And I have here on his behalf a Petition for Audit of his account
at this time.It is the First and Partial.Most of the proceeds
for distribution,which are around $6700.00.comes from the sale pf
real estate.The rest of the money is money he is receiving.I

believe,as a statutory payee of the Social Security.And there is
a copy of the notice sent to all parties in interest and my PraecipE
for Appearance.There is no particular problem here,excepting
that the balance for distribution,Mr.Terputac suggests to Your
Honor that it be paid back into his hands.However,there is a
very substantial claim here by the Commonwealth of Pennsylvania
for the care and keep of this ward for the past 25 years up in
Torrance.It's a very substantial claim and I believe that they
would like to be heard as to payment of this balance for distributi n.

She's been declared mentally incom petent legally
and she's been there and from the way things look,she will be
there for awhile.She's been there for 20,25 years now.

a detailed and certified statement prepared on behalf of the
Torrance State Hospital,Department of Revenue for this patient,
Erma Riva . I am here appearing on behalf of Mr.Keller,DeputJ
Attorney General.
The position of the Commonwealth basically is
that $26,376.11 were owed as of the date of this certified statemEnt.
I unders tand that payments are being made from the fund in the
hands of the guardian on a monthly basis.However,we submitted
our claim to the guardian and as I understand the proposal for

distribution,the guardian proposes that the money be distributed
to tTh.€guardian for future payments.Basically,it is the position
of the Commonwealth that this money should be paid directly to
the Department of Revenue since there is not much likelihood that
this patient will ever regain her competency and be released~
at least based on past history and future prognostication.And
:!z~we think that under the Support Law under 62 Purdons,Section
~01
Z~1974 and the other appropriate sections of the Support Law,
