from freezing and
things •.

And as a result of that sale, did you place that
money in a bank account under the name of the Estat~
of Paul D. Babish?
It was placed in the name of, under his estate but
placed under me and Art Wilson •. Art was the
attorney at the ·time.
After Mr.· Babishts death, did you pay the balance
on his funeral bill?
Yes, I did.
You personally paid that?
Yes, I did.
Did you purchase a grave plot for him?
Yes, I did.
Did you find there were delinquent real estate taxe1
on his property ?
There were some. I forget exactly what.
And some utility bills owed?
Did you expend your own monies to repair that prope1ty
and clean it up?
Just little things, you know~ I spent some for
things that had to be done and I so.ld the property
and.there had to be a little bit done before I sold
it, to get the people to buy.
You testified you knew the decedent for approximate y

Oh, for the last four years. he lived, I went and go
all of his groceries and all his running around for

No, I didn't.
Did you assist him in the collection of pensions
and benefits due him?
Yes. He tried to get black lung and I took him to
all the clinics, ~he places·over in Pittsburgh ovei
on Penn Avenue. ~A7e was at Monongahela, Centerville·
Clinic, Uniontown to the miner's place over there,
trying to get it.·
Did Mr •. Babish drive a car?
No.

and that was. when he died, you know; when he was in
the hospital.

Yeah. I had.to mow the grass and things like that
to keep it looking half way nice.

He ·said everything belongs to me. He made a will ott
but he never signed the'will. Greenlee made the
will out. I was up the attorney's office when he
made 'it. Greenlee made 'it out and sent it to him

Yeah. He had in his mind that he had a lot of
money.
And you actually did go to the attorney's office
with him shortly before his death and you were

leaving you as his only-beneficiary?
That's right. He left a will, in case. I had to
take care of him when he died, m·ake a burial for hi n
and everything like that.
Mr. Hathaway, do you believe the reasonable value
of your services over the 'last several years of
Mr. Babish's life. were worth at least the $3500.00
for which his property was ultimately sold?
I think it was. ·I think it was worth more than
that. You feel sorry for the old man and I tried
to do all I could to help him because ·there wasn't
no one else to help him.

1. Paul D. Babish, died intestate on January 16 ,. 1971,
a resident of Washington, Washington County, Pennsylvania.
2. Your petitioner, Joseph W. Hathaway, resides at 12
Altamont Avenue, Washington, Washi:ngton County, Pennsylvania.
3. Letters of Administration were awarded to your
petitioner by the Register of Wills of Washington County, Pennsyl-
vania, on February 24, 1971.
4. The said decedent died seized of the following
described real ~state which is the ~ubject 6f this Petition:
ALL that certain lot of ground situate_in the
City of Washington, Washington County, Pennsylvania,
kn9wn and designated as Lot No. 8 in Block ''G" in the
plan of lots known as the Shirls Grove Addition, being
more particularly bounded and described as follows:
On the North by Hoge Alley; on the South by
Addison Street, on the East by Lot No. 7i on the West
by Lot No. 9. Fronting 30 feet on Addison Street and
extending back of even width a distance of 150 feet to
Hoge Alley.

Between JOSEPH W. HATHAWAY, Executor of the Estate of Paul D. Babish, deceased,
(hereinafter caliled "Seller") and
JM1ES R. SHRIVER and INEZ F.-· SHRIVER, his vJif'e, (hereinafter called "Buyer"),
WITNESSETH, that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows: ·
1. Seller agrees to sell and convey to buyer on or before Nov ember 1, 1971
by s pee iat warranty deed in fee simple absolute, clear of all ·~ortgages, judgment liens
and tax liens and c>ther encumberances affecting its marketability (except as hereinafter set forth) all the real property
described in Paragraph 7 hereof. ·
2. Buyer agrees to purchase said real property and to·pay Seller therefor the sum of three thou sand
five hundred seventy-1'ive ----{$ 3575.00 ) Dollarsasfollows: $357.50.hand money
herewith and balance of $3217.50 on delivery of deed and possession.
3. Possession shall be given on or before November
at the office of Seller's attorney on or. before Nov. 1, 1971
agreed.

4. At settlement Seller shall pay for or be charged with the cost of all federal documentary· taxes and
state and local realty transfer taxes payable upon this transaction, but real estate taxes for year of settlement, sewer

delivery of possession of the premises; except as hereinafter set forth:
Stamp taxes to be divided equally, seller pay state, buyer pays

5. From and after the date of this agreement, insurance shall be provided and paid for as follows:
Each party ·to protect own interest.
6. Time is not of the essence of this Agreement.
7. The real property which is the· subject of this Agreement is described as follows:

8. If Buyer defaults in· payment or performance for 30 days, Sell~~ may, at Seller's election
use one or. more of the following remedies in addition to or instead of any other remedies provided by law:
(a) rescind this agreement and retain all sums paid on account hereof as'liquidated damages, in·
. which case Seller shall· retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this Agreement for cancellation;
(b) eject Buyer 'from said real estate, for which purpose Buyer hereby authorizes any attorney
of any Court of Record to appear for Buyer and confess judgment against Buyer in an amicable action of ejectment,
with immediate writ for possession of the real estate and for damages, to include attorney's commission of 10 %
or $ 200. 00 and costs, hereby waiving stay of execution, exemption and inquisition, with release of all errors;
(c) affirm this agreement by delivery of deed to Buyer, declare all sums due hereunder to be
forthwith due and payable, and cause judgment to be entered therefor, for which purpose Buyer hereby authorizes
and empowers any attorney of any Court of Record to appear for Buyer and confess judgment against Buyer for
the whole balance due, together with interest, attorney's commission of · 10 % or $ 200. 00 , and costs,
and hereby agrees to immediate execution thereon, waiviing stay of execution, exemption and inquisition, with re-
lease of all errors.
9. The Buyer agrees not to record this Agreement and recording by the Buyer shall constitute a breach
thereof.
10. This Agreement shall extend to·and benefit and bind the heirs, executors, administrators, successors and
assigns of the parties. Whenever used herein, the singular number shall include the plural, the plural the singular
and the use of any gender shall include all genders. .
NOTICE -THIS DOCUMENT MAY NOT SELL, CONVEY, TRANSFER, INCLUDE OR INSURE THE TITLE TO THE COAL
AND RIGHT OF SUPPORT UNDERNEATH THE SURFACE LAND DESCRIBED OR REFERRED TO HEREIN, AND THE

death, the said Paul D. Babish was seventy-seven(77)years of aae.
2. On February 24, 1971, Letters of Administration on
said estate were granted to Petitioner by the Register of l'Jills of
Washington County, Pennsylvania.
3. At the time of his death, the Decedent was the owner
of a tract of land situate in the City of Washington, Washington
County, Pennsylvania, known and designated as Lot No. 8, Block G,
in the Shirls Grove Addition which si.ad lot fronted thirty (30)
feet on Addison Street and extended back of even width a distance
of one hundred-fifty(lSO)feet to Hoge Alley. Said lot which is
more fully described in Deed Book 587, page 634, was the sole
asset of the Decedent at the time of his death.

consideration of the Petition to Settle Estate Under $10,000.00
pursuant to Section ~531 of the Pennsylvania Probate, Estates
and Fiduciar±es..:Code, and after a hearing held on the s:ame on
November 2, 1981, and the Court being satisfied as to the
validity and the amount of the claim of JOSEPH HATHAWAY, the
Court hereby awards to said JOSEPH HATHA'VJAY as partial reimburs-··"
ment for services rendered to the decedent and for monies
advanced in behalf of the decedent, the balance of $4,132.87
representing the balance for distribution in said estate to the
said JOSEPH HATHA~vAY. Forthwith after the entry of this Decree,
i the said JOSEPH HATHAWAY is hereby directed to file the appropriate
Pennsylvania Inheritance Tax Return:·and on said return to list
as a debt of the decedent, the amount of the claim of Mr.
Hathaw~y in the amount of'$4,132.87 and after proof to the Court

I hardly ever went_any ·place just on that account-

just couldn't get along I guess.

for_a while-getting pretty drunk-and after a whil
this other guy left, and then Paul wanted some cigar-
~tte·s, and he went down to get -the cigarettes in -the
.basement. We had rooms in the basement and upstairs ~
rooms too. ·. Well he. went-dmm there and he couldn't ® :f:, find the cigarettes ·-he looked all over and then he .f:
wanted me to.: come do\m and get them for. him·-I told · : _ ~
him. where they were but. he couldn't see them, and was t!
yelling around so I got·up and went down to the cella ffl

He was just throwing everything all over the cellar, ~
and I said to him you know you shouldn't drink like -~
