Under the Intestate Act the petitioner is entitled to the entire :ten thousand ($10,000.00) dollars, or a pertion thereof. 5. The Administratrix and her attorney have been requested on several occasions to account for the said ten thousand ($10,000.00) dollars but have failed to do so. ANSWER TO RULE AND NOW, comes EVELYN ZAPPI and makes the following answer to the rule issued in this case: 1.·-2. ·The allegations of paragraphs l and 2 are admitted. 3. The allegation of paragraph 3 that $10,000 in cash was located in·the safety deposit box is admitted except the total cash in the box was $10,399. It is admitted that an inventory has not yet been filed. 4. The allegation·of paragraph 4 that the pe- ~itlb~~~ is entitled to all or a portion of the cash found in the box is admitted unless the cash is found to belong to Evelyn Zappi. 5 .. The allegationsof paragraph 5 are admitted. 6. By way of further answer and explanation for her delay in filing an inventory , Evelyn Zappi sets forth the following: 6.1 The sum of $ 9750 has been deppsited -1- j ------------ ' '- in an interest-bearing account so that the eventual heirs are protected against loss due to the passage of time. 6.2 The sum of $649 was cash which she placed in the safety deposit box. 6.3 She feels that the balance of the money in the box is hers by virtue of her mother's ( the decedent intention but has been advised by counsel that if she intends to claim it, it will be necessary that she resign as administra- trix and pending her final decision as to whether she should make legal claim for the money , she'has not fiaed an inventory.
