PETITION FOR HEARING TO
DETERMINE CLAIMS AGAINST THE ESTATE
The petition of Jacob E.Blangger respectfully repre-
sents:
1.That Edward J.Blangger,a/k/a Edward Blangger,died
intestate on October 30,1967;
2.That Letters of Administration were issued by the
Register of Wills of Washington County;Pennsylvania,to Jacob E.
Blangger on November 3,1967;
3.That an Account has been filed and the Estate has
been called for an Audit on the third Monday of March of 1971;
4.Thatthe~mmonwealthof Pennsylvania,Department of
Public Assistance has filed a claim against the Estate in the
sum of Two Thousand Four Hundred eight and 30/l00ths ($2,408.30)
Dollars,and Nancy Blangger,now Nancy Harrison,filed a claim
against the Estate in the sum of Three Hundred and OO/lOOths
($300.00)Dollars;
5.That both claims have been denied by the Adminis-
trator;
6.That efforts have been made to arrive at a just
amount of the claim of the Department of Public Welfare;but to
date,the Commonwealth and the Administrator have been unable to
agree on the amount due to the Department of Public Assistance,
if any;and neither of the parties have been able to arrive at
a settlement of the claim of Nancy Blangger,now Nancy Harrison.
WHEREFORE,your Petitioner prays your Honorable Court
to set a date for a hearing on both claims so that this Estate
may be finally closed.

J.Paraska,discussed this estate matter with you on July 15,1971.
Following is the Department of Public Welfare's claim:
Claim vs.Edward J.B1angger for assistance granted May 8,1965 through
October 11,1966 and February 1,1966 through August 24,1966 totals
$1363.60.We received payments in amount of $1069.90,leaving a balance
due of $293.70.
Claim vs.Nancy Blangger for assistance granted May 15,1964 through
December 23,1965 totals $2ll4.60.Included in the grant were her four
children,Edward,Richard,Deborah and Susan Blangger.
We respectfully request that our claims be presented and admitted by
the court.

I ,Since we have been unable to determine this claim against
the Estate of EdHard J.Blangger,I have prepared the enclosed
Petition for Hearing and left it with the ~-Jashingtoll County
Orphans'Court Judge,the Honorable Paul A.Simmons,to set
a date and time.Judge Sinunons is currently on vacation,but
I felt that I \vould give you advance notice that this matter
is coming up,and as soon as we are informed of the date and
time of the ~eari&.1g.\Ve will notify you.Tnis should give you
sufficient time to get all the papers together.
From my prior meeting with your office,it appears to me
that assistance is being charged against this estate by ass'istance
paid to the ex-wife of the dededent after their divorce.Assistance
'was paid to her on behalf of certain children;and at the same
time,they were being paid to him on behalf of the same children.
Primarily,this is our position,and vle feel that the estate is
not responsible for any assistance paid to the wife after the
divorce was granted,or to the wife on behalf of the children,
when it was also being paid to the husband on behalf of the same
children.

AND NOW,this 26th day of September,1974,it appearing that
a hearing was scheduled to determine the claims of .the Commonwealth of
Pennsylvania against the estate of Edward J.Blangger;and further,it
appearing to the Court that although the Commonwealth was properly notified
as to the time and place of this hearing,it nonetheless failed to appear;and
further,it appearing to the Court that the Commonwealth has at no time
filed a proper and accurate claim sufficient to permit the attorney for the
said estate to respond to the same;
NOW,THEREFORE,it is the order of the Court that the
Commonwealth of Pennsylvania shall file a formal claim against the Estate
of Edward J.Blangger,also known as Edward Blangger,if such claim exists,
on or before October 22,1974,with this Court and shall send an exact copy of
said claim to Barna &Barna,Attorneys for the above captioned estate.
Further,it is the order of this Court that a hearing in regard to
this matter shall be held on November 20,1974,at 10:00 o'clock A.M.,in
Courtroom No.5,at which time a full hearing will be held on all matters
raised by the claim of the Commonwealth of Pennsylvania against the estate of
Edward J.Blangger,deceased.

Further,it is the order of the Court that the representatives of
the decedent's estate shall have twenty days to answer the formal claim
submitted by the Commonwealth;if they so wish.This ans~er of the
representatives of the decedent's estate shall be filed with the Court and made

available to the attorneys for the decedent's estate all of their records and
files pertaining to this matter.The representatives of the decedent's estate

MOTION TO DISMISS-
AND NOW,comes PAUL N.BAID~A,JR.,ESQUIRE,of the Law Firm
of Barna and Barna,Attorneys for the Executor of the above estate,
and moves that the claim of the Commonwealth of Pennsylvania be
dismissed for the reasons set forth below:
1.On May 8,1968,the Commonwealth of Pennsylvania notified
the attorneys for the Executor in the above estate that it had a
claim in the amount of $2,408.30,for assistance granted.
2.On March 5,1971,the attorneys for the estate notified
the Commonwealth of Pennsylvania,Department of Public Welfare,
Office of Administrative Services,that their claim was ~\denied and
that the audit of this estate would be held the afternoon of
March 15,1971.An Affidavit of Service of mailing the said claim
has been filed in the Clerk of the Orphans'Court Office of
Washington County,Pennsylvania.
3.The Commonwealth of Pennsylvania did not appear at the
audit on March 15,1971,to submit their claim as required by the
Fiduciaries Act of 1949,§6l6.
4.The Commonwealth of Pennsylvania never filed a formal
claim in the above estate for any public assistance due.
5.Since the date of the audit,the Commonwealth of Pennsyl-
vania has never moved to have a hearing set or to have their claim
adjudicated by the Orphans'Court of Washington County,Pennsylvan·a.

6.On or about July 15,1971,the Commonwealth of Pennsylvani
has discussed this claim,ex parte,with the then Audit Clerk of
Washington County.
7.On July 26,1971,the Commonwealth of Pennsylvania,by
letter to the then Audit Clerk of Washington County attempted to
have the Court rule on their claim without a hearing.
8.On November 19,1971,eight months after the audit,the
Claim Settlement Agent of the Commonwealth of Pennsylvania filed a
claim with the attorney for the Executor of the estate,claiming
that $2,616.30 was due the Commonwealth of Pennsylvania,and
requested notice of the filing of the account in this estate.
(They were given notice of the filing of the account on March 5,
1971.)
9.On April 21,1972,Paul N.Barna,Jr.,Esquire,made a
special trip to the Administrative Offices of the Department of
Public Welfare at the Pittsburgh State Office Building in an
attempt to resolve this claim with the Department.After waiting
over one hour,he was able to meet with one of the Claim Settlement
Agents.Some of the records of the claim were pulled,but the
Agent advised him that many of the records were not available and
could not be found.However,this Agent promised to get all the
records t?gether and recompute the claim.
10.It was not until September 24,1974,that a recomputation
of the claim was sent to the attorney for the Executor in the amount
of $2,005.58.This letter also requested that written notice of
the filing of the account in this estate be sent to the Department
of Public Assistance.
11.On August 14,1974,attorney for the estate petitioned the
Orphans'Court Division of the Court of Common Pleas of Washington
County for a hearing to determine the claim of the Commonwealth of
Pennsylvania.

12.On August 21,1974,Judge Paul A.Simmons signed an Order
setting September 26,1974,at 10:00 o'clock,a.m.,as the date and
time for said hearing.
13.On August 21,1974,Paul N.Barna,Jr.,attorney for the
Executor,gave notice to the Commonwealth of Pennsylvania,
Department of Public Assistance,of the date and time of the hearin
and enclosed is a copy of the petition for a hearing.An Affidavit
of Service has been filed with the Court.
14.On September 26,1974,at 10:00 o'clock,a.m.,the
attorney for the Executor of the estate appeared before the Honorab e
Paul A.Simmons,prepared to defend the claim,at the Orphans'Cour
courtroom,Court House,Washington,Pennsylvania.No one from the
Commonwealth of Pennsylvania had appeared,nor did they notify the
Court or Mr.Barna that they would not appear.
15.On September 25,1974,Paul N.Barna,Jr.,Esquire,
personally called Betty Duvall,Claim Settlement Agent,of the
Department of Public Welfare in Pittsburgh,reminding her of the
hearing;and she assured him that a representative of the Departmen
would attend the hearing.
16.On September 23,1974,the office of Paul N.Barna,Jr.,
Esquire,received a telephone call from William A.Johnson,Esquire,
Deputy Attorney General of the Commonwealth of Pennsylvania,
inquiring as to whether or not this claim was admitted.
WHEREFORE,your petition respectfully requests the Court to
dismiss the claim of the Commonwealth of Pennsylvania on the groun s
that:
(a)they did not file a claim at the audit after receiving
due notice of the audit;
(b)they are guilty of laches in that they have not filed
their claim as of the present time;

(c)they have not pursued their claim;
(d)they have delayed for a period of over two years in
recalculating their claim;and
(e)they failed to appear at a hearing specially set after
due notice had been given.

Edward J.B1angger,a/k/a Edward B1angger,Deceased,and request
additional fees for the following services performed:
The Commonwealth of Pennsylvania,Department of Public
Assistance,filed various claims against the Estate,for which
the Administrator had a receipt "Paid in Full"showing that there
was no balance due.In trying to resolve this claim,the
attorneys for the Administrator performed the following extra
legal services:
1.Conferred with John Hana,Audit Clerk,about
this matter at the time of the Audit of the estate and at
various other times thereafter;
2.Corresponded with the Department of Public
Assistance and other officials on numerous occasions which
resulted in approximately 25 pieces of individual corres-
pondence which is in our file on this matter;
3.On April 21,1974,met with Mrs.Betty Duvall
at the Claims Settlement Division of the Department of
Public Assistance at the State Office Building at
Pittsburgh,from 1:15 o'clock,p.m.,until after 4:30
o'clock,p.m.,most of which time was spent waiting for
the file to be located and then explaining our position;
4.August 21,1974,prepared and filed a petition
setting a hearing date for September 26,1974;
5.September 26,1974,appeared at hearing at
which no 'one from the Commonwealth appeared;prepared
affidavit of service and filed the same;
6.November 20,1974,appeared at the rescheduled
hearing with the Administrator and defended the claim.The
result achieved was that the Court dismissed the Common-
wealth's claim of $2,005.00.

returns for the years 1972,1973 and 1974.

AND NOW,comes PAUL N.BARNA,JR.,ESQUIRE,of the Law
Firm of Barna and Barna,Attorneys for the Executor of the above
estate,and in addition to the reasons cited in the Motion to
Dismiss the complaint of the Commonwealth of Pennsylvania which
was filed on or about September 26,1974,sets forth the followin
additional reasons to have the claim of the Commonwealth of
Pennsylvania dismissed:
1.That on September 16,1974,the Honorable Paul A.
Simmons,in his Order of that date,ordered the Commonwealth of
Pennsylvania to file a formal claim against the Estate of Edward
J.Blangger,a/k/a Edward Blangger,if such claim existed,on or
before October 22,1974.
2.That on October 21,1974,Mr.Barna received a letter
from William A.Johnson,Esquire,the Attorney representing the
Commonwealth in the above Estate,in which he stated:
"...I am enclosing a breakdown of the Department
of Public Welfare's claim in the aIIDUI1t of $2,005.58 in the above
referred matter."
The material that was submitted was illegible,incomprehendible,
and does not comply with the local rules of the Orphans'Court as
set forth in Section 3 and Section 6.

3.It is impossible to file an Answer to the incoherent
and illegible matter that the Commonwealth submitted to the
Attorneys for the Executor,which is interpreted to constitute
the Commonwealth's claim.
WHEREFORE,your petitioner respectfully requests the Court
to dismiss the claim of the Commonwealth of Pennsylvania against
the Estate of Edward J.Blangger,a/k/a Edward Blangger,at the
above number and term.

Dear John:
In the above estate I believe we have the following
questions to resolve:
1.Necessity of a guardian --the account shows that there will be
less than $7,000.00 for distribution after deducting the inheritance
tax and the possiple claims and audit costs.One-fourth of this
amount,of course,leaves less than$;l,7S0.00 to each one of the
minor children.The ages are set forth on the third page of the
audit petition.I called one of the banks about an appointment of
a guardian and they called my attention to the fact that under the
Amendment to the Fiduciaries Act of 1949,Act No.136 of 1970,found
in pocket parts of 20 P.S.320.1001,the amount that may be distributed
to the'parent as natural guardian has been increased from $1,000.00
to $5,000.00 for each child.This money is now on deposft in the
Pittsburgh National Bank,Donora office.We are suggesting that the
court award this money to Nancy Harrison,mother of the said children
~Dg Q~g§~t~s!~~E~~~E8~~te,e ~~~ee Pi~t~b.~rgh National Bank,and
not to be wlthdrawn before the age of 21wlthout an Order of Court.
In this way,we will save a lot of costs,especially since one boy
will be 21 next April and the second boy will be 21 in February of
1973.To the above amount is to be added the $1,000.00 family exemption,
which is to be divided among the four boys,as their motner was divorced
from the father,Edward Blangger,before his death.
2.D.P.A.Claim --we received a letter from the claims settlement
office,dated May 8,1968,a copy of which is attached.Among the
papers of the decedent,we found a cancelled check in the sum of
$1,024.40,dated October 19,1966.We also found a letter dated March 3,
1967,addressed to Edward Blangger which carries a cross-reference
to Nancy Blangger.Since Edward Blangger paid the D.P.A.$1,024.40
in 1966,we are assuming that this was a settlement of his share of
the amount that was owed to D.P.A.,and that the remainder was likely
incurred by Mrs.Blangger after the divorce.I wrote to the D.P.A.
Mr.John Hana -2-July 13,1971
on January 7,1971,asking for the dates on which Public Assistance
was paid and the amounts that were paid on each date.I am enclosing
a copy of that letter.To date we have not received a reply to that
letter.We have also sent them a notice of the audit on March 5,1971,
and advised them of the date on which the audits would begin,to which
again we received no reply.I am enclosing a copy of our letter and
the notice of audit in which we state at the bottom that their claim
in the amount of $2,408.30 is denied.No one from the D.P.A.appeared
at the audit and we may therefore disregard their claim.
3.Expenses of Nancy Harrison --these are travel expenses to Arizona
in connection with the estate.After Mr.Blangger was buried,the
mother,Nancy Harrison,went to Arizona to pick up all the childrens'
belongings and to bring back the Volkswagen automobile,which has been
since sold and assets accounted for in the estate.The following is
an explanation of her bill,a copy of which is also enclosed:--I did
put question marks in back of the trailer and hitch,but it was explained
that they rented a U-Haul trailer to transfer the beds,chest of drawers,
mattresses,springs,drums,clothing,etc.The hitch was needed to
connect the trailer to the VW.
4.Our bill of $750.00 --I do not know whether or not Paul explained
that this was charged for the death claim action against the estate
by the estate of the passenger in the automobile at the time of the
accident in which Mr.Blangger and his friend were both killed.Suits
were filed in the Federal Court in Pittsburgh,Federal Court in Arizona,
and the Court of Common Pleas of Arizona.We were finally able to have
the court discontinue all of the proceedings with prejudice.
I believe that with the above explanations you may
possibly be able <to close this estate.If you have any other questions,
please contact me.
