TO EXECUTOR
TO THE HONORABLE JUDGE OF SAID COURT:
The petition of James Alexander Taggart,respectfully
represents:
1.That the decedent,James F.Taggart a!k!a J.Leroy
Taggart,who resided at R.D.#2,Avella,Pennsylvania (Hopewell
Township)died on January 1,1971,leaving his Last Will dated
March 24,1964.
2.That said Will was probated on January 6,1971,in
the Office of the Register of Wills for said County and Letters
Testamentary were issued to your petitioner on said date.
3.That your petitioner has not completed his investi-
gation of the assets of said estate and,therefore,has been
unable at this time to file an Inventory and Appraisement of said
assets.
4.That the decedent died seised of a tract of land
in Hopewell Township,Washington County,Pennsylvania,containing
144.443 Acres,more or less,as more particularly described in
deed of Anna Mary Taggart,widow,et ale to James F.Taggart dated
July 23,1936 and recorded in the Recorder's Office for said
County in Deed Book 609 page 105.
5.That your petitioner and his wife,Helen M.Taggart,
have agreed to purchase a portion of said tract of land for the
price of $500.00,the portion being conveyed being more particular y
bounded and described as follows:
BEGINNING at an iron pin in the center line of

the Northwest corner of land of Alexander and
Helen M.Taggart as described in Deed Book 840
page 228,said iron pin being further located,
South 82°29'East 679.9 feet from the Northwest
corner of the larger tract of land known as the
James F.Taggart farm;thence in said public
road,North 12°50'East 150.48 feet to a point;
thence continuing in said public road,North 25°
12'East 93.17 feet to a point;thence continuing
in said public road,North 39°36'East 118.76
feet to a point in said public road;thence through
the larger tract of land of which the parcel herein
conveyed is a part,South 3°15'East passing
through an iron pipe at 30.15 feet a distance of
842.03 feet to an iron pipe;thence through said
larger tract South 75°41'West passing through
an iron pipe at 155.09 feet a distance of 170 feet
to a point in the public road beforementioned;
thence in said public road,North 3°15'West
261.09 feet to a point in said public road at the
Southwest corner of land of the said Alexander

EXCEPTING AND RESERVING all the coal in and
underlying said parcel of land together with mining
rights as heretofore conveyed of record in Deed Book

6.That the only other parties-interested in said
estate in addition to your petitioner who is a son of decedent
are the following children of the decedent,namely:Mary Louise
Hunter and Harold Leroy Taggart,both of whom are sui juris and
who have approved the said sale as indicated by their written
consent attached hereto.
WHEREFORE,petitioner prays Your Honorable Court uunde
section 546 of the Fiduciaries Act of 1949 for leave to petitioner
and his wife,Helen M.Taggart,to purchase the property above
described for $500.00 and requests Your Honorable Court to direct
the Clerk of the Orphans'Court Division of the Court of Common
Pleas of Washington County to execute and deliver a deed for said
property to your petitioner and his
