PETITION TO SETTLE SMALL ESTATE
The petition of Mildred M.Day respectfully represents:
1.The decedent,Walter T.Day,died on January 6,1970 a resident
of HoustoIl,Washington County,Pennsylvania and his post office address was
218 Hodgson Avenue~Houston,Pennsylvania.
2.Your petitioner,whose address is also 218 Hodgson Avenue,
Houston,Pennsylvania is the widow of the decedent.
3.The decedent and the petitioner were married on June 28,1928
in Moon Township,Allegheny County.1 Pennsylvania.
4.The decedent left a Will dated the 8th day of August,1-963 which was
probated on Decemb~r 22,1970 but letters testamentary have not been granted.
5.'The petitioner is the sole heir of the said decedent by virtue of
Item No.:2 of ,such Will,a copy of which is attached hereto as an exhibit.
6.The petitioner is entitled to the family exemption.
7.The decedent had prior to the time of his death filed a patent
application with the Commissioner of Patents designated No.862,232 for a
gauge apparatus and method for cutting uniformly spaced tenons and mortises.
This application has a fair market value of $685.00.
8.All of the bills of the Estate have been paid and there are no unpaid
claimants"

WHEREFORE the petitioner requests this Court to direct distribution
of the Estate unto her and to award the patent application unto her as her
family exemption.

I,WALTER T.DAY,a resident of Houston,Washington County,
Pennsylvania,being of sound and disposing mind,memory and understanding,do
hereby make,publish and declare this my Last Will and Testament hereby revok-
ing any and all Wills by me heretofore made.
ITEM 1..I direct that all my just debts and funeral expenses be paid as
soon after my decease as may be found convenient.
ITEM II.I give,devise and bequeath all the property,both real,
personal and mixed,of which I may die seized to my wife,Mildred M.Day,
ITEM III.In the event my said wife,Mildred M.Day,should predecease
me or in the event we should be killed as a result of a common accident,I do
hereby give,devise and bequeath all of my estate both real,personal and mixed
to my son,Reed B.Day,and to my daughter Marjorie Day Breth share and share
alike.
ITEM IV.I hereby nominate and appoint my wife,Mildred M.Day,to
be the Executrix of this my Last Will and Testament.In the event she should be
unable or unwilling to ~erve I do hereby nominate and appoint my son,Reed B.
Day,a$Executor of this my Last Will and Testament.
