just received this morning and in HIe letter he 'ljequested that we
hand you a copy of the answer,iff we call it that,filed by Mr.
Rogers in the form of a letter answering Mr.Faixls letter,So
we will let you have that now and you can read it.You can look
that over and see if there is any change by reason thereof.

PETITION
TO THE HONORABLE,THE JUDGES OF THE SAID COURT
AND NOW comes Philip A.Faix,Jr.,Esquire,as an
officer of this Honorable Court and friend of the three minor
beneficiaries of the Estate of James G.Spaulding,and represents
as follows:
1.That he is a member of the law firm of Griggs,
Moreland,Blair &Anderson,1707 Oliver Building,
Pittsburgh,Pennsylvania 15222;and that he is
admitted to practice law before the Supreme Court
of Pennsylvania and all other courts;
2.That the said firm represents Robert F.Rogers
who was appointed administrator of the Estate of
James G.Spaulding,Deceased on November 1,1966;
3.That James G.Spaulding died on October 1,1966
and was a legal resident of Washington County,
Pennsylvania at the time of his death;
4.That no inventory or account has been filed by
the said administrator since his appointment;
5.That the sum of sixty($60.o0)Dollars was paid
on September 27,1967 to the Pennsylvania State
Inheritance Tax Department;
6.That Commonwealth of Pennsylvania Form Rcc-62
has not been filed;
7.That only one bond premium with respect to the
administrator's bond was paid and there is bond
premium due and owing;
8.That the Honorable P.Vincent Marino,President
Judge of the Orphans'Court Division of this Honorable
Court executed an Order dated March 17,1967 awarding
to Patricia M.Spaulding,surviving spouse of the said
James G.Spaulding,one 1963 Chevrolet Bel Air Sedan
Serial Number 31669B2l259 listed at $985.00 plus
$15.00 in cash pursuant to her Petition for Family
Exemption under Section 211 of the Fiduciaries Act
of 1949,as amended;
9.That letters of administration to said Robert F.
Rogers were advertised on May 14,21,and 28,1970,
in the washington County Reports and in the Valley
Independent on May 15 and 22,1970;
10.That he has requested the aforesa.id administra-
tor many times orally and in writing without avail
to file an inventory,an account and va.rious other
legal documents to fulfill his statutory duties
under the applicable laws of the Commonwealth of
Pennsylvania;
WHEREFORE,your petitioner prays that a citation
be awarded and directed to Robert F.Rogers as the administrator

istration of the said Estate.

at his residence Beech Creek,Clinton County Pennsylvania

As you see by my new address I am now about 190
miles from Pittsburgh.This has created two problems
I took on this work last Sept.and at the request of
the Council of Ten of our Association moved central-
state.
My problem Is this.I have no office space there
for all my books and files had to be put Into storag •
We are planning to purchase a home this spring that
will be large enough to have an office.I will then
be able to get ·to the Spaulding file.
Since you represent me I would like to ask you
with your fi Ie give an account of the estate less
the charges by the Attorneys and perhaps an equal
amount for the Administrators fees.I'm sure you
will have most everything there.Then too,as the

PETITION TO WITHDRAW
TO THE HONORABLE,THE JUDGES OF THE SAID COURT
AND NOW comes the firm of Griggs,Moreland,Blair &
Anderson and Philip A.Faix,Jr.,Esquire,as officers of your
Honorable Court and as friends of the widow and three minor
beneficiaries of the Estate of James G.Spaulding,Deceased,and
represent as follows:
1.That the firm of Griggs,Moreland,Blair &
Anderson is a partnership engaged in the practice
of law and is located at 1707 Henry W.Oliver
Building,Pittsburgh,Pennsylvania 15222;
2.That the petitioner Philip A.Faix,Jr.,is a
member of the above described law firm and is
admitted to practice law before the Supreme,Superior,
and Commonwealth Courts of the Commonwealth of
Pennsylvania and before the Court of Common Pleas
of Allegheny County,Pennsylvania and is duly
licensed to practice law in said Commonwealth.
3.That the decedent,James G.Spaulding died on
October 1,1966 and was at that time a legal resident
and citizen of 40 Dinsmore Avenue,Burgettstown,
Washington County,Pennsylvania 15021.

4.That the above law firm of Griggs,Moreland,Blair
&Anderson was employed initially in October 1966 by
Mrs.Patricia M.Spaulding,the surviving spouse of the
decedent to handle the legal matters pertaining to the
probate,adminietration,and distribution of assets of
the Estate of James G.Spaulding,Deceased.Said firm
was subeequently employed by Robert F.Rogers who was
appointed administrator by your Honorable Court on
November 1,1966,to render him in his fiduciary
capacity legal advice concerning problems in the
probate,administration,and distribution of assets
relative to the aforesaid Estate.
5.That the said firm entered a lawsuit on behalf of
said Patricia M.Spaulding and Robert F.Rogers,as
Administrator of the Estate of James G.Spaulding,
Deceased,against Edward F.Scullion,Jr.,Administrato
of the Estate of Edward F.Scullion,Deceased,listed
at No.1900 July Term 1967,in the Civil Division of
the Court of Common Pleas of Allegheny County,Pennsyl-
vania.According to records of said Court,the lawsuit
was fully settled for the sum of Twelve Thousand Five
Hundred ($12,500.00)Dollare which was given to Patrici
M.Spaulding outright pursuant to a Order of Court
dated August 2,1967.
6.That the folloWing described events show what else
has been done in connection with the probate and admin-
istration of the Estate of James G.Spaulding,Deceased
a)Sum of Sixty ($60.00)Dollars was paid on
accouqt on September 27,1967 to the Pennsyl-

Dollars in cash pursuant to her Petition for
Family Exemption under Section 211 of the
Fiduciaries Act of 1949,as amended.
d)Advertisement of the Grant of Letters to
said Robert F.Rogers was made in the
Washington County Reports on May 14,21,and
and 28,1970 and in The Valley Independent on
May 8,15,and 22,1970 as required by
Section 312 of the Fiduciaries Act of 1949,as
amended.
7.That no inventory or an account for the Estate of
James G.Spaulding,Deceased,has been filed by Robert
F.Rogers as administrator since his appointment on
November 1,1966 despite numerous oral and written
communications beginning in February 1970 by the
individual petitioner to do so.
8.That the individual petitioner had filed a Petition
on January 27,1971 as an officer of your Honorable
Court to issue a Citation directed to Robert F.Rogers
as administrator of the Estate of James G.Spaulding,
Deceased to show cause why he had not filed an inventor
or an account.The said citation was issued by your
Honorable Court by an Order dated January 27,1971
executed by the said Judge Marino.Said Petition,

Citation,and Order were served personally on
February 1,1971 on said Robert F.Rogers in Beech
Creek,Pennsylvania by a duly authorized member of
the Sheriff's Office of Clinton County acting as
the duly constituted agent of the Sheriff of
Washington County.Said Robert F.Rogers failed to
appear in person on the return and hearing date on
March 8,1971 in Washington County before said Judge
Marino despite the aforesaid Order of Judge Marino.
9.The individual Petitioner telephoned Judge Marino
to make an appointment with him to discuss the impasse
between said petitioner and his aforesaid client for
the latter's failure to file an inventory and an
accounting.Said petitioner sent Robert F.Rogers a
special delivery,return receipt requested letter
dated March 19,1971 directing that he appear with
him on Friday,April 2,1971 at 2 P.M.before said
Judge Marino in his chamber in the Washington County
Courthouse.Said Robert F.Rogers failed to appear
or give any explanation of any type by any method
at any time to the individual petitioner or to Judge
Marino of his reasons for his failure to appear on the
aforesaid date.
WHEREFORE,your petitioners pray for the reasons stated
above that your Honorable Court issue an Order withdrawing them as
counsel for the above captioned Estate.
