The petition of Phoebe Riggle,respectfully
represents:
1.Viola Sampson a/k/a Mrs.Charles Sampson,late
of west Finley Township,Washington County,Pennsylvania,died
at the Ohio Valley Hospital,Wheeling,West Virginia,on
December 12,1970,intestate,and Letters of Administration upon
her estate were issued to your petitioner by the Register of Wills
for Washington County on January 6,1971.
2.That the only real estate owned by decedent
at the time of her death was the following:

situate in East Finley Township,Washington County,
Pennsylvania,bounded and described as follows:

operation of this conveyance all the coal of the
Pittsburgh or River Vein in and underlying the thre
tracts of land above described,together with all
the mining rights,privileges,etc.as set forth in
deed of George Plants to Frank P.Grafflin dated
June 20,1905,and recorded in the Recorder's
Office£or said County in Deed Book 321 page 417.
BEING the same as conveyed to Viola M.Sampson
by deed of John C.Sampson,per Administrators,
dated December 2,1930 and recorded in said Recorde 's
Office in Deed Book 576 page 222.The said Viola
M.Sampson a/k/a Viola Sampson died December 12,
1970 and Letters of Administration upon her estate
were issued by the Register of Wills for said Count
to Phoebe Riggle on January 6,1971.
3.That your petitioner has entered into an
agreement to sell the real estate described above to Wayne Thomas
and Dora Lulu Thomas,his wife,for the price of $8,500.00,a
copy of said agreement of sale being attached hereto and made a
part hereof.
4.That attached hereto are affidavits of two
responsible persons familiar with real estate values certifying

that $8,500.00 is the fair market value of said property and a
better price than could beohtainedat public sale.
5.That the ~ersonal estate of decedent consists
of household furniture appraised at $182.00 and bank accounts
amounting to $6727.72.
6.That your petitioner has heretofor filed Bond
with the Register of Wills for said County with Travelers
Indemnity Company as surety in the amount of $2,000.00.
7.That the 6nly persons interested in the balance
of decedent's estate are Phoebe Riggle,Alta Boyd and Nellie
Hicks,all of whom are sui juris,pursuant to a Family Agreement
entered into by all the heirs dated January ,1971,a copy
of which is attached hereto and made a part hereof.Said
interested parties have consented to the presentation of this
petition as indicated by the Joinder attached hereto and made a
part hereof.
WHEREFORE,petitioner prays Your Honorable Court
under Section 541 of the Fiduciaries Act of 1949,for a Decree
fixing·the amount of security.which the Court may determine to
be posted by your petitioner in ord r to consummate said sale.

Between PHOEBE RIGGLE,Administratrix of Estate of Viola Sampson,late of
West Finley Tm'1nship,Washington County,Penna.----(hereinafter called "Seller")and
WAYNE THOMAS of R.D.#1,West Finley,Washington County,Pennsylvania--
--------------------------------------------------(hereinafter called "Buyer").
WITNESSETH,that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows:

1.Seller agrees to sell and convey to buye/on or before April 1,1971 .
by Trustee's warranty deed in fee simple absolute,clear of all mortgages,judgment liens
and tax liens and other encumbrances affecting its marketability (except as hereinafter set forth)all the real property
described in Paragraph 8 hereof.
2.Buyer agrees to purchase said real property and to pay Seller therefor the sum of EIGHTY FIVE
HUNDRED AND NO/lOO----------($8,500.00 )Dollars as follows:the sum of Five
hundred and no/IOO ($500.00)dollars on execution 6f this agreement,receipt
whereof is hereby acknowledged,and the balance of Eight thousand and no/IOO

9.If Buyer defaults in payment or performance for thirty days,Seller may,at Seller's election,
use one or more of the following remedies in addition to or instead of any other remedies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer
shall surrender this ,Agreement for cancellation;

WHEREAS,Viola Sampson a/k/a Mrs.Charles Sampson,
died December 12,1970,a resident of West Finley Township,
Washington County,Pennsylvania;and
WHERE.A.S,Letters of Administration upon her Estate
were issued by the Register of Wills oJ Washington County to
Phoebe Riggle on January 6,1971;and
WHEREAS,the said Viola Sampson had prepared in her
own handwriting a testamentary document dated March,1964,copy
of which is attached to this agreement;and
WHEREAS,the parties hereto,being all the heirs at
law of said decedent,and the only persons entitled to inherit
under the Intestate Laws of the Commonwealth of Pennsylvania,
desire to carry out the intentions of the decedent as expressed
in said testamentary document.
NOW THEREFORE,in consideration of the premises and
intending to be legally bound hereby,James F.Sampson,Effie
McDonald,Adeline Richey,Lester Sampson,Phoebe Riggle,Alta
Boyd and Nellie Hicks,covenant and agree by and with each other
as follows:
1.The household goods and household furnishings
shall be distributed to the undersigned at the appraised value
of each item,unless the same has been previously sold by the
Administratrix.
2.Upon completion of the administration of the
estate of Viola Sampson by Phoebe Riggle,the duly appointed
administratrix,and payment of the costs of administration,
debts and inheritance taxes,the balance of the proceeds of
said estate shall be awarded by the Judge of the Orphans'Court
Division of the Court of Common Pleas of Washington County,

MR.SIEGEL:If Your Honor please,in this estate this decedent
executed a holographic paper which apparently she presumed was a
Will,but she failed to sign it at the end.Consequently,it was not
,probatable,and we took out Letters of Administration on this estate.
However,all the parties named in the Will entered into---the alleg d

decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement showing which of the beneficiaries named in the decedent's will,if any,died prior

That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including fUneral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fUdiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and Impaid at time of
death;taxes accrued chargeable for period prior to decedent's death (except those allowed under Section
