HUGH J.GRAHAM,m-------}jJJ1e Mr.Adam L.Sanders Attorney at Law Washington Trust Building Washington,Pennsylvania Re:Emma Belle Lemley Estate Claim of Michael W.Schafer Dear Mr.Sanders: Thank you for your letter of September 16,1971 and the enclosure of the Will of Emma Belle Lemley. I had sent the opinion of the case,In Re Estate of Mary Elizabeth Tilliski because it stands for the proposition that the share-of the adoptive child relative the true parents estate is not cut down by virtue of the adoption.Rather, the adopted child still has the right to inherit from the trueparent.. I am sendinica copy to you of Chap.3,Sec.49,Illinois Revised Statutes, which may be more in point on the detail in this case where the decedent had a will. The purpose of the statute is,of course,to prevent a lapse of a gift where a descendant of the decedent dies before the dec~dent and that descendant himself leaves persons surviving him who are likewise heirs of the decedent.. - It would seem in this case a reading of this act would be that Michael Lemley, now Schafer, grandchild of Lloyd Lemley, the named beneficiary, would take in substitution the share of Lloyd Lemley,Lloyd Lemley having predeceased the testator,Emma Belle Lemley.. Thank you for your attention to the matter. I am sending a copy of both this letter and the enclosure for your Judge.' I appreciate the courtesies you have extended me and Michael Schafer.
