PET I T ION BY AN EXECUTOR FOR LEAVE TO SELL PROPERTY OF THE ABOVE NAMED ESTATE UNDER THE PROVISIONS OF SECTION 541 OF THE FIDUCIARIES ACT OF 1949 As AMENDED TO THE HONORABLE,P.V.MARINO,PRESIDENT JUDGE OF SAID COURT: The Petition of JOHN A.THOMAS,Administrator of the Estate of Carter Thomas respectfully represents: 1.That the decedent,Carter Thomas,resided at Van Voorhi , Fallowfield Township,Washington County,Pennsylvania,and died intestate on December 6th,1970. 2.That your Petitioner was duly appointed as Administrato on November 13,1971,by the Register of Wills'of Washington County,Pennsylvania. 3.That your Petitioner is the Son of Carter Thomas,and is a resident at 62 Park Manor,Monessen,Pennsylvania 15062. 4.That there are only two heirs of the said Carter Thomas namely,your Petitioner,John A.Thomas,and Leonard L.Thomas, who is a resident of 12816 Conway Street,Detroit,Michigan 48217. 5.That the said Leonard L.Thomas has filed for renouncia tion of his right to administer said Estate and has given full authority to John A.Thomas to proceed with the sale of the pro- perty hereinafter referred to. • I 6.Your Petitioner has filed with the Register of Wills' of Washington County,Pennsylvania,a bond in the amount of Two Thousand Five Hundred ($2,500.00)Dollars,which bond was furnish- ed by a Corporate Surety. 7.That the above named decedent owned real estate at the time of his death described as follows: ALL that certain parcel of land situate in Fallowfield Township,Washington County,Pennsylvania, being Lot No.21 of the Valley Camp Coal Companies Plan of Lots of Soudan,and which property is more specific- ally described in the Recorder's Office of Washington County,Pennsylvania,in Deed Book Volume 660,at Page187. 8.That the real estate is subject to a lien in the amount of Two Hundred Eighty-Five and 75/l00ths ($285.75)Dollars,pay- able to the Department of Public Welfare,Commonwealth of Pennsyl- vania,and Twenty-Five and 65/l00th ($25.65)Dollars in liened taxes,payable to the Washington County Tax Claim Bureau. 9.The Petitioner has executed a contract to sell the pro- perty to Joseph Dobranski and Catherine L.Dobranski,his wife,fo a price of Two Thousand Five Hundred ($2,500.00)Dollars,and a copy of this Contract of Sale is attached hereto and made a part hereof as Exhibit "A". 10.A notice of this sale and Petition has been sent to Leonard L.Thomas,the only heir,other than the Petitioner,there fore,notice by publication is unnecessary. 11.The total Estate of the decedent is less than Five Thousand ($5,000.00)Dollars,and it is heretofore stated that your Petitioner is bonded in the amount of Two Thousand Five Hundred ($2,500.00)Dollars.Therefore,the Petitioner requests the Court,pursuant to Section 541 of the Fiduciaries Act of April 18,1949,P.L.,512,20 P.S.Section 320,541,as amended,to -2- ..., waive the filing of additional security before he may receive the proceeds from the sale of the real estate described herein. 11.Attached hereto and made a part hereof as Exhibit "B"is an Appraisal of said property. 12.Other than the liens above referred to,there are no creditors in the Estate of Carter Thomas,deceased,in that all debts have been paid other than the inheritance tax and normal costs of administration and attorney fees. WHEREFORE,your Petitioner prays your Honorable Court,under Section 541 of the Fiduciaries Act of 1949,as amended,to grant leave to your Petitioner,without additional security,to sell the said property for Two Thousand Five Hundred ($2,500.00)Dollars,and to authorize and empower him to execute and deliver a deed to said property to the above named prospec- tive purchasers.
